He pointed to the company’s aversion to publicity and said many of its U.S. executives were on green cards. That was McGowan’s prediction—not an official decision. The company said it had not made or distributed the video and had not granted permission to use its intellectual property.
What was in the DHS video?
In September 2025, the Department of Homeland Security posted a video titled “Gotta Catch ’Em All.” It combined Pokémon anime material with footage of law-enforcement agents detaining people in an ICE-related enforcement and recruitment context. Fans called on the intellectual-property owner to take legal action, according to Nintendo Life’s September 25, 2025 report.
Why did McGowan think the company would hold back?
McGowan gave two reasons for his view in the Nintendo Life interview. First, he described The Pokémon Company International as unusually publicity-shy, saying it preferred to let the brand speak for itself. Second, he said many of the company’s U.S. executives were on green cards. He added that, even if he still worked there, he would not touch the matter, and predicted the controversy would fade within days.
The green-card point is McGowan’s claim; the cited coverage does not independently verify executives’ immigration status or show that it drove a company decision. His comments explain his own forecast, not a confirmed legal strategy.

What did The Pokémon Company officially say?
The company’s statement, reproduced by Nintendo Life, said: “We are aware of a recent video posted by the Department of Homeland Security that includes imagery and language associated with our brand. Our company was not involved in the creation or distribution of this content, and permission was not granted for the use of our intellectual property.”
The statement disavowed involvement and permission, but did not announce a lawsuit or say that the company had decided against one. McGowan’s prediction and the company’s statement are different things: one is a former executive’s assessment of what might happen; the other is the company’s position on its connection to the video and authorization for its use.

Does that mean Pokémon cannot sue?
No. The reports cited here establish neither a final legal outcome nor a court or regulator finding about any potential claim. A statement that permission was not granted is not itself a legal ruling, and McGowan’s prediction does not establish that the company has permanently ruled out action. The most accurate conclusion is that the company publicly denied involvement and authorization, while its former legal chief expected it to avoid a public fight.

In March 2026, The Pokémon Company responded to a separate White House social post that used imagery associated with Pokopia. Spokesperson Sravanthi Dev said the company had not created or distributed that content, had not granted permission, and was not affiliated with any political viewpoint or agenda. Nintendo Life reported that response on March 6, 2026. It concerned a different post; it was not an update on the 2025 DHS video or a reported legal action concerning it.
