YouTube 24/7 Stream Copyright Rules for Indian Film Songs and Karaoke Tracks

A continuous YouTube stream or karaoke backing track does not make Indian film music copyright-safe. Check recording and song rights, livestream and archive permissions, and Content ID allowlisting before going live.

No: playing Bollywood film songs or commercial karaoke tracks on a 24/7 YouTube livestream is not made copyright-safe by streaming continuously, owning a copy, or using a backing track. You generally need permission covering both the particular sound recording and the underlying music and lyrics, for the specific uses you plan—including the live broadcast and any saved archive. YouTube can still interrupt a licensed stream if the rights owner has not allowlisted your channel in Content ID.

What YouTube can do when a live stream contains music

YouTube says all live streams are scanned for matches to third-party content, including another copyrighted live broadcast. If it detects a match, it may replace the stream with a placeholder and warn you to stop using the material. If the material remains, YouTube may temporarily interrupt or terminate the stream. A copyright or Community Guidelines strike can also end a live broadcast.

That is platform enforcement, not a final ruling on who owns a song or whether a particular use is legally authorized. YouTube says it does not decide copyright ownership. A stream continuing without a warning likewise does not prove that the music was cleared.

A licence may not prevent an automated interruption

YouTube advises creators who have licensed third-party material to ask the owner to add their channel to the Content ID allowlist. A stream may be interrupted even when you have a licence—including when you limit the stream to territories where you hold the necessary rights—if the channel has not been allowlisted. Confirm the licence and the owner’s process for preventing or resolving live interruptions before scheduling a broadcast.

The archive can be claimed after the broadcast

If you choose to archive the livestream, YouTube says Content ID claims can be made after the live stream ends. Depending on the rights holder’s settings and the relevant geography, a claim can block the video, monetize it for the rights holder (sometimes sharing revenue), or track its viewership. A claim on an archive and an interruption during the live broadcast are separate events to monitor.

Why film songs can require more than one permission

India’s Copyright Act, 1957 recognizes separate copyright in works such as musical and literary works, films, and sound recordings. Section 14 includes rights to reproduce and communicate relevant works to the public; the Act also says copyright in a film or sound recording does not erase separate copyright in a work used to make it.

For a film song, check at least two layers: the underlying musical or literary work (including lyrics where relevant) and the particular sound recording. A permission for the recording should not be assumed to clear the composition or lyrics, or vice versa. The relevant owners, licence terms, territories, platforms, duration, live use, archive use, and monetization rights depend on the specific song and recording; ownership of any particular title cannot be inferred from the fact that it is a film song.

Original covers, karaoke backing tracks, and film recordings are not interchangeable

Using a new performance may mean you are not using the original film-song master recording, but that alone does not establish that the underlying composition and lyrics are cleared for a YouTube livestream. A purchased karaoke file also does not prove that you may publicly stream it, save an archive, or monetize either use.

Material in the stream Recording question Underlying-work question What YouTube’s guidance establishes
Your own cover performance with a newly made accompaniment Whether the original master recording is used depends on how the recording was made; a new performance does not itself use that original master. Permission for the composition and lyrics still needs to be checked for the intended live and archived uses. YouTube says some creator-made covers may be eligible for monetization if the music publisher claims the song through Content ID and elects to monetize it. If it has not been claimed, YouTube says to obtain explicit written permission beforehand. This is monetization guidance, not a general livestream licence.
Commercial karaoke or instrumental recording The karaoke or instrumental recording is a separate recording whose use must be covered. Permission for the underlying song should not be inferred from permission to use the backing recording. YouTube says commercial sound recordings such as karaoke recordings are not eligible for monetization. That statement does not by itself resolve every legal question about a particular use.
Original film-song recording Permission must cover the specific sound recording and the planned use. The underlying musical or literary work remains a separate rights layer to check. YouTube’s live-content matching and enforcement procedures may apply; a licence does not necessarily prevent an interruption without Content ID allowlisting.

For each option, separately verify permission for public livestreaming, any archive or video-on-demand, monetization, territory, duration or repeat schedule, and any Content ID allowlisting required by the owner. YouTube’s monetization guidance does not establish that a track is legally cleared for every livestream use.

Does Indian law provide an exception for a 24/7 music stream?

Do not assume that a public continuous music stream is permitted just because it is free, short, noncommercial, or described as fair use. Section 52 of the Copyright Act lists specific exceptions, including fair dealing for private or personal use, criticism or review, and reporting current events or current affairs. Whether an exception applies depends on the facts; YouTube cautions that even a use a creator believes qualifies can receive a claim, and only a court can determine whether an exception applies.

Section 31D describes a statutory licence for a “broadcasting organisation” that communicates certain previously published literary or musical works and sound recordings by broadcast or performance, subject to statutory conditions including notice and royalty requirements. The statutory text alone does not establish that an individual creator’s YouTube livestream qualifies or that its procedures have been satisfied. Get advice from a qualified Indian copyright lawyer before relying on section 31D or an exception for a public music stream.

How to check rights before scheduling the stream

  1. Inventory the material. List each song and the exact recording, cover performance, or karaoke track you intend to use. Do not treat a song title as identifying a single rights holder or recording.
  2. Obtain written permissions for the relevant layers. Confirm that the relevant sound recording and underlying musical or literary works are covered. The terms should expressly address YouTube livestreaming, any archive or VOD, monetization, territory, and the intended duration or repeat schedule.
  3. Confirm the channel’s Content ID status. Ask each relevant rights owner or administrator whether the channel must be allowlisted, and confirm that the allowlisting is active before going live.
  4. Check restrictions and repeats. Ask whether the permissions cover continuous or repeated streaming and whether they limit territories, advertising, archives, or other platform uses.
  5. Monitor the broadcast and its archive. Watch YouTube Studio for warnings or interruptions during the live stream and check afterward for claims or strikes. Keep copies of licences and related correspondence.
  6. Get India-specific advice where needed. Consult a qualified Indian copyright lawyer before relying on section 31D or a statutory exception for your particular stream.

What monetization options do—and do not—solve

YouTube says creators need the rights necessary to use audio and visual elements commercially. Its general copyright guidance identifies permission, a relevant exception, public-domain status, or applicable licensing terms as possible routes, but none guarantees that a Content ID claim or strike will not occur.

Creator Music is not a general workaround for an Indian 24/7 livestream. YouTube’s help guidance describes the service as available to creators in the US YouTube Partner Program, with expansion outside the US pending, and says revenue-sharing tracks cannot be used in live streams. Eligible creators should check current availability and each track’s usage terms in YouTube Studio; a listing should not be treated as livestream clearance where its terms do not allow that use.

YouTube’s special live Content ID matching is for selected rights-owner partners using Studio Content Manager. It requires a proven rights-management record, time-sensitive live content, worldwide rights, and exclusive ownership of the content in the stream. It is a rights-management tool, not a way for a creator to obtain permission to play film songs.

Or let it run in the cloud

StreamNeo is an operational option for keeping an already-cleared YouTube stream running; it does not license songs, establish ownership, or prevent copyright enforcement. You upload a recording or make a playlist, add your YouTube stream key, and go live. StreamNeo loops the uploaded video from the cloud, so no computer or home connection has to stay on. Your video streams as uploaded, up to 4K 60fps, at one price per slot; automatic recovery can restart the stream if YouTube drops it. The first day is free with no card, and the monthly option is $9.99 per month. UPI and cards are accepted in India. Learn about StreamNeo, then start the free day after confirming you have the rights for your stream.
