California Attorney General Rob Bonta announced an investigation on January 14, 2026, into xAI and its Grok AI model after reports that users were creating and sharing nonconsensual sexualized images of women and girls, including people who appeared to be minors. Grok was integrated into X, which is why the social platform is central to the story, but the announcement named xAI and Grok rather than X as a standalone investigation target. Two days later, Bonta sent xAI a cease-and-desist letter demanding immediate steps to stop the alleged conduct.
What California is investigating
The attorney general’s office said it was examining reports that Grok could be used to turn ordinary photographs of identifiable people into sexually explicit or “undressed” images without their consent. Some of the reported material allegedly depicted women and girls, including apparent minors, and was then posted or circulated through X.
The January 14 announcement used investigative language. It said the office would determine whether and how xAI violated California law; it did not declare that every reported image or allegation had been proven. The release also cited an analysis of 20,000 xAI-generated images in which more than half allegedly showed people in minimal clothing, with some appearing to involve children. That figure was an analysis cited by the attorney general, not an independently established government census.
The inquiry can examine more than individual user behavior. It may also consider whether Grok’s design, safeguards, moderation, promotion or business practices enabled or facilitated unlawful creation and distribution.

Who was the target: X, xAI or Grok?
xAI
xAI is the company that developed Grok. The attorney general’s investigation and later letter were directed at xAI over the model’s alleged conduct and the company’s role in operating it.
Grok
Grok is xAI’s AI model and chatbot, including image-generation and image-editing capabilities. The releases described a so-called “spicy mode” as a feature capable of generating explicit content and said xAI had promoted that capability. An explicit-content feature is not, by itself, proof that every use is unlawful; the issue raised by the investigation was the alleged sexualization of identifiable people without consent and, most seriously, material involving minors.

X
X is the social platform where Grok was available and where generated images were reportedly posted or shared. The January 16 letter described Grok as developed by xAI and integrated with X, and said X was owned by xAI. Therefore, the most precise description is that California investigated xAI over Grok’s alleged generation and dissemination of sexualized deepfakes, including through X, rather than simply saying it investigated “X.”

Bonta described an “avalanche” of reports about users generating sexually explicit material involving women and children without permission. The office said the activity appeared to be occurring at large scale. Reports involving people who appeared to be under 18 raised separate child-sexual-abuse-material concerns, regardless of whether an image was synthetic or based on an ordinary photograph.
Age, consent, identifiability, context and what happened to an image after generation all matter legally. A sexualized image is not automatically a nonconsensual intimate image, and private generation, public posting, threats to distribute and actual distribution can present different legal questions.

What the cease-and-desist letter demanded
On January 16, Bonta escalated the matter with a cease-and-desist letter. It demanded that xAI immediately stop:
- Creating, disclosing or publicizing sexually explicit digital material depicting a person without consent.
- Facilitating or aiding the creation, disclosure or publication of that material.
- Creating or facilitating AI-generated images depicting anyone under 18, or appearing to be under 18, in sexual conduct or simulated sexual conduct.
The letter gave xAI five days to confirm what corrective measures it had taken. That window reached January 21, 2026. The official material available for this account does not establish what xAI submitted, whether California accepted any response or whether the company’s steps satisfied the office.

California laws identified by the attorney general
The cease-and-desist announcement identified several provisions as potentially applicable:
- California Civil Code § 1708.86: a civil-law provision concerning nonconsensual distribution of intimate images, including digitally altered material in circumstances covered by the statute.
- California Penal Code §§ 311 et seq.: provisions addressing sexually explicit material involving minors.
- California Penal Code § 647(j)(4): a criminal provision concerning specified nonconsensual recording or distribution of intimate material.
- California Business and Professions Code § 17200: California’s unfair-competition law, which can reach unlawful, unfair or fraudulent business practices.
The attorney general identified these laws as possible legal theories; no court ruling in the cited material had found xAI liable under them. A cease-and-desist letter is an enforcement demand, not a judicial judgment. The legal analysis could differ between generation, publication, distribution, aiding or facilitating conduct, and a company’s response to reports or requests for removal.

TechCrunch also reported that X’s safety account said users who prompted Grok to create illegal content could face consequences. Those statements are Musk’s and X’s positions, not findings that resolve the attorney general’s investigation.

The material available for this article does not verify a substantive xAI response to the cease-and-desist demands. Secondary reporting described restrictions on image editing shortly after the controversy, but the official sources reviewed here do not establish the scope, durability or effectiveness of any such changes.

What remains unresolved
- Whether xAI complied with the letter and what safeguards, if any, it changed.
- Whether California later filed a lawsuit or took additional enforcement action.
- Whether the attorney general ultimately found violations of any cited law.
- How many images involved real, identifiable people and how many involved minors.
- How responsibility would be divided among users who created or posted material, xAI as the model developer, and X as the distribution platform.
The investigation also illustrates two separate prevention problems: stopping an image from being generated and stopping it from spreading after generation. Embedding an image model in a social network can make both problems harder, while material involving children creates especially serious risks.
For people affected
California’s attorney general directed potential victims to report the matter through oag.ca.gov/report. Avoid downloading, reposting or linking to abusive images. Preserve relevant information safely, such as account names, dates and non-explicit URLs, and consider contacting law enforcement or a qualified legal-support organization if there is an immediate threat or ongoing distribution.
Status
