The latest projected release date located by the Los Angeles Times is January 21, 2028. That is a Bureau of Prisons projection—not a new ruling by a judge.
Has a judge ordered Combs released today?
No same-day release order is reported in the latest coverage available as of October 4, 2026. The district-court sentencing took place in October 2025. Combs’s appeal was argued before the Second Circuit on April 9, 2026, but the judges did not announce a decision at the hearing. In September, a spokesperson told the Los Angeles Times that Combs was awaiting the court’s decision.

The available reporting does not establish whether the court issued a ruling after the September 30 Los Angeles Times report. The latest located update said the appeal decision was still pending; the status can change as the court acts.
What does the January 21, 2028 date mean?
The Los Angeles Times reported on September 30, 2026, that the Federal Bureau of Prisons inmate database listed January 21, 2028, as Combs’s projected release date. It is an administrative projection, not a court-ordered date or a guarantee that he will leave prison on that day.

The date has changed in reporting: The Washington Post reported a February 5, 2028 projection on September 4, 2026, before the later Times report gave January 21. These dates should not be treated as separate judicial decisions; they are projections reported at different times.
What is Combs appealing?
A jury convicted Combs on two counts of transportation to engage in prostitution under the Mann Act and acquitted him of racketeering conspiracy and sex trafficking charges, according to the Associated Press’s account of the appellate arguments. His defense is asking the appeals court to reverse the convictions, order his immediate release, or reduce his sentence.

One issue raised by the defense is whether the sentencing judge improperly relied on evidence related to charges the jury had acquitted. The government disputed that account, arguing that the sentence was below the applicable guideline range and consistent with similar Second Circuit cases. Those are the parties’ arguments, not findings by the appeals court.
Why is the appeal taking attention?
At the April 9, 2026 hearing, the three-judge Second Circuit panel questioned the severity of the sentence and whether acquitted conduct had improperly affected it. The panel did not rule at the hearing. Circuit Judge William J. Nardini described it as an “exceptionally difficult case,” raising questions of first impression “not only for this court but for any federal court in the country,” the Associated Press reported.

At sentencing, Judge Arun Subramanian said Combs was being sentenced for the offenses of conviction, not the crimes of which he was acquitted, while also noting that the law required the court to consider the nature of the offense and the defendant’s characteristics. The appellate court’s consideration of the parties’ arguments is separate from that sentencing explanation.

On October 3, 2025, U.S. District Judge Arun Subramanian sentenced Combs to 50 months in prison, imposed a $500,000 fine, and ordered five years of supervised release after prison, according to the Associated Press. The judge said a lengthy sentence was needed for deterrence.

“Release” can refer to different outcomes in this case: an immediate release order during the appeal, a change to the sentence after appellate action, or completion of the sentence on the Bureau of Prisons’ projected date. The pending appeal is not itself proof that any of those outcomes has occurred.
