How Gene Hackman and His Wife’s Estate Depends on Who Died First

Betsy Arakawa reportedly died about a week before Gene Hackman. Their reported wills named each other, but trusts, asset ownership and beneficiary designations leave the ultimate distribution unresolved.

Public reporting says Betsy Arakawa died about a week before Gene Hackman, and that each spouse’s will named the other. That sequence may affect gifts made in the wills, but it does not by itself reveal who ultimately receives the couple’s property: two trust documents were not public, and some assets may pass by ownership form or beneficiary designation rather than by will.

Who died first, and what did the reported wills say?

Authorities concluded that Arakawa died around a week before Hackman, according to the Associated Press on February 28, 2025. The report said Arakawa died of hantavirus pulmonary syndrome and Hackman of heart disease with Alzheimer’s complications.

On March 17, 2025, the Associated Press reported from probate-court documents that Hackman’s will left his estate to Arakawa, while Arakawa’s will directed her estate to Hackman. Those reports describe the wills’ stated provisions; they do not establish the terms of the couple’s full estate plan or the final distribution of every asset.

Why does the order of death matter?

A gift in a will to a spouse generally depends on whether the spouse survived for the period required by the will or by applicable law. If the named recipient died first, the gift may instead pass under an alternate-beneficiary clause, another provision of the will, or a default rule. The controlling documents and governing law have to be checked before deciding what happened to a particular gift.

New Mexico survivorship rules are sometimes discussed in connection with a 120-hour period, but the legislative material available here is not a consolidated current statute that establishes how such a rule applies to each Hackman or Arakawa asset. It would be unsafe to treat that period as a definitive answer for the couple’s estate without examining the instruments and the current law governing each asset.

Which route can property take?

A will is only one possible route. New Mexico Courts’ self-representation guidance describes property that can transfer outside probate, including joint tenancy with right of survivorship and transfer-on-death deeds. Trust ownership and account beneficiary designations can also affect where property goes. The public reporting does not establish how the couple held any specific asset or what designations applied.

Intestate property Applicable intestacy law, but only for property not effectively disposed of by a will, trust, or other transfer mechanism. New Mexico legislative material describes descendants taking the portion of an intestate estate that does not pass to a surviving spouse. That bill text is not a consolidated current code and does not establish that any particular Hackman or Arakawa property was intestate.

Does the reported sequence mean Hackman’s children inherit?

It does not settle that question. Whether children receive anything depends on the applicable will or trust terms, asset ownership and designations, and any relevant default law. AP’s March 17 report said beneficiaries of the two trusts were unclear because the trust documents were not public. The available reporting therefore supports neither a definite claim that Hackman’s children are excluded nor a definite claim that they inherit.

Does a personal representative or trustee inherit the property?

No. A personal representative handles estate administration; that appointment is distinct from the question of who receives estate property. New Mexico Courts’ self-representation guidance explains the appointment process and priority. Similarly, a trustee administers trust assets under the trust instrument; the role itself does not identify the trust’s beneficiaries.

What did the later court ruling reveal?

On March 31, 2025, the Associated Press reported that a judge permitted the release of most investigative materials, subject to restrictions on images depicting the couple’s bodies. That ruling concerned death-investigation records. It did not disclose the trust beneficiaries or resolve the distribution of estate assets.

What can be concluded from the public record?

  • Arakawa reportedly died before Hackman, and AP reported that each will named the other spouse.
  • The death sequence makes the wills’ survival and alternate-beneficiary terms important, but those reported provisions alone do not resolve the destination of each asset.
  • The trust terms, asset ownership and beneficiary designations needed to trace all property have not been established in the public reporting described above.
