Reporting on the letter said Disney objected both to alleged use of its works to train or power the service and to the generation and circulation of recognizable franchise characters. ByteDance said it would strengthen safeguards against unauthorized intellectual-property use. No court has ruled in this episode that ByteDance infringed Disney’s copyrights, and the reported action was a cease-and-desist demand—not a Disney lawsuit.
What Disney reportedly accused ByteDance of doing
According to Axios and Reuters-based reports, Disney’s letter alleged that ByteDance used Disney material without permission in connection with Seedance 2.0. The reported allegations cover related but distinct issues:
- Model development: Disney said its works were used to train or otherwise power the service without compensation. That is an allegation about model development; public reporting does not establish the complete contents of Seedance’s training data.
- Generation capability: Disney objected to the service’s reported ability to produce videos closely reproducing recognizable characters and franchise elements.
- Outputs and circulation: The controversy included concern that users could create and share videos depicting protected characters. A model’s ability to produce such material does not, by itself, establish how it was trained or determine whether a particular output is legally infringing.
Axios reported that the letter described Seedance as effectively giving users access to a “pirated library” of Disney characters, including properties from Star Wars and Marvel. Later coverage cited examples such as Spider-Man and Darth Vader, but those examples are not a complete list of the works or characters referenced in the letter. Disney demanded that the alleged conduct stop.
What Seedance 2.0 is
ByteDance’s Seed team announced Seedance 2.0 on February 12, 2026. The company describes it as a multimodal audio-video generation model, rather than a text-only video system. Its official materials say users can combine several kinds of references and direct the result with natural-language instructions.

These are product descriptions from ByteDance’s launch announcement and official product page, not independent benchmark findings. ByteDance’s launch material also says demonstrations using character references involved AI-generated or properly licensed subjects, and that real-person references require identity verification or prior legal authorization. Those statements show the company was addressing rights and authorization in its documentation; they do not resolve Disney’s separate allegations.

How ByteDance responded
On or around February 16, Reuters-based coverage reported that ByteDance would take steps to prevent unauthorized intellectual-property use on Seedance 2.0 and improve existing safeguards. The report did not specify the technical filters, review process, geographic scope or enforcement standards involved.

That statement is not an admission of infringement, a settlement, a license from Disney or proof that every Disney character has been blocked. Public reporting also does not establish that ByteDance removed Seedance 2.0, changed its training data, deleted earlier outputs or reached an agreement with Disney.
Disney was not the only studio objecting
Reuters-republished reporting said Paramount Skydance sent ByteDance its own cease-and-desist letter, accusing the company of “blatant infringement” involving Paramount intellectual property. The Motion Picture Association later condemned Seedance 2.0, saying it produced material closely replicating distinctive characters and other protected elements belonging to member studios. Axios reported that the wider concerns included more than fictional characters, extending to other protected elements and likeness issues.

Associated Press coverage likewise placed the dispute in a broader debate over copyright and the use of performers’ identities. The common issue is not simply whether an AI system can make generic fantasy footage, but whether strong reference control makes it easy to reproduce commercially valuable characters, performances, voices or visual identities without authorization.
Why the legal distinction matters
A cease-and-desist letter is a demand backed by the possibility of further legal action. It is not a complaint filed in court and not a judgment. Disney’s allegations could implicate several different legal questions, each requiring its own facts:

- Whether protected works were copied into a training or development process.
- Whether a system retained or reproduced protected expression.
- Whether a particular generated video is substantially similar to protected material.
- Whether distributing or displaying an output creates separate liability.
- Whether trademarks, unfair-competition rules or publicity rights apply to names, branding, likenesses or voices.
The available reports do not identify causes of action formally pleaded by Disney against ByteDance, because no lawsuit in this episode was reported. Character protection is fact-specific: a general archetype is different from a distinctive character design, name, costume, voice or combination of expressive traits. Copyright, trademark and publicity-rights rules can also differ by jurisdiction.

The ByteDance warning fits a broader pattern reported in coverage of Disney’s AI policy. Disney has pursued complaints or legal action involving Character.AI, Google, Meta and Midjourney, while also entering a reported licensing arrangement with OpenAI allowing certain Disney, Marvel, Pixar and Star Wars characters to be used in Sora. That contrast suggests a licensing-based dividing line rather than a blanket rejection of generative AI.

Authorized use can be defined by contract, characters, territories, formats and safeguards. An unlicensed system that can reproduce the same properties raises a different commercial and legal question. The reported OpenAI arrangement is not evidence that Disney has approved unrestricted use of its catalog by AI companies.
What creators and businesses should do
Seedance’s availability or ability to generate a famous character is not a rights clearance. Teams using it or similar tools should treat source assets and outputs as separate risk points:
- Use only footage, images, music, voices and characters that you own or are licensed to use.
- Obtain explicit authorization for a real person’s likeness and voice; do not assume a publicly available image is cleared.
- Check the applicable product edition, territory and terms before commercial use. No reliable public pricing or universal commercial-rights promise was established for Seedance 2.0 in the reporting covered here.
- Keep prompts, uploaded references, licenses, approvals and model terms so the origin of a production can be documented.
- Do not treat a model’s successful generation of a recognizable studio character as permission to publish, advertise or monetize it.
- Seek legal review for branded campaigns, entertainment releases, character imitations and high-value commercial work.
Safeguards can also create trade-offs. Broad filters may block legitimate parody, criticism, commentary, fan works, public-domain characters or user-owned creations that happen to resemble a famous franchise. Effective systems must distinguish those categories instead of treating every resemblance as legally identical.
What remains unresolved
- Whether Disney will file a lawsuit against ByteDance.
- What technical and human safeguards ByteDance actually implements, and how consistently they operate across regions and products.
- Whether studios and AI companies negotiate licenses or industry standards for training, references, likenesses and outputs.
- How courts would separate training-data questions from claims about generated videos and distribution.
- Whether Seedance becomes more broadly available outside China and, if so, under what commercial terms.
Viral examples can demonstrate what a system appears capable of producing, but they cannot prove the contents of a training dataset or establish infringement on their own. Until a court rules or the companies disclose more, the precise legal status of Seedance’s alleged Disney-related uses remains contested.
