Alcon Entertainment sued Elon Musk, Tesla and Warner Bros. Discovery, alleging that an AI-generated image shown at Tesla’s October 10, 2024 robotaxi event evoked Blade Runner 2049 after Alcon had refused permission to use imagery from the film. A February 3, 2026 order let Alcon’s copyright claim against Musk and Tesla proceed past dismissal, but it did not decide whether they infringed copyright.
What image prompted the lawsuit?
Tesla held its robotaxi presentation on October 10, 2024, at Warner Bros.’ Burbank studio lot. During the event, a screen showed a man in a long coat looking toward an orange-tinted, ruined city. The Associated Press reported that Musk referenced Blade Runner as the image appeared, saying: “I love Blade Runner, but I don’t know if we want that future.”

Alcon’s complaint says the image resembled a scene in Blade Runner 2049 in which Ryan Gosling’s character arrives in an abandoned Las Vegas. Alcon also alleges the image was generated to evoke the film after the company refused permission to use its imagery. Those are allegations about the image and how it was made, not findings established by the court.
What does Alcon allege?
Alcon filed its complaint on October 21, 2024, naming Tesla, Musk and Warner Bros. Discovery. It alleges copyright infringement and other claims connected to the event image and the possibility that the presentation suggested an association between Alcon’s film and Tesla. The complaint’s account of what happened—and its legal claims—must be distinguished from a court’s determination of liability.

What has the court decided?
The June 2025 tentative ruling
A tentative ruling dated June 16, 2025 discussed the presentation and the alleged use of AI to create the slide. A tentative or interim ruling is part of the court’s handling of the case; it is not a verdict on whether infringement occurred.
The February 2026 dismissal order
On February 3, 2026, the court denied dismissal of Alcon’s copyright infringement claim against Tesla and Musk while dismissing other claims. The copyright claim therefore survived that stage of the case. The order did not establish that either defendant was liable, and the information available here does not establish what happened on the docket after that date.

Has the lawsuit been resolved?
The February 3, 2026 order is not a final judgment on liability. Because later docket activity is not established here, it would be inaccurate to say whether the case remains pending, was settled or has since been finally decided. A current case status requires checking the live docket for the U.S. District Court for the Central District of California.
