Can a YouTube Live Stream Use Public Domain Music Without Attribution?

Public-domain music can be used without attribution when both the composition and the specific recording are cleared in the relevant territory. YouTube may still scan a live stream or claim its archived replay.

Yes—if both the musical composition and the specific recording you play are genuinely public domain in the relevant territory. Public-domain music does not ordinarily require attribution as a copyright-license condition. But an old composition can still have a protected modern recording, and YouTube may scan the live stream for matches even when you believe the track is cleared.

Check the composition and the recording separately

A piece of music and a recording of that piece are separate works. The composition is the music and any lyrics; the sound recording captures a particular performance and its production. The U.S. Copyright Office explains that copyright in a sound recording is not the same as, or a substitute for, copyright in the underlying composition (U.S. Copyright Office: Musical Compositions and Sound Recordings).

That distinction matters for classical music and old songs. A composer’s work may be public domain while a later orchestra, soloist, label, or producer owns rights in the recording. Clear the exact audio file you intend to use, not just the tune or composer.

Public-domain status depends on the territory and the recording

There is no single worldwide public-domain date. Copyright status can depend on where the stream is available, when a work was created or published, who created it, and which recording you use. The U.S. Copyright Office says works published before January 1, 1931 are in the public domain in the United States because their copyright has expired. That U.S. reference point is not a universal rule and does not by itself clear a recording.

Recordings have their own timelines. For example, the Copyright Office notes that pre-February 15, 1972 sound recordings may remain protected under state law until February 15, 2067 (U.S. Copyright Office: Pre-1972 Sound Recordings). If your audience is worldwide, do not assume a work’s status in one country settles its status everywhere.

Attribution is different from permission

If the composition and exact recording are truly public domain, attribution is not ordinarily required as a copyright-license condition. Giving credit does not, however, make a protected recording safe to use or replace permission you do not have.

A licensed track is different: follow its specific terms. For example, YouTube says a Creative Commons Attribution (CC BY) work requires credit to the creator. Check any other license for conditions such as attribution, livestream use, monetization, territories, and archived replays (YouTube: License types on YouTube).

What can happen when YouTube detects music in a live stream

YouTube says all live streams are scanned for matches to third-party content, including copyrighted content in another live broadcast. If it identifies third-party content, YouTube may replace the stream with a placeholder and warn you. If the content continues, the stream may be temporarily interrupted or terminated.

That live scan is separate from claims on an archived stream: YouTube says Content ID claims on an archived live stream are made after the stream ends, if you choose to archive it (YouTube: Copyright issues with live streams).

A Content ID match is a platform event, not proof by itself that your public-domain assessment is wrong. YouTube notes that Content ID does not take a written description of “free” music into account. Depending on the rights holder’s settings and geography, a claim may affect visibility or earnings. Verify a track before you stream it

  1. Identify the exact file. Record the track title, performer, recording date if known, and the source page. Do not rely only on the composer’s name or the age of the composition.
  2. Check both rights layers. Confirm the composition’s status and the specific recording’s status or license. Save the rights statement and source information together with the audio file.
  3. Check where and how you will use it. Verify that the status or license covers the relevant territories, a live online stream, monetization if applicable, and any archived replay.
  4. Follow license conditions. If you are relying on a license rather than public-domain status, comply with its attribution and other terms. A “free” label or credit line alone does not establish permission.
  5. Prepare for a platform match. Keep your documentation available in case YouTube identifies the recording. If a rights holder has licensed third-party content for your stream, YouTube advises that the channel may need to be added to the owner’s Content ID allowlist to avoid interruption.
