Amazon’s decision to add limited advertisements to Prime Video exposed a weakness in annual streaming plans: paying upfront may lock in a price without locking in the service’s features. U.S. subscribers sued after ads appeared during existing annual terms, but a federal court dismissed the consolidated case on July 16, 2025. A separate Australian Competition and Consumer Commission (ACCC) proceeding, filed June 30, 2026, is still testing whether Amazon used unfair contract terms. The practical lesson is current even without a U.S. consumer victory: annual billing is a discount, not necessarily a guarantee that a service will remain unchanged.
How the Prime Video dispute began
Amazon announced in September 2023 that Prime Video would introduce limited advertisements unless customers paid an additional fee. Ads began appearing for U.S. subscribers in January 2024. Wilbert Napoleon, a California resident, filed the original complaint on February 9, 2024, seeking class-action treatment.
The complaint did not simply argue that advertising is undesirable. Its central theory was that customers who had already purchased annual Prime subscriptions had paid for a commercial-free Prime Video experience and were being charged again to keep it. Related claims were later consolidated in federal court.

What an annual subscription does—and does not—promise
Streaming contracts often combine several different promises. A customer may be buying a defined period of access, a bundle of benefits, and a particular commercial or technical experience. Those are not necessarily the same thing.
- Fixed price: the amount charged for the subscription term.
- Fixed bundle: the features included when the customer signs up.
- Advertising promise: whether viewing is represented as commercial-free.
- Changing catalog: the titles available under licenses that can expire or change.
The plaintiffs argued that Amazon’s historical commercial-free presentation created expectations about the product they bought. Amazon relied heavily on contract language reserving the ability to change offerings, prices, services and available titles, subject to applicable law. A customer expectation is not automatically a legal right; whether a change violates a contract or consumer-protection law depends on the wording, the facts and the jurisdiction.
What happened in the U.S. lawsuit
The federal court dismissed the consolidated action on July 16, 2025. The order is recorded in Napoleon v. Amazon.com Inc..
That result means the lawsuit, as pleaded, did not produce a successful class-action judgment, a nationwide right to refunds or a court-ordered ad-free benefit for annual subscribers. It does not establish that every future change to every annual streaming plan is lawful, nor does it amount to a blanket ruling that a provider may always add advertising during a paid term. The court considered the particular claims and the Prime and Prime Video contract terms presented in that case.

Customers therefore should not read the dismissal as proof that they were automatically entitled to a refund—or that a refund is automatically unavailable. Any remedy still depends on the applicable contract, purchase channel, local law and the facts of an individual account.
Why the Australian proceeding matters
On June 30, 2026, the ACCC filed Federal Court proceedings against Amazon Australia. The regulator alleges that Amazon’s standard-form Prime contracts used between November 2023 and August 2025 contained five unfair terms that allowed negative changes during an annual subscription without an adequate remedy. The ACCC says Amazon relied on those terms when Prime Video advertising was introduced in Australia on July 2, 2024.
The ACCC states that more than one million annual subscribers were exposed to the relevant terms and that more than 850,000 annual subscribers existed when advertising began. It cites an annual Prime price of A$79 and an ad-free surcharge of A$2.99 per month. Those figures and subscriber counts are allegations in the regulator’s case, not findings. Australian consumer law and U.S. contract law are different. The ACCC case cannot determine what a U.S. subscriber’s contract means, but it demonstrates that broad change clauses can remain subject to consumer-law scrutiny.

Prime Video’s U.S. structure in 2026
Amazon’s March 13, 2026 announcement describes a Prime membership whose included video benefit carries limited ads, alongside a paid Prime Video Ultra option.

Amazon says the included Prime benefit supports HD, HDR10, HDR10+ and Dolby Vision, while 4K/UHD and Dolby Atmos are Ultra features. Ultra is not literally free of every advertisement: Amazon says live television, live events and select other ad-supported programming may still contain ads. The $45.99 annual Ultra option is not automatically included with every annual Prime membership; eligible annual Prime members must choose it. Twelve monthly payments total $59.88, so the annual option saves $13.89, or about 23.2%, when used for a full year.
The risks of paying for a year upfront
Product degradation
A provider can introduce advertising, move features to a premium tier, reduce download or stream limits, or alter video and audio quality. The Prime Video dispute focused on advertising; contemporaneous reporting also discussed concerns about Dolby Vision and Dolby Atmos access. Amazon’s later 2026 product description shows why the exact date and tier matter: Dolby Vision is described as part of Prime’s included benefit, while Dolby Atmos is associated with Ultra.

Catalog churn
A subscription normally grants access to a changing library, not ownership. Licensed films and series can leave when rights expire, and originals can become unavailable. The removal of one title is not automatically equivalent to changing the commercial experience for every program.
Price and tier changes
A service can keep a headline price while reducing what is included or adding a surcharge for the experience customers previously preferred. A new premium tier may preserve a feature without preserving it at the original price.
Refund friction
Annual customers have already paid, so leaving after a mid-term change can be more difficult. Refund rules vary by provider, purchase channel, jurisdiction, usage and the account’s cancellation terms. Do not assume a prorated refund is available.
Reduced leverage
Monthly billing usually lets a customer leave at the next billing date. An annual subscriber may instead have to accept the change, negotiate with support or seek help from a consumer-protection authority.

When annual billing can still be sensible
An annual plan is not inherently a bad choice. It can be rational when:
- You expect to use the service throughout the year.
- The savings remain meaningful after accounting for likely cancellations.
- You use the broader bundle, such as Prime delivery, shopping, music or sports benefits, rather than evaluating video alone.
- You accept that catalogs, features and commercial terms may change.
- The terms provide a clear remedy for material changes.
- The exact tier you want is available on annual billing.
For Prime, compare the whole bundle on Amazon’s Prime page. A streaming-only calculation can undervalue Prime for a household that uses delivery and shopping benefits, while overstating its value for someone who watches only occasionally.
Use a months-of-use calculation
The relevant formula is:
Effective monthly cost = annual price ÷ months you expect to use the service
For example, $139 spread across six months of actual Prime use is about $23.17 per month of use. The annual price may still be worthwhile if delivery and other benefits matter, but the discount is not meaningful if you would otherwise subscribe only during selected months.
Checklist before choosing an annual plan
- Confirm whether the plan is genuinely annual or merely billed annually.
- Check whether the feature you care about is expressly included in the terms.
- Look for language permitting advertising or changes to resolution, downloads, concurrent streams and audio formats.
- Find out what happens if a major feature is removed: automatic refund, prorated refund, discretionary credit or no stated remedy.
- Check whether cancellation ends access immediately or at the end of the paid term.
- Identify who handles billing if you purchased through Apple, Google, Roku, a mobile carrier or another intermediary.
- Compare the annual price with paying monthly only during the months you watch.
- Read separate terms for live sports, channels, rentals and other add-ons.
If the service changes during your term
- Save the original sign-up page, promotional language, confirmation email, invoice and relevant terms.
- Record when the ads or feature change first appeared and what content was affected.
- Open the account’s cancellation and refund screen, but review the result before confirming cancellation.
- Ask customer support in writing whether a refund, credit or adjustment is available.
- Keep the case number and the support transcript.
- If a third party billed you, check that seller’s cancellation and refund rules.
- If the issue remains unresolved, contact the relevant consumer-protection authority.
These steps preserve evidence and clarify your options; they do not create a refund entitlement where the contract or law does not provide one.
Bottom line for streaming subscribers
The U.S. Prime Video lawsuit ended without a nationwide consumer win, while the ACCC’s Australian case remains unresolved. Together, the cases show the central risk of annual streaming plans: the upfront payment may be fixed even when the product is not. Annual billing can save money for a committed user, but monthly billing costs more in exchange for the ability to leave when advertising, features, catalog or pricing changes no longer fit.
