Why did Fiona Harvey sue Netflix?
Harvey filed a complaint on June 6, 2024, against Netflix, Inc. and Netflix Worldwide Entertainment, LLC in the U.S. District Court for the Central District of California. The complaint concerned the series’ portrayal of the alleged real-life inspiration for Martha.
In the complaint, Harvey alleged that the series falsely depicted her as a twice-convicted stalker sentenced to five years in prison and as having sexually assaulted Richard Gadd. Those are allegations in her filing, not facts established by the court. The complaint asserted six California-law claims:
- Defamation
- Intentional infliction of emotional distress
- Negligence
- Gross negligence
- Common-law right of publicity
- Right of publicity under California Civil Code section 3344
Harvey requested at least $170 million in damages. That figure was the amount sought in the complaint, not a court award.

What did the judge decide?
On September 27, 2024, U.S. District Judge R. Gary Klausner dismissed Harvey’s negligence and gross-negligence claims, both right-of-publicity claims, and her request for punitive damages. He allowed the defamation and intentional-infliction-of-emotional-distress claims to proceed past the motions then before the court.
That was a motion-stage ruling about which claims could continue, not a final judgment on whether Netflix was liable. In the order, Judge Klausner wrote: “There is a major difference between stalking and being convicted of stalking in a court of law.” Read the September 27, 2024 order for the court’s reasoning.

What happened to Netflix’s appeal?
Netflix appealed the denial of its special motion to strike. The district court stayed proceedings while the appeal was pending and vacated the pretrial and trial dates that had been set. The district-court docket mirror and Ninth Circuit docket mirror available for this account show the appeal and initial filings, but the Ninth Circuit mirror was last retrieved October 9, 2024, and does not establish a later disposition.
Accordingly, these records do not verify whether the appeal was decided, the stay was lifted, or the case later settled, went to trial, or reached judgment. A current court docket is needed to confirm any later status.

Did Fiona Harvey win the $170 million lawsuit?
The cited records do not establish that Harvey won the amount she requested. The $170 million was her demand in the complaint; the September 2024 order neither awarded it nor resolved the surviving claims on their merits. The appeal’s later outcome is not verified by the docket information cited here.
