The more plausible casualty is the first generation of startups that trained on major-label recordings without clear permission, then tried to negotiate after building their products. The cases are pushing AI music toward licensed data, costlier compliance and a smaller group of well-capitalized survivors.
What the record companies allege
On June 24, 2024, major record companies filed separate U.S. lawsuits against Suno and Udio through the Recording Industry Association of America (RIAA). The complaints allege that the companies copied large quantities of copyrighted sound recordings without permission to train commercial music-generation systems.
The Suno complaint alleges willful infringement and argues that copying threatens both today’s market for sound-recording licenses and a future market in which AI companies would pay to train on those recordings. The Udio complaint similarly alleges that recordings from Universal, Sony and Warner were used in training and seeks damages, injunctions and other restrictions.
Those are allegations, not final findings. The cases concern specific companies, evidence and legal theories; they do not establish that every form of AI training is unlawful.

These are two cases, not one universal “RIAA lawsuit”
- UMG Recordings, Inc. et al. v. Suno, Inc. was filed in the U.S. District Court for the District of Massachusetts.
- Atlantic Recording Corp. et al. v. Uncharted Labs, Inc.—Uncharted Labs is Udio’s legal entity—was filed in the U.S. District Court for the Southern District of New York.
The proceedings have developed differently through settlements, amended claims, discovery and later litigation.
Why “style” is not the whole copyright question
Copyright does not give an artist ownership of every mood, genre, instrument or production convention. The legal analysis can involve several different interests:
- Musical compositions: melody, harmony and lyrics.
- Sound recordings: a particular recorded performance and its fixed sounds.
- Performers’ and publicity rights: including disputes over a recognizable voice or persona.
- Trademarks and branding: names and identifiers that may create consumer confusion.
A song that evokes a genre is not automatically an infringing copy. Courts may examine what was copied for training, whether protected recordings were reproduced or memorized, the output’s similarity, the jurisdiction and the market effect. “In the style of” is therefore not a complete legal test.
The timeline has moved beyond a simple startup-versus-label fight

The Sony figure was 30,117 recordings; Sony’s allegation remains contested in litigation. The settlement terms do not establish their payment amounts or a universal licensing template. Major questions in the U.S. cases remained unresolved as of August 16, 2026.

Why the economics can produce a bloodbath
A company can lose without waiting for a final judgment. It may face years of legal fees, intrusive discovery, potential damages, settlement demands, new license payments and the cost of retraining a model whose performance depends on disputed material.
The cost stack
- Retrospective exposure: resolving alleged past copying.
- Prospective licenses: paying for training, output generation or distribution going forward.
- Retraining: removing disputed data and rebuilding evaluation, filtering and safety systems.
- Compliance: provenance records, audits, geographic restrictions and artist-consent systems.
- Customer risk: deciding whether the platform indemnifies commercial users or leaves them exposed.
Investors are consequently likely to ask for dataset provenance before valuing model quality. A startup whose advantage depends on catalog access that can be withdrawn may be worth less than a slower company with documented, permission-based data. Smaller firms may be unable to fund both litigation and licensing, leading to shutdowns, distressed acquisitions or consolidation.
Settlements point toward licensed partnerships, not surrender
Warner’s settlement with Suno and Universal’s settlement with Udio suggest a two-track strategy: labels can litigate to preserve leverage while converting viable AI companies into licensed partners or controlled distribution channels. This is an inference from the settlement pattern, not a published industry-wide rule.
A likely structure could include negotiated training rights, retrained or supplemented models, label payments or equity, limits on downloads and monetization, and controls over artist names or voices. The AI company gains legitimacy and continued access; the label gains money, oversight and influence over product design. Sony’s continuing conflict with Udio shows that no general peace has been reached.

Why a shakeout could help AI—and why it could hurt everyone else
The case for a correction
- It discourages “train first, negotiate later” business plans.
- It gives investors a price for data provenance and legal risk.
- It creates incentives for opt-in catalogs, audits and clearer output controls.
- It may produce more durable services instead of speculative products built on uncertain access.
The case against celebrating a bloodbath
- Major labels may become gatekeepers for any commercially useful catalog.
- License fees can raise prices and exclude small developers and independent artists.
- Consolidation can reduce competition among platforms.
- Payments to labels do not automatically reach performers, songwriters or session musicians.
- A licensed product can still displace human work or offer little control to individual artists.
The American Federation of Musicians’ amended July 2026 lawsuit against Universal and Warner alleges that musicians were not properly compensated under union arrangements connected to AI licensing deals, underscoring that label settlements do not resolve distribution disputes. What courts still have to decide
In the United States, fair use is a fact-specific defense, not a declaration that all training is permitted or forbidden. Courts may weigh:
- the purpose and commercial character of the use;
- whether the use is transformative;
- the creative nature of sound recordings;
- the amount and substantiality of copying;
- effects on existing and potential licensing markets;
- whether intermediate copies, access methods or memorized outputs matter; and
- whether generated tracks substitute for licensed recordings.
The July 31, 2026 Munich Regional Court decision against Suno in a GEMA case is evidence of international risk, not a ruling on American fair use. It may strengthen rightsholders’ negotiating position and encourage jurisdiction-specific data controls. The decision could still face appeal or further proceedings. What the lawsuits mean for different music communities
Major-label artists
They may benefit indirectly if labels obtain licensing revenue, settlement value or control rights. Whether money reaches an individual artist depends on recording contracts, accounting and collective arrangements.

Independent artists
They gain a stronger argument for consent, payment and opt-in licensing, but may be shut out if platforms can afford only major-label catalogs.
Session musicians and performers
Being represented by a label does not guarantee a direct share of AI revenue. The AFM litigation illustrates the unresolved question of how performers’ contributions should be valued and paid.
AI-assisted creators
A platform’s commercial-use permission is separate from copyright protection. You may be allowed to exploit a track under contract while lacking an enforceable exclusive copyright in the output.

Before commercial release, verify:
- the plan’s commercial-use scope and generation date;
- whether the platform claims ownership, grants a license or assigns rights;
- what indemnity, takedown and removal protections exist;
- whether the output can be registered or licensed exclusively;
- permissions for uploaded material, voices, remixes and samples; and
- whether a distributor, broadcaster or client imposes stricter chain-of-title requirements.
How startups and investors should evaluate the next phase
For AI companies
- Document every training source and its permission status.
- Check that licenses cover training, generation, distribution, derivatives and voice likeness where relevant.
- Map rights across the United States, Europe and other target markets.
- Build controls against recognizable reproductions and unauthorized artist imitation.
- Model the cost of removing disputed data and retraining.
- Offer clear customer terms rather than implying that a subscription guarantees copyright.
For investors
- Ask whether data is licensed, public-domain, synthetic or undisclosed.
- Review demand letters, preservation notices and litigation reserves.
- Identify whether the moat is the model, data, distribution or a rights-holder relationship.
- Test whether a court order could require retraining or disable service.
- Discount valuations that assume permanent access to unlicensed catalogs.
The likely end state
Generative music will probably survive in a more licensed, expensive, centralized and legally constrained form. The decisive change is not whether software can generate a song; it is who can lawfully obtain the recordings used to build the system, who pays for that access and who receives the resulting value.
“Bloodbath” is therefore a credible description of startup economics: companies, valuations and opaque training practices may disappear while the technology becomes an ordinary—if tightly controlled—part of music production and distribution.
