Brendan Devine survived a knife attack outside Magennis’s bar in Belfast on 31 January 2005, but his friend Robert McCartney, a 33-year-old father of two, died beside him. Devine says the assault escalated after he identified Gerard “Jock” Davison, whom reports described as a senior IRA figure, and that he later received threats. Those claims are Devine’s testimony, not findings established by a court. The murder remains without a conviction: three men were acquitted at trial in 2008. The three-part documentary Murder in Belfast: Sisters Seeking Justice revisits the killing, the McCartney family’s international justice campaign and the case’s impact on Northern Ireland’s peace process.
What happened to Robert McCartney and Brendan Devine?
The confrontation began inside Magennis’s bar after an argument reportedly involving a rude gesture. Devine says he was attacked with bottles and had his throat cut. The violence then moved outside, where McCartney was beaten and stabbed. McCartney died from his injuries; Devine survived with a serious abdominal stab wound as well as the throat injury.
Reports say up to 70 people were in the pub. Despite the crowd, no witnesses came forward to identify the attackers. That silence became central to the later investigation and to the McCartney family’s campaign for justice.

Who was the IRA figure Devine says wanted him dead?
Devine says he believes the attack intensified after he named Gerard “Jock” Davison. Contemporary reporting described Davison as one of the most senior IRA figures in Belfast. Davison was killed in a Belfast gun attack in 2015.
Devine has also said he received death threats and was warned that speaking publicly could put him in danger. The documentary presents these statements as his account. They should not be read as a court-established finding that Davison ordered an attack or that any particular person intended to kill Devine.
“I don’t feel guilty for the actual happening but I do worry that my big mouth could have inflamed the situation, and got Bert killed.”

Devine says he was diagnosed with post-traumatic stress disorder after McCartney’s death. He has described guilt over whether his words escalated the confrontation and says he later met the IRA four times.

Why was the McCartney murder never solved?
The available reporting points to a combination of witness silence and damaged or missing evidence, rather than a single procedural failure.
Witnesses did not identify the attackers
Although the bar was reportedly crowded, no one came forward to name those responsible. Fear, community pressure and the presence of powerful local actors have all been discussed in coverage, but the precise reasons individual witnesses stayed silent were not established in court.
Potential evidence was compromised
CCTV was taken and destroyed, according to the report. Possible forensic traces may also have been wiped when the bar was cleaned with bleach. These accounts explain why investigators had little reliable material to connect suspects to the killing; they do not by themselves prove who destroyed evidence or why.
The IRA’s parallel investigation
The IRA initially denied involvement. It later said three members had been involved, including two “high-ranking volunteers”, and said it had expelled them. That was the organisation’s reported statement, not a judicial verdict.

Devine testified that the IRA conducted a secret investigation alongside the police inquiry and that he only fully cooperated with police after receiving IRA clearance. He changed parts of his account in the witness box but denied doing so to match another witness.
What happened at the 2008 trial?
Three men went on trial in 2008 and all were acquitted. Because there was no conviction, the killing is still described as unsolved. An acquittal means the prosecution did not establish guilt to the criminal standard; it is not a finding that investigators proved nothing happened.
The case therefore has two separate records: a documented death and assault, and unresolved questions about who carried them out and whether intimidation prevented witnesses from giving evidence. No person should be identified as McCartney’s killer without a new authoritative legal finding.

What remains unresolved?
- Who precisely carried out the assault that killed McCartney and injured Devine.
- Whether destroyed CCTV, cleaning of the scene or missing forensic traces could have supplied decisive proof.
- Why potential witnesses did not identify attackers despite the reported crowd.
- How much Devine’s account changed because of trauma, fear, later contacts or ordinary differences in memory; the 2008 court did not convict anyone.

He was 33 and was described as a father of two. He was killed on 31 January 2005 after leaving Magennis’s bar in Belfast.
Why did the McCartney sisters campaign internationally?
