Supreme Court Upholds TikTok Ban-or-Sale Law: What the Ruling Means

The Supreme Court upheld the law threatening TikTok with removal from U.S. app stores and hosting services unless ByteDance completed a qualified divestiture—but it did not directly order a permanent ban.

The Supreme Court did not directly order TikTok to shut down. On January 17, 2025, the justices unanimously upheld the federal law requiring TikTok’s China-based parent, ByteDance, to complete a legally compliant divestiture or lose access to U.S. app stores and hosting services.

The ruling removed TikTok’s First Amendment challenge to the law. It did not require a permanent prohibition under every future ownership structure. Subsequent enforcement delays and a reported U.S.-controlled transaction allowed TikTok to continue operating in the United States.

The short version

  • What did the Court decide? In TikTok Inc. v. Garland, No. 24-656, the Court upheld the Protecting Americans from Foreign Adversary Controlled Applications Act as applied to TikTok and the petitioners.
  • Was TikTok permanently banned? No. The law created a ban-or-divestiture regime: ByteDance could complete a qualifying divestiture, or U.S. providers could be barred from distributing, hosting, maintaining, or updating the app.
  • Why did the Court uphold it? The justices accepted the government’s national-security rationale and concluded that the law did not burden substantially more speech than necessary.
  • What happened afterward? TikTok briefly went offline in January 2025, resumed service after an enforcement delay, and later continued operating under a reported U.S.-controlled structure.

The most precise description is therefore: the Supreme Court upheld the TikTok ban-or-sale law, not a judicial order permanently banning TikTok.

What law did the Supreme Court uphold?

Congress enacted the Protecting Americans from Foreign Adversary Controlled Applications Act as Division H of Public Law 118-50 on April 24, 2024. The statute applies to designated applications controlled by a foreign adversary. TikTok became its central test case because its parent company, ByteDance, is based in China.

The law set January 19, 2025, as the key deadline. Unless ByteDance completed a “qualified divestiture,” U.S. companies would be prohibited from providing services needed to distribute or operate TikTok. That included app-store distribution and hosting, as well as maintaining or updating the application.

This structure matters. The statute did not make it a crime for every American to open TikTok. Instead, it placed the primary legal obligations on companies that distribute, host, maintain, or support a covered application. Without those services, however, the practical effect could have been a nationwide shutdown.

What counts as a qualified divestiture?

A qualifying transaction required more than selling a U.S. subsidiary or changing TikTok’s management team. Under the statute, the President had to determine that the transaction removed the application from foreign-adversary control and prevented the former foreign-adversary entity from controlling U.S. operations.

The arrangement also had to address prohibited operational relationships, including cooperation involving TikTok’s recommendation algorithm and data sharing. In practical terms, the relevant questions included:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • Who owns the U.S. operation?
  • Who controls its board and management?
  • Who governs user data and security systems?
  • Who controls or licenses the recommendation algorithm?
  • What operational relationships remain with ByteDance or affiliated entities?
  • Who provides cloud hosting and security oversight?

That is why a simple stock sale or rebranding would not automatically have satisfied the law.

Why did the Court reject TikTok’s First Amendment challenge?

The Court’s per curiam opinion recognized that restricting TikTok could affect expressive activity. Users communicate through the platform, and creators rely on it to reach audiences. The Court nevertheless held that the law survived the applicable constitutional review as applied to the petitioners.

The central distinction was between regulating speech because of its viewpoint and regulating the ownership and operational structure of a platform that the government said created national-security risks. The Court treated Congress as targeting foreign control, data access, and influence over the recommendation system—not particular opinions or categories of content.

The government’s stated concerns included ByteDance’s Chinese ownership, Chinese laws that may require companies to assist with intelligence work, TikTok’s large-scale collection of user data, the possibility of access to sensitive information about tens of millions of Americans, and the possibility of foreign control over content recommendations.

Those points should not be overstated. The Court accepted the government’s asserted national-security interest for constitutional purposes; it did not independently establish that Chinese officials had misused every category of TikTok data or directed every recommendation shown to American users.

The Court also concluded that the law did not burden substantially more speech than necessary to address the ownership-related risks identified by the government. The ruling concerned this statute and these petitioners. It did not establish that the government may automatically ban any social-media application it labels a security concern.

Was the decision unanimous?

Yes. The judgment was unanimous, although the opinion was unsigned and the justices did not present a completely uniform set of reasons. Justice Sotomayor and Justice Gorsuch each wrote separately. Describing the result as unanimous is accurate; reducing the entire decision to an undifferentiated “9–0” analysis misses those separate opinions.

What happened in January 2025?

  1. January 17: The Supreme Court upheld the law in TikTok Inc. v. Garland.
  2. January 18–19: TikTok became temporarily unavailable in the United States as the statutory deadline approached.
  3. January 20: President Trump directed the Justice Department to refrain from enforcing the law for 75 days and instructed that penalties not be imposed for relevant conduct during the stated period. The executive order delayed enforcement; it did not repeal the statute.
  4. Later in 2025: The administration issued additional extensions while a divestiture structure was negotiated.

TikTok’s brief outage was therefore not necessarily the final legal outcome. A constitutional ruling, an enforcement decision, an app-store listing, and the app’s underlying ownership are separate questions.

What happened to TikTok’s ownership?

In September 2025, the White House said a proposed U.S.-based joint venture would qualify under the law. The administration described a structure in which ByteDance would hold less than 20 percent and Oracle would serve as the security provider. The White House fact sheet presented the arrangement as a way to preserve the service while addressing national-security concerns.

Associated Press and Axios later reported that the transaction closed in January 2026 and that TikTok continued operating through a U.S.-controlled arrangement. Those closing details should be understood as reported developments unless confirmed through a current corporate or government filing. They also do not mean that every ByteDance connection necessarily disappeared; algorithm governance, data access, security controls, and continuing operational relationships remain important compliance questions.

Is TikTok still banned in the United States?

There is no accurate one-word answer.

The Supreme Court upheld the statute that could remove TikTok from U.S. app stores and hosting infrastructure. The statute remains the governing legal framework. But enforcement was delayed, and the administration later determined that the proposed divestiture qualified. As of August 2026, AP and Axios reported that TikTok continued operating under a U.S.-controlled joint venture.

So the practical outcome was not a permanently unavailable TikTok. It was a legally threatened shutdown followed by enforcement delays and a reported ownership transition. Continued availability depends on whether the resulting structure satisfies the statute and remains covered by the relevant presidential and administrative determinations.

What does the ruling mean for users and creators?

Existing users and new downloads

Had the statute been fully enforced without a qualifying divestiture, U.S. app stores could have been barred from offering TikTok to new users and from providing updates. Existing installations could also have become increasingly unreliable if maintenance and hosting services were restricted.

Updates and security

App availability is not the same as operational support. A user might still have an installed application while losing access to updates, bug fixes, or security patches. Hosting restrictions could also affect the service even if the app remained visible on a device.

Creators, advertisers, and merchants

A shutdown or prolonged service disruption could affect creator income, advertising campaigns, shopping activity, customer communications, and businesses that use TikTok as a marketing channel. The Court’s ruling did not determine how individual contracts, creator earnings, or commercial accounts would be handled.

VPNs and sideloading

A VPN may change the location that a service appears to see, but it does not resolve the legal obligations imposed on U.S. app stores, hosting providers, or other covered service providers. Sideloading or using an alternative access method also would not by itself answer whether the underlying service is lawfully hosted or supported in the United States. The ruling did not create a general safe harbor for circumvention.

What about other apps?

The statute was written to cover more than TikTok and could apply to other applications controlled by foreign adversaries. ByteDance-related applications such as CapCut and Lemon8 became part of the broader policy discussion. That does not mean every ByteDance application automatically received identical treatment. The statute’s definitions, any designation, and applicable presidential or agency action must be examined for each service.

Government devices are a separate issue

The nationwide TikTok law should not be confused with restrictions on government-owned devices. In July 2026, the Justice Department’s Office of Legal Counsel issued an opinion concerning use of the TikTok USDS Joint Venture on federal devices. That development illustrates that government-device restrictions can raise separate questions even after a reported divestiture.

Those restrictions do not, by themselves, determine whether ordinary members of the public may use TikTok on personal devices.

What remains uncertain?

  • Operational control: The legal effect of a reported ownership change depends on who actually controls management, data systems, security, and platform operations.
  • Algorithm governance: A qualifying structure must address the recommendation algorithm and prohibited cooperation with former affiliated entities.
  • Data access: Ownership, hosting, access permissions, and security oversight are related but distinct issues.
  • Future enforcement: A later administration or agency could interpret or enforce the statute differently, subject to the law and further litigation.
  • Future constitutional challenges: The decision was limited to the statute as applied to TikTok and the petitioners. It did not resolve every possible challenge involving another platform, another law, or different facts.

The bottom line

The Supreme Court upheld the federal government’s legal authority to force a choice: ByteDance had to complete a qualifying divestiture, or TikTok could lose the U.S. distribution and hosting services needed to operate. The Court did not itself shut TikTok down, declare all TikTok content unprotected, or guarantee that the app could never return under new ownership.

After a brief January 2025 outage, presidential enforcement delays and a reported U.S.-controlled transaction changed the practical result. The law survived; TikTok’s U.S. operation continued under a structure that the White House said qualified and that news organizations reported had closed in January 2026.
