The finding, announced on March 26, 2026, is not yet a final infringement decision or an announced fine. Each company can inspect the investigation file and submit a response.
The case follows formal proceedings opened on May 27, 2025, focused on age-assurance systems, risk assessments and measures addressing children’s rights, minors’ safety, and users’ mental and physical well-being.
What the EU has—and has not—decided
- Formal proceedings: opened on May 27, 2025, against Aylo Freesites Ltd. (Pornhub), WebGroup Czech Republic (XVideos), NKL Associates s.r.o. (XNXX) and Technius Ltd. (Stripchat).
- Preliminary findings: issued on March 26, 2026. The Commission said all four services failed to protect minors from pornographic content.
- Final liability: not established by that announcement. The companies retain rights of defence, including access to the file and an opportunity to respond.
- Announced fine: none in the cited Commission release.
The Commission’s wording matters: a preliminary finding is a serious enforcement step, but it is not the same as a final decision, court judgment or confirmed penalty.

How the case developed

What the Commission is investigating
Age verification and age assurance
The proceedings examine whether the services use measures that can effectively prevent minors from accessing pornography while providing an appropriately high level of privacy, safety and security. A click-through “I am over 18” prompt is not equivalent to reliable age verification.
The Commission’s 2025 announcement did not prescribe one technical method or say that every user must upload a passport, national identity card or facial video. It required appropriate and proportionate measures, including effective age-verification tools where necessary.

Risk assessment
Large platforms must assess systemic risks created by their services, including foreseeable effects on children’s rights, minors’ exposure to harmful content, and users’ mental and physical well-being.

The investigation also asks whether the platforms took proportionate steps to reduce those risks. The issue therefore extends beyond an entry screen to the design and operation of the services, their controls and their ability to demonstrate compliance to regulators.
Why these platforms receive enhanced scrutiny
The DSA gives the Commission direct supervisory responsibility for designated VLOPs because their scale can create systemic effects. The Commission’s listed figures are reported or assessed using DSA methodology, not necessarily current traffic measurements or figures that can be compared directly with third-party analytics.

Stripchat’s unusual status
Stripchat is no longer classified as a VLOP after the Commission terminated that designation on May 27, 2025. That change does not erase the proceedings or automatically resolve conduct covered by them. The Commission’s enforcement record still shows proceedings opened on May 27, 2025, the designation termination on the same date, and preliminary findings on March 26, 2026.
Its current classification and the Commission’s ability to examine the conduct at issue are separate questions. Nor does the termination mean Stripchat escaped all EU regulation: baseline DSA duties and applicable national rules can still matter.

What happens next
- File access: the companies can inspect the evidence gathered by the Commission.
- Responses: each provider can submit written observations and challenge the Commission’s preliminary assessment.
- Possible remedies: the process can lead to legally binding commitments, orders to change systems or practices, further investigative steps, or a final decision.
- Possible penalties: the DSA permits fines of up to 6% of a provider’s worldwide annual turnover for certain infringements, plus possible periodic penalty payments. That is a statutory ceiling, not a prediction of the outcome here.
The governing regulation is the Digital Services Act. The March 2026 announcement did not identify a final infringement decision or fine.

The EU’s policy challenge is to establish that a user is an adult without creating a database of people’s identities, browsing histories or sexual interests. The Commission’s child-protection recommendations emphasize privacy-preserving approaches rather than a universal identity-document upload.

Possible approaches and trade-offs

A robust system also has to address VPNs and proxies, shared devices, stolen credentials, forged evidence, downloaded copies, mirrored domains and access through services outside EU jurisdiction. These circumvention routes make perfect prevention unrealistic, but they do not remove the platforms’ obligation to use proportionate controls.

What users and operators might notice
No particular change has been confirmed for every service or country. If the proceedings produce remedies or voluntary changes, possible effects include:
- new or repeated age-check screens;
- third-party verification or digital-credential flows;
- country-specific access requirements;
- clearer privacy notices and limits on data retention;
- stricter account, upload or recommendation controls;
- reduced availability in jurisdictions with separate national rules.
EU-level DSA enforcement does not automatically create identical access rules in all 27 member states. National laws, Digital Services Coordinators, court challenges and country-specific decisions can produce different outcomes.
Why the case extends beyond pornography
The Commission is using the DSA to test how large services identify and reduce risks to minors. The wider effort includes social networks, app stores, recommender systems and online marketplaces. National Digital Services Coordinators supervise smaller pornography services, while the Commission directly supervises designated VLOPs.
That division creates a practical enforcement question: if the largest sites adopt stronger controls, will users move to smaller or less compliant services? The case may influence adult platforms, social networks carrying sexual material, digital-identity providers and national age-verification regimes, but it will not by itself eliminate minors’ access or settle every privacy and interoperability dispute.
