Sean ‘Diddy’ Combs Federal Sex-Trafficking Case: Latest Verdict, Sentence and Appeal Update

Sean Combs was acquitted of federal sex trafficking and racketeering conspiracy, but convicted on two Mann Act transportation counts. Here is the latest timeline, sentence, and Second Circuit appeal status as of April 9, 2026.

As of April 9, 2026, Sean Combs is serving a 50-month federal prison sentence for two convictions under the Mann Act, while his appeal is pending in the U.S. Court of Appeals for the Second Circuit. The jury acquitted him of racketeering conspiracy and both federal sex-trafficking counts. The appeal has not been decided.

Why this is no longer simply an indictment story

The phrase federal sex-trafficking indictment accurately describes how the case began, but it does not describe the final verdict. An indictment is a charging document: it states what prosecutors accuse a defendant of doing. It is not a finding of guilt.

That distinction matters here. Federal prosecutors charged Combs with sex trafficking, but the jury acquitted him on both sex-trafficking counts. He was also acquitted of the racketeering-conspiracy count. The convictions that remain are for transporting people with the intent that prostitution occur, not for sex trafficking or racketeering.

What the five-count indictment charged—and what the jury decided

The third superseding indictment filed on April 3, 2025 was the operative charging document at trial. It identified Casandra Ventura and a former girlfriend known publicly at trial as Jane in the two sex-trafficking counts and related transportation counts.

The two transportation convictions were brought under 18 U.S.C. § 2421(a), a federal Mann Act provision. The convictions established criminal liability for the charged transportation conduct and the required prostitution-related intent. They did not establish that Combs committed federal sex trafficking or participated in a racketeering conspiracy.

What prosecutors alleged at the beginning

The original indictment, announced by the U.S. Attorney’s Office for the Southern District of New York on September 17, 2024, charged racketeering conspiracy, sex trafficking by force, fraud, or coercion, and transportation to engage in prostitution. Prosecutors alleged that the conduct began in or around 2008.

The original charging document described an alleged enterprise involving sexual exploitation, forced labor, kidnapping, arson, bribery, and obstruction of justice. Prosecutors later added factual allegations in a January 2025 superseding indictment. The operative third superseding indictment ultimately presented the five-count case that went to the jury.

Those descriptions belonged to the prosecution’s charging theory. They were allegations, not findings of guilt. The jury’s acquittals on the racketeering and sex-trafficking counts are therefore an essential part of any accurate account of the case.

What the trial established—and what it did not

The government’s appellate brief describes trial evidence including witness testimony, text messages, videos, financial records, travel arrangements, hotel-room preparation, and the delivery of drugs and supplies. Prosecutors argued that Combs used employees, business resources, money, drugs, intimidation, violence, and threats to organize and conceal sexual encounters involving his girlfriends and male commercial sex workers.

Those are descriptions of the government’s allegations and its interpretation of the trial evidence. They should not be rewritten as findings that supported the acquitted sex-trafficking counts. The legally significant result is narrower: the jury found the government had proved the two Mann Act transportation counts beyond a reasonable doubt, but it did not find the government had proved racketeering conspiracy or either sex-trafficking count beyond a reasonable doubt.

Case timeline

  1. September 17, 2024: Federal prosecutors in Manhattan announced the original three-count indictment, and Combs was arrested.
  2. January 2025: Prosecutors filed a first superseding indictment that added factual allegations but, according to contemporaneous accounts, did not add new charges.
  3. April 3, 2025: The third superseding indictment became the operative charging document. It contained five counts.
  4. May 12, 2025: The jury trial began.
  5. July 2, 2025: After an eight-week trial, the jury convicted Combs on Counts Three and Five and acquitted him on Counts One, Two, and Four.
  6. October 3, 2025: Judge Arun Subramanian imposed a principal sentence of 50 months’ imprisonment and five years of supervised release.
  7. October 22, 2025: Combs’s appeal opened in the Second Circuit as No. 25-2623.
  8. April 9, 2026: A three-judge Second Circuit panel heard oral argument. No immediate decision was announced.

Sentence and current imprisonment status

Judge Subramanian sentenced Combs to 50 months in prison, followed by five years of supervised release. The government’s appellate brief states that Combs is serving that sentence.

The sentence followed convictions on the two transportation counts—not convictions for sex trafficking. Describing Combs as a convicted sex trafficker would therefore be inaccurate based on the federal jury verdict in this case.

What is at issue in the appeal?

The central sentencing question is whether the district court could rely on conduct connected to charges of which Combs was acquitted when calculating the sentence for the Mann Act convictions. The Second Circuit panel treated that question as difficult and potentially one of first impression in the circuit.

Combs’s lawyers also challenge the convictions and seek reversal or resentencing. The government argues that the 50-month sentence was below the applicable guideline range and consistent with comparable Second Circuit cases. The panel asked questions about the sentencing issue during oral argument, but judicial questions are not a decision and do not reliably predict the result.

Possible outcomes include affirmance of the convictions and sentence, reversal of the convictions, resentencing, or another modification of the judgment. As of the April 9 oral argument, none of those outcomes had been ordered.

What readers should not assume

  • Not convicted of sex trafficking: The jury acquitted Combs on both federal sex-trafficking counts.
  • Not convicted of racketeering: The jury acquitted him on the racketeering-conspiracy count.
  • Not awaiting a sex-trafficking trial: The federal trial has concluded, and the sex-trafficking charges ended in acquittals.
  • Not a wholesale dismissal: The case produced two convictions, a sentence, and an active appeal.
  • Not a final appellate ruling: The Second Circuit’s questions at oral argument do not mean that Combs has won or lost the appeal.

Civil lawsuits and documentaries are separate from the criminal verdict

Combs also faces civil litigation and has been the subject of documentary productions and other media coverage. A 2026 New York appellate decision addressed anonymity in a civil action involving Combs. Civil proceedings use different legal standards and address different claims from the federal criminal prosecution; developments in one proceeding do not automatically alter the verdict or sentence in the other.

Documentaries can provide chronology, interviews, and context, but they are not court records and their allegations are not substitutes for the jury’s verdict. Any documentary account should be read with the same distinction used in this update: allegations, evidence described by a party, judicial rulings, and jury findings are different categories.
