An upside-down American flag has a formal meaning as a distress signal: the U.S. Flag Code says the blue field of stars, called the union, should not be displayed downward except to signal “dire distress” in extreme danger to life or property. In public life, the inverted flag is also used as protest. The setting can offer clues, but the flag alone does not prove what a particular person intends.
What the Flag Code says
Under 4 U.S.C. § 8(a), “The flag should never be displayed with the union down, except as a signal of dire distress in instances of extreme danger to life or property.” The union is the blue canton containing the stars.
The exception is specific: it describes extreme danger to life or property, not simply dissatisfaction, grief, or disagreement. The Congressional Research Service reproduces the same statutory wording in its 2025 report on flag law.
Why it is also used as a protest symbol
People have used an inverted flag to express the view that the country or its government is in crisis. The Associated Press documents its use by anti-Vietnam War demonstrators and in later political protests, including the “Stop the Steal” movement. AP also reported renewed displays after Donald Trump’s 2024 New York verdict. These are examples tied to particular events, not evidence that the symbol belongs to one party or always communicates the same claim.

For a documentary or news viewer, the useful distinction is between the symbol’s conventional distress meaning and the message conveyed by its setting. A flag displayed alongside protest signs or at a rally is likely being used as political expression; a genuine emergency could support the distress interpretation. Neither context lets an observer state an individual’s motive with certainty.
What it means legally—and what it does not
The Flag Code gives a standard for displaying the flag; that wording alone does not establish that every upside-down display is a crime. The legal treatment of expressive conduct is a separate question. The Congressional Research Service discusses Spence v. Washington (1974), in which a student hung an upside-down flag bearing a peace symbol as a protest. The Supreme Court treated the act as symbolic speech.

That case is not a blanket ruling about every display or every circumstance. The Code’s display guidance and First Amendment questions should not be collapsed into a claim that inversion is automatically illegal—or that all settings have identical legal rules.

Half-staff is a separate mourning convention: the flag remains correctly oriented but is lowered on its pole. USAGov’s guide to the American flag and national symbols identifies deaths of officials, military members or emergency responders, national tragedies, and remembrance days among common occasions for flying it at half-staff. Lowering a flag in mourning does not mean turning it upside down.
