Elizabeth Holmes can reasonably be described as a manipulator in the investor-fraud sense, while also having been subject to serious personal and institutional pressures. The distinction matters: “master manipulator” is an opinion about documented conduct, not a psychiatric diagnosis or legal label, and “victim” must identify what she was allegedly a victim of. Holmes was convicted of conspiring to defraud investors and of three investor wire-fraud counts. She was acquitted on the patient-related counts, and three additional investor counts ended without a verdict and were later dismissed. The mixed verdict complicates a simple villain story, but it does not erase the evidence supporting the investor convictions.
What did Elizabeth Holmes and Theranos promise?
Holmes founded Theranos in 2003 and remained its chief executive until 2018. The company claimed that a portable analyzer could run a broad range of blood tests from a finger-stick sample, potentially replacing conventional laboratory equipment with faster, cheaper testing.
According to the U.S. Securities and Exchange Commission (SEC), Holmes and Theranos raised more than $700 million from investors through an elaborate, years-long fraud. The SEC said the proprietary analyzer could perform only a small number of tests, while most patient testing used modified commercial analyzers. Theranos also represented that its technology had been deployed by the U.S. Department of Defense in battlefield settings; the SEC said it had not.

Theranos materials said 2014 revenue would exceed $100 million, while the SEC reported actual operating revenue of only a little more than $100,000. Those were not merely optimistic projections detached from a product roadmap; they were claims presented to obtain capital.

Did Holmes knowingly deceive investors?
The prosecution evidence described by the U.S. Department of Justice (DOJ) supports a finding that she did. The DOJ’s sentencing account says Holmes knew the analyzer was not accurate or reliable, understood that it could perform only a few basic tests, and knew it was slower than established devices. Yet investor communications, marketing materials, media statements and financial models continued to present the system as broadly capable and commercially validated.
The evidence also covered claims about Walgreens expansion, military contracts, pharmaceutical-company logos and projected revenue. The Ninth Circuit’s later opinion described employee warnings about accuracy and quality-control failures, as well as a federal laboratory regulator’s finding of “immediate jeopardy” to patient health. The appellate court characterized the vision sold by Holmes and Sunny Balwani as “nothing more than a mirage.”
That combination—knowledge of technical limits, access to contrary internal information and repeated external claims of success—is why calling Holmes a manipulator is defensible as an opinion grounded in the record. It does not require assuming that every statement she made was false or that every person around Theranos was deceived in the same way.

There is a documented basis for a more complicated account, but it is narrower than saying she was a victim of the fraud charges themselves. The Ninth Circuit’s procedural history records that the district court severed Holmes’s trial from Balwani’s after Holmes disclosed abuse in their personal relationship. That disclosure is a serious contextual factor. It may help explain power dynamics, decision-making and why the defense sought to separate the cases.
It is not, however, a judicial finding that abuse caused every charged act. The record does not turn the disclosure into an automatic explanation for investor communications, revenue figures or technology claims. A careful description is therefore “Holmes disclosed abuse in her relationship with Balwani,” not “the abuse proves she could not intend fraud.”

Another possible victim narrative concerns Silicon Valley’s culture of credulity: prominent investors, corporate partners and media outlets accepted an extraordinary story with insufficient scrutiny. That environment can help explain how Theranos attracted money and status. It does not transfer the legal responsibility for statements made by the company’s chief executive to the people who believed them.
How much responsibility did Sunny Balwani share?
Balwani was not a peripheral figure. The Ninth Circuit discussed Holmes and Balwani together when describing the company’s claims, internal warnings and alleged half-truths. His operational role and personal relationship with Holmes are central to understanding Theranos’s power structure.

Shared influence does not mean identical legal responsibility. Holmes’s case was decided on the evidence and counts submitted to her jury. The abuse disclosure and Balwani’s role complicate the story of authority inside Theranos, but they do not cancel the jury’s conclusion that Holmes was responsible for the investor offenses proved at her trial.
Was Holmes convicted of defrauding patients?
No. The jury acquitted Holmes on the patient-related conspiracy count and three patient wire-fraud counts. Three investor counts produced no verdict and were later dismissed. Those outcomes matter: it would be inaccurate to say that every allegation against her was proved.
The acquittals also do not negate the four investor convictions. The jury found her guilty of one conspiracy count involving investors and three investor wire-fraud counts. The Ninth Circuit later affirmed the convictions, sentence and restitution, leaving the investor-fraud judgment intact.

What were the legal and professional consequences?
Holmes received a 135-month federal prison sentence—11 years and three months. The court ordered joint restitution of $452,047,268 to 12 investor victims, according to the U.S. Department of Health and Human Services Departmental Appeals Board’s 2026 decision.
Separately, an HHS administrative law judge upheld a 90-year exclusion from Medicare, Medicaid and all federal health-care programs; the Departmental Appeals Board later affirmed that determination. The exclusion is an administrative remedy rather than an additional prison sentence, but it has profound practical consequences for participation in federally funded health care.
What does the evidence say about the “master manipulator” label?
The label is strongest when limited to the investor case. Holmes occupied the authority of CEO, had access to information about the analyzer’s limitations and continued to promote claims about validation, revenue, military use and expansion that the evidence contradicted. The SEC’s enforcement director put the principle plainly: investors are entitled to “complete truth and candor” from companies and their executives.
The label becomes misleading when it is treated as a clinical diagnosis, a synonym for every Theranos failure or proof that she personally controlled every decision. Likewise, calling her a victim without specifying the alleged victimization—relationship abuse, institutional credulity or another pressure—collapses distinct questions into one emotional verdict.
The most accurate conclusion is therefore two-part: Holmes was a participant in a proven investor fraud, and the record contains serious circumstances that complicate a purely villainous portrait. The convictions establish responsibility for specific conduct; they do not require denying the abuse disclosure or the broader culture that enabled Theranos to flourish.

Where can viewers learn more about the Theranos story?
John Carreyrou’s book Bad Blood: Secrets and Lies in a Silicon Valley Startup provides a detailed account of Holmes and Theranos; Penguin Random House lists the paperback under ISBN 9780525431992. The documentary The Inventor: Out for Blood in Silicon Valley, identified by Time as featuring whistleblowers, journalists and other people connected to Theranos, offers a film-based companion. Availability can vary by country and platform.
Frequently Asked Questions
What does a 90-year HHS exclusion actually prevent?
It bars Elizabeth Holmes from participating in Medicare, Medicaid and all other federal health-care programs for the exclusion period. That administrative sanction is separate from her criminal sentence and is designed to protect federally funded programs, not to add prison time.
Why did the court hold separate trials for Holmes and Balwani?
The district court severed the trials after Holmes disclosed abuse in her relationship with Balwani. Separate proceedings allowed each defendant’s evidence and defenses to be considered without automatically importing the other person’s relationship history into the jury’s evaluation.
What does a jury’s failure to reach a verdict on some counts mean?
A no-verdict count is not an acquittal or a conviction; it reflects that the jury did not unanimously resolve that charge. In Holmes’s case, the three unresolved investor counts were later dismissed, while the four investor counts on which jurors did reach guilty verdicts remained in force.
Is “master manipulator” a legal finding in Holmes’s case?
No. Courts decide whether specific statutory offenses were proved beyond a reasonable doubt. “Master manipulator” is a descriptive opinion that should be tied to the documented investor communications and conduct rather than presented as a diagnosis or formal legal conclusion.
