Chigvintsev, a professional dancer whose tenure on Dancing with the Stars began in 2014, was arrested on suspicion of felony domestic violence in Yountville on August 29, 2024. The Napa County District Attorney’s Office announced its decision not to file charges on September 24, following a review of the investigation and evidence. Was he charged?
No criminal charges were filed by the Napa County DA following the arrest. An arrest on suspicion is not itself a criminal charge, and the DA’s decision was not a court ruling dismissing charges. The distinction matters: the office said it declined to file, rather than that a court had adjudicated the allegations.
Why did prosecutors decline to file charges?
Napa County District Attorney Allison Haley said the office reviewed the investigation and evidence and had an ethical obligation to file only charges supported by the evidence. In the September 24, 2024, release, Haley said: “While we take every arrest seriously and stand firmly against domestic violence, we have an ethical obligation to only file charges when supported by the evidence.” The release explained that prosecutors must prove a case “beyond a reasonable doubt”; if the available evidence does not meet that standard, the office said it cannot ethically file charges. The DA’s release said the office could revisit the matter during the applicable limitation period if it learned of other incidents or previously unknown facts or evidence. The release described a three-year limitation period for felony domestic violence and a one-year period for misdemeanor domestic violence.
