The Staircase on Netflix: Why the 8-Part Max Drama—and the Case Behind It—Still Defies a Clear Answer

Netflix carries both the 2022 scripted drama The Staircase and Jean-Xavier de Lestrade’s documentary. Here is how they differ, what happened in the Peterson case, and why the final legal outcome did not settle the factual dispute.

Short answer: Netflix currently carries two different productions called The Staircase: the eight-episode scripted drama released as an HBO Max Original in 2022, and Jean-Xavier de Lestrade’s documentary series about the same case. The scripted series is the one most closely matching the familiar description of HBO’s eight-part miniseries.

Neither version settles the central question of what happened to Kathleen Peterson. Michael Peterson was convicted of first-degree murder in 2003, later won a new trial after serious questions arose about prosecution bloodstain analyst Duane Deaver, and resolved the case in 2017 with an Alford plea to voluntary manslaughter. He was not exonerated, but he also did not confess to intentionally killing Kathleen. The legal case ended; the factual argument did not.

Which The Staircase is on Netflix?

The title is confusing because Netflix currently associates it with two separate productions:

  • The 2022 scripted drama: an eight-episode limited series created by Antonio Campos, with Colin Firth as Michael Peterson and Toni Collette as Kathleen Peterson. It was originally released as an HBO Max Original, before the service was rebranded as Max.
  • The documentary series: Jean-Xavier de Lestrade’s observational true-crime production, which follows Peterson, his family, his lawyers, and the long legal fight after Kathleen’s death. Netflix’s current package combines the original documentary material with later follow-up episodes and is commonly presented as a 13-episode collection.

Netflix lists the 2022 production as a TV-MA drama based on true events. It separately lists the documentary as a 2018 documentary package describing a 16-year judicial battle. They share a title and subject, but they are not interchangeable.

If you came for the HBO/Max miniseries: choose the eight-episode scripted drama starring Colin Firth and Toni Collette. If you want direct access to the original courtroom story and the evolving legal record, choose the documentary afterward.

What happened in the Peterson case?

On December 9, 2001, Kathleen Peterson was found dead at the bottom of a staircase in the couple’s home in Durham, North Carolina. Michael Peterson said she had fallen. Investigators and prosecutors argued that she had been assaulted and killed.

The physical scene became the center of the dispute because it appeared capable of supporting competing interpretations. The prosecution developed a homicide theory, while the defense argued that Kathleen’s death was an accident. The case was not simply a question of whether one person’s account sounded more persuasive. It involved disputed interpretation of injuries, blood evidence, household circumstances, relationships, finances, and events from the family’s earlier history.

At trial, the state also introduced evidence concerning Peterson’s finances, relationships, sexuality, and the earlier death of family friend Elizabeth Ratliff. Prosecutors used those subjects as part of a broader theory about motive and Peterson’s character. Their presence in the trial record does not, by itself, establish what happened on the staircase.

The legal timeline, without the usual shortcuts

2011 A new trial was granted after litigation concerning SBI bloodstain analyst Duane Deaver’s conduct and credibility. The forensic controversy weakened confidence in the path by which the original conviction had been obtained. It did not, on its own, prove that Peterson was innocent.
February 24, 2017 Peterson entered an Alford plea to voluntary manslaughter. The plea resolved the criminal case while allowing him to maintain that he was innocent. He received credit for time served and left custody.

The final point is the one most often misstated. An Alford plea is not an exoneration, and it is not the same as a conventional confession. Peterson accepted the legal consequences of a voluntary-manslaughter conviction while not admitting that he intentionally killed Kathleen. The plea ended the prosecution without producing a universally accepted factual explanation.

Why the case still does not make sense to viewers

1. Legal finality and factual certainty are different things

Courts need a legal disposition. Viewers looking at a documentary or drama often want something else: a complete, emotionally satisfying account of what happened. Peterson’s 2017 Alford plea supplied the first but not the second.

There is therefore no contradiction in saying that the case was legally resolved and still feels narratively unresolved. Peterson was not cleared of responsibility, but the final plea did not require him to say that he deliberately killed Kathleen. The prosecution’s position and Peterson’s stated position remained fundamentally opposed.

2. The forensic controversy damaged confidence in the original conviction

Bloodstain analysis played a significant role in the original prosecution. Later litigation focused on Duane Deaver, an SBI analyst whose conduct and credibility became central to the push for a new trial. The controversy did not establish an alternative cause of death by itself. It did explain why the original conviction could not simply be treated as the final word on the evidence.

This distinction matters. Problems with one part of a prosecution’s forensic presentation can undermine confidence in a trial without proving the defendant’s innocence. The evidence may become less reliable without a competing explanation becoming proven.

3. A documentary with unusual access is still a perspective

De Lestrade’s documentary benefited from unusually close access to Peterson, his family, and his defense team. Cameras observe courtroom strategy, family conversations, interviews, and the legal process over many years. That access gives the documentary an intimacy that is unusual in true crime.

It also makes perspective important. The documentary is closely connected to Peterson and his defense. Viewers should distinguish among three categories:

  1. What the camera records: courtroom proceedings, interviews, meetings, and events observed during production.
  2. What participants claim: Peterson’s account, the defense’s theories, the prosecution’s arguments, and statements from family members or experts.
  3. What a court determined: the conviction, appellate decisions, the new-trial litigation, and the 2017 plea.

Those categories overlap, but they are not identical. A compelling interview is not a judicial finding, and an edited documentary sequence is not a transcript of the entire case.

4. The scripted series interprets events rather than reproducing a transcript

Antonio Campos’s 2022 production is a dramatization. It does not only recreate the death and the courtroom proceedings; it also explores the Peterson family, the defense team, the prosecutors, and the making of the documentary itself.

That approach gives the drama a wider subject than a straightforward courtroom reenactment. It can ask how families perform loyalty, how lawyers construct a narrative, and how filmmakers become part of the story they are recording. But scripted scenes should be treated as adaptations. The fact that a conversation appears in the series does not establish that the conversation occurred exactly as shown.

5. Alternative theories have outlived the courtroom

The case has generated theories ranging from an unusual accidental fall to the much-discussed possibility of an owl attack. These ideas are part of the case’s cultural afterlife, but they should not be presented as established findings.

The careful formulation is that such explanations remain disputed theories advanced by particular commentators or supporters. They were not adopted by the courts as definitive conclusions. The same caution applies to the competing homicide theory: it was the prosecution’s position and supported the original conviction, but the later procedural history means responsible coverage should explain the evidentiary dispute rather than state a contested reconstruction as an unquestionable fact.

The drama and the documentary: a practical comparison

What the 2022 drama adds

The eight-part drama is not merely a shorter version of the documentary. Its subject includes the machinery of storytelling around the case. Alongside the Peterson family and legal teams, it depicts the French filmmakers who turned the proceedings into an international documentary story.

That makes the series a useful companion to the documentary, but not a replacement for it. The drama can show how a case might be understood through different emotional and professional viewpoints. It can also compress time, combine incidents, or create dialogue for dramatic purposes. Its accuracy should be assessed at the level of the broad historical premise, not by assuming that every scene is evidence.

The cast is deliberately recognizable, but star power should not be confused with documentary authority. Colin Firth’s performance is an interpretation of Michael Peterson, just as Toni Collette’s performance is an interpretation of Kathleen. The production’s value lies in the questions it raises about the case and its participants, not in converting dramatized scenes into new proof.

How to watch the two versions

Choose the drama first if you want the headline subject

If you searched for HBO’s eight-part miniseries, start with the 2022 scripted version. It is the direct match for the eight-episode description and presents the case as a character-driven limited drama.

The original U.S. release began on May 5, 2022, with three episodes, followed by weekly releases through June 9, 2022. That rollout is one reason older articles may describe it as an HBO Max series even though current service branding uses Max.

Choose the documentary first if you want the case record

Start with de Lestrade’s documentary if your main interest is the original legal battle, the courtroom access, and the changes in the case over time. The Netflix package is longer and more directly connected to the real proceedings, although it remains an edited documentary with its own perspective.

Watch both if you want to understand why the story persists

The most revealing order is often documentary first, drama second. The documentary establishes the case and its legal chronology. The drama then becomes an interpretation of the people and institutions surrounding that story, including the filmmakers themselves.

Watching them in the opposite order also works. In that case, the documentary can help separate the scripted series’ dramatic choices from the underlying record. Either way, neither production should be used as the sole basis for declaring what happened.

Where to watch

Netflix’s U.S. catalog currently lists both the 2022 drama and the documentary package under the title The Staircase. Availability is territory-specific and can change, so viewers outside the United States should search their local Netflix catalog rather than assume that both versions are included everywhere.

If you prefer to own the scripted adaptation, look for The Staircase: Limited Series DVD. A catalog listing identifies a U.S. release dated December 27, 2022, with approximately 520 minutes of content. Seller, condition, and stock can vary, especially for physical media, so check the current listing before buying. Owning the DVD provides a home-video copy of the drama; it does not provide new evidence about Kathleen Peterson’s death.

How to discuss the case responsibly

  • Say that Peterson was convicted in 2003, but also explain that the conviction was later undermined by litigation over the state’s bloodstain analysis.
  • Use the exact 2017 outcome: an Alford plea to voluntary manslaughter.
  • Do not call Peterson exonerated. The plea resolved the case but did not establish his innocence.
  • Do not call the plea a murder confession. An Alford plea allowed Peterson to accept the conviction’s legal consequences without admitting that he intentionally killed Kathleen.
  • Label disputed theories as theories. The owl explanation, an accidental fall, and a deliberate killing are not interchangeable levels of established fact.
  • Keep the productions separate. The documentary records and edits real proceedings; the 2022 series dramatizes them.
  • Do not treat every prosecution detail as proof. Evidence about finances, relationships, sexuality, or Elizabeth Ratliff’s earlier death formed part of the state’s case, but those subjects do not independently establish what happened on the staircase.

The real reason The Staircase remains compelling

The case is not compelling merely because it contains a famous defendant, a death at the bottom of a staircase, or an unusual alternative theory. It endures because each layer of the story answers some questions while reopening others.

The original trial supplied a verdict. Appellate litigation exposed problems in the forensic presentation. The new-trial process ended in a negotiated plea rather than a second jury verdict. The documentary supplied years of access but also a perspective shaped by its relationship with Peterson and his defense. The scripted series added another layer by dramatizing the family, the legal teams, and the filmmakers.

More context therefore does not produce a single uncontested explanation. It exposes the difference between a legal judgment, a forensic claim, a participant’s account, an edited documentary, and a scripted interpretation. That is why The Staircase can feel unfinished even though the criminal case has been over since 2017.
