Why Stephen Colbert Says CBS Wouldn’t Air His James Talarico Interview

Stephen Colbert said CBS lawyers told The Late Show it could not broadcast James Talarico’s interview. CBS disputed that account, citing legal guidance and options tied to possible FCC equal-time obligations.

Stephen Colbert said CBS lawyers told The Late Show it could not broadcast an interview with Texas Democratic Senate candidate James Talarico. CBS disputed that description: the network said it gave the show legal guidance about possible FCC equal-time obligations and options for addressing them, after which the show chose to publish the interview on YouTube. The public accounts do not establish exactly what was said in the private legal conversation or whether the FCC would have found the rule applied.

What Colbert said—and how CBS responded

On The Late Show, Colbert said Talarico had been scheduled to appear but was kept off the broadcast after the network’s lawyers intervened. “He was supposed to be here, but we were told in no uncertain terms by our network’s lawyers, who called us directly, that we could not have him on the broadcast,” he said, according to CBS News on February 18, 2026.

CBS’s public account was different. The network said, “THE LATE SHOW was not prohibited by CBS from broadcasting the interview with Rep. James Talarico.” It said the show received legal guidance that a broadcast could trigger equal-time obligations involving two other candidates, including Representative Jasmine Crockett, and was given options for meeting any such obligations. The show chose to put the interview on YouTube and promote it on air, CBS said. CBS News reproduced the network’s statement.

Those statements describe competing accounts of the decision, not an independently documented transcript of the lawyers’ conversation. It is therefore more precise to say Colbert characterized the decision as a prohibition, while CBS described legal guidance and available options—not that a confirmed FCC order barred the interview.

What the FCC equal-time rule means

The equal opportunities rule, commonly called the equal-time rule, generally requires a broadcast station that gives airtime to one candidate to provide comparable opportunities to opposing candidates in the same contest if they request them. The obligation is not simply an automatic requirement to give every rival identical airtime whenever a candidate appears. The rule and its exemptions are summarized by the FCC’s political programming guidance.

The rule applies to broadcast radio and television. It does not apply to cable, streaming services, or social media in the same way, which is why the YouTube publication was distinct from putting the interview on CBS’s broadcast signal. The public material cited in this dispute does not show that an opposing candidate had requested comparable time.

Exemptions for certain programming

The law includes exemptions for bona fide newscasts and interview programs, live-event coverage, and documentaries. Whether a particular program qualifies can matter: if an appearance falls within an exemption, the equal-time requirement may not apply in the usual way.

Why late-night interviews became a legal concern

In January 2026, the FCC issued guidance questioning whether daytime and late-night talk shows automatically qualify for the bona fide news exemption. The guidance raised the possibility that a program’s partisan motivation could be relevant. It was a notice and warning about how the exemption might be assessed, not a completed rule change eliminating the exemption.

Colbert also said the exemption had not yet been removed. In its public explanation, CBS said its lawyers saw potential equal-time obligations in the Talarico broadcast and offered options for addressing them. The available accounts do not establish that the FCC had ruled this specific interview was covered by the rule or that it had ordered CBS not to air it. The FCC’s January 2026 guidance is the relevant agency context.

Why YouTube mattered

The disagreement concerned the interview’s appearance on broadcast television. The equal-time rule applies to broadcast stations, not to a YouTube upload in the same way. Publishing the conversation online therefore allowed the show to make it available outside the CBS broadcast, while CBS’s stated concern was about potential obligations tied to airing it on broadcast TV.

What Commissioner Anna Gomez said

FCC Commissioner Anna Gomez criticized the episode as a capitulation to political pressure. That was her characterization, not an FCC finding that the agency had pressured CBS or ordered the interview removed. Gomez said the FCC “has no lawful authority to pressure broadcasters for political purposes,” according to Ars Technica’s report on her February 17, 2026 statement.

What is established—and what remains disputed

  • Colbert’s account: CBS lawyers told the show it could not put Talarico on the broadcast.
  • CBS’s account: the network did not prohibit the interview; it provided legal guidance and options concerning possible equal-time obligations, and the show chose YouTube publication.
  • The legal context: the equal-time rule applies to broadcast radio and television, with exemptions that include qualifying interview programs. FCC guidance had questioned whether late-night talk shows automatically qualify, but had not formally eliminated that exemption.
