Ashley St. Clair is an author and conservative commentator whose public profile expanded after she identified Elon Musk as the father of her infant son, petitioned a Manhattan court over paternity and custody, and later appeared in the documentary Musk. Her book, Elephants Are Not Birds, is tied to her earlier anti-trans advocacy. The paternity and custody filings, the reported $40 million nondisclosure-agreement offer, and the accusations about Musk’s involvement remain matters of public claims and reporting; the sources available for this profile do not establish a final court ruling.

Who Ashley St. Clair is

Reporting describes Ashley St. Clair as an author, conservative or right-wing commentator, and social-media influencer. Her clearest published author credit is the 2023 children’s book Elephants Are Not Birds. The Advocate linked the book’s message to St. Clair’s earlier anti-trans advocacy and quoted its line, “boys are not girls, and Elephants Are Not Birds.” The Independent also profiled her in February 2025 as an author and influencer.

Her public identity has since become inseparable from a personal and legal dispute involving Elon Musk. On February 14, 2025, St. Clair announced that she had welcomed a baby five months earlier and said Musk was the father. On February 22, The Washington Post reported that she had petitioned a Manhattan court for a legal paternity declaration and sole custody. Those events made her a regular subject of political, celebrity and documentary coverage, but they do not by themselves prove the allegations in the petition or establish a judicial finding.

In January 2026, The Advocate reported that St. Clair publicly expressed regret for her earlier anti-trans statements and said she was trying to learn and advocate for people she had hurt. The publication quoted her saying, “I feel immense guilt for my role,” in reference to the possible effects of her past statements on transgender people. A separate explanation from her friend Emma-Jo Morris, relayed by The Independent, is the friend’s interpretation of why St. Clair decided to go public; it should not be treated as an independently verified account of St. Clair’s motives.

Date What was reported How to understand it
2023 St. Clair published Elephants Are Not Birds. A published book and a record of her earlier anti-trans advocacy.
February 14, 2025 She publicly announced that she had welcomed a baby five months earlier and identified Elon Musk as the father. Her public statement, not a court determination.
February 18, 2025 The Independent published a profile identifying her as an author and influencer and included comments from friend Emma-Jo Morris. Profile context and an attributed friend’s interpretation.
February 22, 2025 The Washington Post reported petitions in Manhattan for legal paternity and sole custody. Procedural filings containing St. Clair’s allegations; no final result is established in the reviewed coverage.
January 13, 2026 The Advocate reported her statement of regret and Musk’s stated intention to seek full custody. Two public positions, not proof that a custody order was entered.
September 8, 2026 Associated Press coverage from the Venice Film Festival described her appearance in Alex Gibney’s documentary Musk and her account of declining an NDA. Her account of negotiations, with the amount and terms not independently verified in the reports reviewed.
October 2026 AP reported that Musk was arriving in theaters. Theatrical-release timing; later streaming or home-media availability was not established by the reviewed sources.

What Ashley St. Clair claimed about Elon Musk

The baby announcement

In the public post reproduced by The Washington Post, St. Clair wrote: “Five months ago, I welcomed a new baby into the world. Elon Musk is the father.” That sentence is the source of the widely reported paternity claim. It is not the same as a genetic test disclosed to the public, a signed acknowledgment of paternity, or a court judgment. The available reporting does not establish that any of those forms of confirmation had been made public.

The Manhattan petitions

The Washington Post reported that St. Clair petitioned a Manhattan court for a legal declaration of paternity and sole custody. The petition presented her account of the relationship and portrayed Musk as absent from the child’s care. The Post said Musk did not respond to its requests for comment at the time. A court petition records what a party is asking a court to decide and the facts that party alleges; it is not itself a ruling.

The Advocate’s January 2026 account described more specific allegations from the petition: St. Clair said Musk had met the child only three times and had no involvement in care or upbringing. Those assertions should remain attributed to her filing. The reviewed reports do not establish whether Musk disputed each factual detail in court, whether genetic testing was ordered, or whether a judge issued a final paternity or custody order.

Musk’s stated custody position

The Advocate also reported that Musk publicly said he would seek full custody after St. Clair expressed regret about her earlier anti-trans statements. That is a statement of intended legal action, not evidence that he obtained custody. The sources reviewed for this profile do not establish the outcome of any later filing, hearing or settlement.

What is known about the custody and paternity case

The safest description of the legal situation is that paternity and custody proceedings were reported as having been filed, while the final disposition remains unestablished in the available coverage. Several distinctions matter:

  • Public announcement: St. Clair publicly named Musk as the father on February 14, 2025.
  • Petition: She reportedly asked a Manhattan court to declare legal paternity and award her sole custody.
  • Allegations: Her petition reportedly described limited contact and no caregiving by Musk.
  • Response reported publicly: Musk was reported as saying he would seek full custody after her January 2026 statement of regret.
  • Unresolved status: The reviewed sources do not provide a final order, a confirmed paternity finding, a custody judgment, or a definitive account of any settlement.

Readers should therefore avoid headlines or summaries that turn the petition into a finding of fact. A current answer would require checking the relevant New York court docket and later filings or orders. Until such documents are established, phrases such as “St. Clair alleged,” “the petition said,” and “Musk said he would seek” are more accurate than categorical statements about legal parentage or custody.

Elephants Are Not Birds: the book behind her author identity

Elephants Are Not Birds was published in 2023 and is the work most often cited when St. Clair’s author background is summarized. The Advocate connected its stated message to her anti-trans activism and quoted the formulation “boys are not girls, and Elephants Are Not Birds.” In context, the book functioned as a children’s-book expression of a political position about sex and gender, rather than as a neutral introduction to animals.

That earlier position is important because St. Clair later said she regretted her role and was attempting to learn and advocate for people she had hurt. The change in stated outlook does not erase the book or its earlier public context, and it should not be presented as proof that every criticism of the book was resolved. It does explain why her 2026 comments generated renewed attention: they represented a public break, or attempted break, with views associated with her best-known book.

The book and the documentary also serve different purposes. The book is a 2023 children’s publication expressing a stated message about sex and gender. Musk is a 2026 documentary in which St. Clair discusses a personal relationship, legal conflict and alleged NDA negotiations. Neither format independently verifies the other’s claims, and the documentary’s inclusion of her account does not turn disputed private allegations into established facts.

What she said about a $40 million NDA

Her Venice Film Festival account

At the 2026 Venice Film Festival, St. Clair appeared in Alex Gibney’s documentary Musk. Associated Press reported that she discussed her relationship with Musk and an NDA she said she declined. AP quoted her saying, “I was offered the opportunity not to speak for $40 million.” Variety also reported her account of declining a $40 million NDA.

The precise status of that alleged offer is narrower than the headline figure suggests. The reports document St. Clair’s statement that such an opportunity was offered; they do not independently establish a signed agreement, the identity of the offeror in a formal document, the terms, the timing, the conditions attached to payment, or whether any money changed hands. The $40 million figure should therefore be labeled as the amount St. Clair assigned to the alleged offer, not as a verified transaction.

Messages and the “10,000 lasers in space” exchange

AP later reported that St. Clair supplied text messages and an audio recording connected to NDA negotiations. The same coverage said a message mentioning “10,000 lasers in space” came from a text exchange between Musk and St. Clair. That detail identifies the reported source of the message; it does not establish what the phrase meant, whether a project was carried out, or that it related to an election.

AP specifically noted that neither the film nor St. Clair claimed Starlink interfered in the 2024 election. The space-laser reference should not be rewritten as an allegation of election interference. Doing so would add a claim that the reporting does not support.

What the documentary adds—and what it does not

Musk places St. Clair’s account within a larger documentary examination of Elon Musk. AP reported that the film was arriving in theaters in October 2026. Director Alex Gibney described the project’s framing to AP as the “reality of what he’s done and unreality of his narrative.” That quotation describes the director’s approach, not an independent finding about St. Clair’s paternity or custody claims.

St. Clair’s participation gives viewers a primary statement from one participant in the disputed relationship, along with materials she says relate to NDA negotiations. It does not supply a publicly established court disposition. The sources reviewed here also do not establish later streaming, rental or home-media availability, so theatrical release is the only distribution window that can be stated confidently from this reporting.

How to separate claims from established facts

Subject What reporting documents What remains unestablished
Musk’s paternity St. Clair’s February 14, 2025 public statement and her reported paternity petition. A final public court finding or other independently documented confirmation.
Musk’s involvement with the child Allegations in St. Clair’s petition, including the claim that he met the child three times and did not participate in care. Whether a court accepted those allegations or what evidence was presented in response.
Custody Her request for sole custody and Musk’s reported intention to seek full custody. The result of any hearing, order, agreement or later filing.
$40 million NDA St. Clair’s statement at Venice, reported by AP and Variety, that she was offered $40 million not to speak. The offer’s documentary terms, enforceability, payment and independent verification.
Text and audio materials AP reported that St. Clair provided messages and a recording related to NDA negotiations. Whether every item is authentic, complete and legally significant, beyond what the reports establish.
Election interference AP reported a text reference to “10,000 lasers in space.” Any claim that Starlink or the exchange involved interference in the 2024 election; AP said the film and St. Clair did not make that claim.

Why the story remains unsettled

The public record described in these reports combines a social-media announcement, a legal petition, competing public statements and documentary testimony. Each type of material answers a different question. A post shows what St. Clair chose to announce. A petition shows what she asked a court to decide and the allegations supporting that request. A public statement from Musk shows his stated position. A documentary interview records what a participant says and what materials she supplies. None automatically substitutes for a final judicial order or independently verified evidence.

That distinction is especially important because the legal issues are private and the public accounts are partial. The reviewed coverage does not establish the present status of the Manhattan case, whether paternity was formally adjudicated, whether custody was awarded to either parent, or whether later proceedings changed the positions reported in 2025 and January 2026. Claims about those outcomes should be checked against dated court records rather than inferred from later interviews or social-media posts.

The concise answer

Ashley St. Clair is a published author and conservative commentator best known for Elephants Are Not Birds, a 2023 children’s book associated in reporting with her former anti-trans advocacy. In February 2025, she publicly identified Elon Musk as the father of her baby and petitioned a Manhattan court for paternity recognition and sole custody. She later expressed regret about her earlier advocacy, while Musk was reported as saying he would seek full custody. In 2026, she appeared in Musk and said she had declined an alleged $40 million NDA offer. Those are the documented public claims and procedural events; the sources reviewed do not establish a final paternity or custody disposition or independently verify the alleged NDA’s amount and terms.
