No—power of attorney (POA) does not automatically let another person see or control everything. An agent may use only the authority written into the document and permitted by the law governing it. Health-care and financial POAs are separate legal tools, and a broad document still does not combine every medical, banking and personal power. The answers below explain what an agent can access, when authority begins, and how to set safeguards.
Can someone with power of attorney see everything?
No. The document’s wording controls the agent’s authority, subject to state, provincial or national law. A limited POA might authorize one real-estate closing or bank transaction; a broad POA can cover many legal acts but still does not grant every possible health-care, financial and personal power.
Start by identifying the type of authority. A health-care POA concerns treatment and medical information. A financial or property POA concerns money, accounts and other property. One document may not cover both, and institutions may require the relevant document before disclosing information or accepting instructions.
| Comparison point | Health-care POA | Financial or property POA |
|---|---|---|
| Authority type | Medical decisions and records related to the representation | Banking, property and other financial acts stated in the document |
| Scope | Limited or broad, as written and allowed by health-privacy law | Limited or broad, as written and allowed by local law |
| Activation | May be immediate or begin when the patient lacks capacity | Depends on the activation language and governing jurisdiction |
| Geography | HIPAA applies in the United States; other countries and regions have different rules | State, provincial or national law and institutional requirements apply |
| Oversight | Providers may evaluate whether the person is a valid representative | The agent must keep records and follow fiduciary duties |
| Ending or revocation | Follow the document and local rules; some health-care authority can pause when capacity returns | Follow the document and local rules for revocation, registration and acceptance |
Read every optional power rather than relying on labels such as “durable,” “general” or “lasting.” Those labels do not replace the actual grant of authority.

Does a POA let my daughter see my medical records?
In the United States, a person given health-care POA generally has access to records related to that representation, to the extent allowed by the HIPAA Privacy Rule. The U.S. Department of Health and Human Services states: “Yes, an individual that has been given a health care power of attorney will have the right to access the medical records of the individual related to such representation to the extent permitted by the HIPAA Privacy Rule at 45 CFR 164.524.”
HHS explains that a currently effective personal representative generally has the patient’s HIPAA access rights for relevant information, including mental-health information. Separately maintained psychotherapy notes are different: HIPAA does not include those notes in the representative’s ordinary access right.
When can a provider withhold access?
A provider may decline to treat the person as the patient’s representative when it reasonably suspects abuse, neglect, violence or endangerment and believes withholding access is in the patient’s best interests. That is a case-specific judgment, not a blanket rule that every family member with a document is entitled to every record.
Can a POA agent see or use my bank accounts?
A financial POA can authorize an agent to conduct banking transactions while the account remains in the principal’s name. The agent normally presents the POA to the bank and must stay within the powers it grants. Authority over one account or transaction does not automatically extend to every account or asset.

The Consumer Financial Protection Bureau warns that giving someone POA could allow that person to withdraw money without permission. The agent is not the owner merely because the bank accepts the document; the legal authority comes from the POA and applicable law.
How is a trusted contact different?
A trusted contact is not a substitute for an agent. The CFPB describes a trusted contact as someone a financial institution may notify when it suspects exploitation; that person does not receive access to the money merely by being listed as a contact.
When does POA authority start and end?
Look for the document’s activation clause. Some POAs operate as soon as they are signed and accepted. Others are “springing” arrangements that begin only after a specified incapacity determination. The exact trigger, evidence required and institutions’ procedures vary by jurisdiction and by POA type.

HHS notes that some health-care POAs are effective immediately, while others begin only when the patient lacks capacity and stop when capacity returns. A financial POA may use different language, so do not assume the health-care rule applies to banking authority.

Registration, revocation and termination mechanics also differ across jurisdictions. Guidance for a lasting power of attorney in the United Kingdom, for example, illustrates a country-specific system; it is not a universal rule for people in the United States, Canada or elsewhere. Confirm the governing law before signing, revoking or relying on a document.
Can I still make my own decisions after signing a POA?
Signing a POA does not by itself erase the principal’s ability to make decisions. Whether an agent can act immediately, or only after incapacity, depends on the document and local law. Where a health-care POA is triggered by incapacity, the agent’s role is tied to that condition; HHS notes that authority can stop when capacity returns.
If you want to retain control while adding help, the document can state a later activation date, narrow the transactions covered, require notice, name co-agents or require recordkeeping. These options must be drafted to fit the jurisdiction rather than copied from a generic form.

What limits and safeguards apply to an agent?
An agent is a fiduciary. The CFPB identifies core duties that include acting in the principal’s best interest, managing money carefully, keeping the principal’s funds separate and maintaining complete records. The Florida Bar similarly explains that an agent may perform only acts specified in the POA or reasonably necessary to carry them out.

Government guidance in Saskatchewan also emphasizes honesty, good faith, best interests and staying within granted authority. It states that a property attorney cannot make or change a will, a restriction that demonstrates why local law matters.
Checklist for the person granting authority
- Label the document as health-care, financial or both, and verify that the law allows the combination you want.
- Read each optional power and delete or narrow powers you do not intend to grant.
- State when authority starts, what evidence of incapacity is required and when it ends.
- Set co-agent, notice, monitoring and recordkeeping rules if appropriate.
- Give copies only to institutions that need them, while keeping the signed original secure.
- Obtain advice from a lawyer licensed where the POA will be used before signing a broad form or when abuse is suspected.
If a bank will not accept the document, ask for the specific reason and have counsel review both the POA and the institution’s requirements. Do not assume that a form accepted in one jurisdiction or by one institution will be accepted everywhere.

Act quickly if an agent is using funds outside the document’s authority. Preserve statements and other records, contact the relevant institution to explain the concern, and obtain local legal advice about revocation and protective remedies. Revocation procedures, notice requirements and the effect on transactions already made depend on the governing law and the POA’s terms.

Frequently Asked Questions
Can a power-of-attorney agent change my will?
A property agent generally cannot make or change the principal’s will; Saskatchewan government guidance states that limitation explicitly. Because testamentary rules differ by jurisdiction, have a local lawyer confirm the restriction that applies where the document is used.
What should I do if my bank refuses my power of attorney?
Ask the bank to identify the missing formality, date, certification or other reason for refusal. Then have counsel review the POA and the bank’s stated requirements; acceptance practices are not identical across institutions or jurisdictions.
Do rules from a UK lasting power of attorney apply in the United States?
No. UK lasting-power-of-attorney guidance describes a UK system and cannot be used as a universal rule elsewhere. The law of the place governing the POA, plus the institution’s procedures, determines registration, activation and revocation.
