Jennifer Pan remains incarcerated in Canada. The latest verified status available for this update, August 12, 2026, does not show that she has been released or granted parole. After the Supreme Court of Canada upheld a new trial on her original first-degree murder count, Pan pleaded guilty to manslaughter in her mother’s death in March 2026 and received a concurrent life sentence.

She is eligible to seek parole, but eligibility is not release.

Jennifer Pan remains incarcerated in Canada. As of the latest verified status available for this update, August 12, 2026, there is no reliable public indication that she has been released or granted parole. Her legal status did change after Netflix released What Jennifer Did: her original first-degree murder conviction was set aside for a new trial, and she later pleaded guilty to manslaughter in the death of her mother, Bich Ha Pan.

Pan received a life sentence for manslaughter, to be served concurrently with the life sentence she is already serving for the attempted murder of her father, Hann Pan. The manslaughter disposition makes her eligible to seek parole under the applicable Canadian process. It does not mean she is free, that parole has been granted, or that release is imminent. Where is Jennifer Pan now?

The safest current answer is that Jennifer Pan remains imprisoned in Canada and is eligible to seek parole, but has not been verified as released.

Public reporting reviewed for this update does not establish her current correctional institution, prison address, transfer status, or a release date. For that reason, claims that she is being held at a particular facility—or that she is living at a named location—should not be treated as confirmed unless a later official correctional, court, or parole source verifies them. Why did Jennifer Pan’s original conviction change?

Pan was originally convicted of first-degree murder in her mother’s death and attempted murder in the shooting of her father after an attack at the family’s Markham, Ontario, home in November 2010. The original sentence included life imprisonment with no possibility of parole for 25 years on the first-degree murder count, along with a life sentence for attempted murder. [CIT-004] [CIT-005]

In May 2023, the Court of Appeal for Ontario ordered a new trial on the first-degree murder count while upholding Pan’s attempted-murder convictions. The court’s decision was about the legal instructions given to the trial jury—not a finding that Pan was innocent. [CIT-006] [CIT-007]

The jury-instruction issue, in plain English

The appeal concerned whether the jury had been given every legally available verdict option supported by the evidence. One possible scenario was that Pan intended for an attack on her father to take place but did not specifically intend for her mother to be killed. If a jury accepted that version of events, it needed to be able to consider lesser offenses, including second-degree murder or manslaughter.

The Supreme Court of Canada confirmed that reasoning on April 10, 2025. Its case summary stated that the trial judge should have left lesser included offenses with the jury where there was a realistic basis for those verdicts in the evidence. The Supreme Court upheld the new-trial order for the first-degree murder count and left the attempted-murder convictions intact. [CIT-001] [CIT-002]

That distinction matters. The appellate courts did not declare Pan exonerated, did not erase the attempted-murder conviction, and did not determine that family conflict excused the attack. They found a legal error in how the original murder charge was presented to the jury.

What happened in the March 2026 manslaughter case?

Rather than proceed to another first-degree murder trial, Pan pleaded guilty to manslaughter in the death of her mother on March 18, 2026.

Reporting on the plea described an agreed statement of facts in which Pan acknowledged that she planned an attack directed at her father but ought to have known that her mother could be present in the home and could be harmed or killed. The plea resolved the first-degree murder charge with a manslaughter conviction. [CIT-003] [CIT-008]

What does the concurrent life sentence mean?

Pan received a life sentence for manslaughter, concurrent with the life sentence connected to the attempted murder of her father. “Concurrent” means the sentences run at the same time rather than one beginning only after the other ends.

The practical difference from the original first-degree murder disposition is parole eligibility. Under the disposition reported in March 2026, Pan can seek parole through the applicable Canadian process. That is only an opportunity to apply for consideration. A parole-eligibility date is not a release date, and parole eligibility does not guarantee that an application will succeed. [CIT-008] [CIT-009]

What does What Jennifer Did cover?

What Jennifer Did is a feature-length Netflix true-crime documentary released on April 10, 2024. Netflix describes the film as focusing on Pan’s 911 call reporting that her parents had been shot and on the investigation that made her the central focus of the case. Netflix’s materials also say the documentary uses police interrogation footage and testimony from people involved in the case. [CIT-010] [CIT-011]

The documentary predates both major legal developments discussed above. It was released before the Supreme Court of Canada’s April 2025 judgment and before Pan’s March 2026 manslaughter plea. Consequently, the film is a snapshot of the case as it stood in 2024—not a complete account of Pan’s current legal status.

Viewers who want a longer written account can also look for A Daughter’s Deadly Deception by Jeremy Grimaldi, a nonfiction book about the Jennifer Pan case that predates the documentary. It may provide additional case background, but it cannot substitute for reporting on the later appeal and plea disposition. [CIT-013] [CIT-014]

What this update does—and does not—establish

  • It establishes continued incarceration: Pan has not been verified as free or released on parole.
  • It establishes a change in the murder conviction: The original first-degree murder conviction did not simply remain unchanged; it was set aside for a new trial, followed by a manslaughter guilty plea.
  • It does not establish exoneration: The appeal dealt with jury instructions, and Pan’s attempted-murder convictions were upheld.
  • It does not establish an immediate release: Parole eligibility allows Pan to seek consideration, but does not guarantee parole.
  • It does not turn family conflict into a legal defense: The court rulings addressed available verdicts and jury instructions, not a conclusion that parental pressure justified the attack.

In short, the post-documentary update is a legal change, not a freedom story: Jennifer Pan remains in custody in Canada, now under concurrent life sentences after pleading guilty to manslaughter, and no verified public source reviewed for this update reports that she has been released.

Why was Jennifer Pan’s first-degree murder conviction set aside?

The Ontario Court of Appeal and Supreme Court of Canada found that the original jury had not been given all legally available verdict options supported by the evidence. The ruling ordered a new trial on the first-degree murder count; it did not declare Pan innocent, and her attempted-murder convictions remained in place.

Does What Jennifer Did include Jennifer Pan’s 2026 manslaughter plea?

No. The documentary premiered on April 10, 2024, before the Supreme Court of Canada’s April 2025 ruling and Pan’s March 2026 manslaughter plea. It does not reflect those later developments.

Does parole eligibility mean Jennifer Pan will be released?

Parole eligibility means Pan can seek consideration under the applicable Canadian parole process. It is not a guarantee of approval or release, and it does not mean she is currently out of prison.

The Bottom Line

Bottom line: Jennifer Pan remains incarcerated in Canada as of August 12, 2026. Her original first-degree murder conviction was replaced after a new-trial ruling and a 2026 guilty plea to manslaughter. She is eligible to seek parole, but no verified release or parole grant has been reported.
