You get music-related permissions only if the sale documents expressly grant them, and those permissions depend on what the agreement covers. A token may come with listening access, a defined license, a copyright assignment, or a royalty arrangement; those are different things.
What does a music NFT buyer actually own?
An NFT is a blockchain-recorded token associated with an asset or work. Its ownership record does not, by itself, transfer copyright in the associated music or spell out what the holder may do with it. The terms of the sale must provide any copyright assignment or license. Creative Commons explains that NFT ownership alone does not make the buyer the copyright owner; an applicable public Creative Commons license also remains in force.
In practice, a music NFT may be sold as a collectible, an access pass, or a token associated with separately granted rights. Do not infer permission to download, copy, publish, perform, remix, or use music in a commercial project just because a listing links to an audio file or calls the token a music NFT.
Which music rights can be involved?
A music release can involve at least two distinct copyrights: the musical work—the composition, including melody and lyrics—and the sound recording—a particular recorded performance. The owner of one may not control the other. The U.S. Copyright Office and USPTO note that playing or displaying a linked recording can implicate rights in both, so a grant covering only the master recording may not clear the composition, and vice versa. The agencies’ March 12, 2024 report to Congress discusses these layered rights and possible uses.

The permission needed depends on what you plan to do. Listening to a stream under the seller’s access terms is not the same as copying or distributing the audio. Pairing music with video may raise synchronization-licensing questions; displaying lyrics or notation may involve other rights; materially changing music can raise derivative-work questions. No generic “music NFT license” should be assumed to clear every use. The U.S. Copyright Office advises musicians and users to obtain permission from the copyright holder or follow the license’s terms. See the Copyright Office’s musician copyright guidance.
How to check what rights the sale grants
Find the agreement or license that applies to the listing and sale; promotional language on a page is not a substitute for the operative terms. Check the document against the uses you actually want to make:
- Covered material: Does it identify the composition, the specific sound recording, or both? Who has authority to grant the rights?
- Permitted uses: Does it allow personal listening or downloads only, or also reproduction, public distribution, video synchronization, adaptation, or commercial exploitation?
- Kind and scope of grant: Is it a license or an assignment? Is it exclusive or nonexclusive, and what are its territory and term?
- Transfer and resale: Does the license continue if the token is transferred, and does a later buyer receive the same permissions? Read the agreement rather than assuming that token transfer carries every associated right.
- Money and reporting: If the offer mentions royalties or revenue participation, what revenue is included, how is a share calculated, who reports it, and when and how is payment made?
- Disputes and availability: What does the contract say about disputes, and what happens to access or referenced content if the platform or storage service changes or closes?
These are questions to ask of the particular agreement, not provisions every NFT sale necessarily contains. If the grant is unclear or the intended use is commercially significant, get advice from a qualified lawyer before relying on it.
Do music NFT holders receive royalties?
Not automatically. A royalty share is a separate contractual promise whose scope, conditions, accounting, and payment terms must be established in the sale documents. Owning the token alone does not show that you own part of a song or recording, or that you are entitled to revenue from its use. Likewise, a project’s stated plan to send payments through a token does not establish what rights support that payment or what happens if the terms or platform change.
Resale payments are also distinct from copyright ownership and from income earned when music is used. NFT technology may support downstream resale remuneration and rights management, but that possibility does not mean every transfer produces a payment or that an artist receives one in every transaction. The U.S. Copyright Office and USPTO’s joint NFT study identifies both potential uses and transparency concerns.

How U.S. mechanical royalties differ from an NFT royalty promise
In the United States, Title I of the Music Modernization Act created a blanket mechanical-licensing system for covered digital music providers making and distributing covered digital phonorecord deliveries. The Mechanical Licensing Collective (The MLC) administers collection and distribution of mechanical royalties under that system. Songwriters and publishers must register or claim through The MLC to receive royalties under the blanket license. The Copyright Office’s Music Modernization Act page explains the system.
That statutory process concerns qualifying digital-service uses; it does not prove that a particular NFT buyer owns a royalty share or that an NFT sale grants rights. Composition mechanical royalties should not be confused with sound-recording royalties, public-performance royalties, a platform reward, or a private revenue-sharing contract. Each has a different basis, and a token’s existence does not establish entitlement to any of them.
What U.S. agencies concluded about NFTs and intellectual property
On March 12, 2024, the U.S. Copyright Office and the U.S. Patent and Trademark Office submitted a joint report to Congress. They concluded that current NFT applications did not require changes to intellectual-property law or agency registration and recordation practices. They also described buyer and seller confusion about which rights are involved, as well as the possibility that NFTs could facilitate infringement; they viewed education and product transparency as appropriate responses to that confusion. The Copyright Office’s release announcing the study provides the agencies’ dated conclusion. It is a general NFT finding, not a blanket ruling on a specific music token or contract.
