Find and replace yours safely.Free scan · under a minuteIf your employer threatens, questions, watches, rewards, disciplines, or dismisses workers because of union activity, document what happened and contact the National Labor Relations Board (NLRB) promptly. The National Labor Relations Act (NLRA) protects covered employees who organize, assist a union, act together about workplace conditions, or choose not to participate. Coverage and remedies depend on the facts, and the NLRA does not cover every worker.
This guide explains what employer pushback can look like, how to preserve evidence without breaking workplace rules, how an NLRB charge works, and when another labor agency or legal route may apply.
Start with three questions
Are you covered by the NLRA?
The NLRA covers most private-sector employees. It generally does not cover federal, state, or local government employees; agricultural laborers; domestic workers; independent contractors; supervisors; employees of a parent or spouse; or workers covered by the Railway Labor Act, including many rail and air-carrier employees. Other statutory exclusions also exist. The NLRB’s coverage guide lists the categories and explains that a worker’s label is not always decisive: Are You Covered?
If you are outside NLRA coverage, a state labor agency, another federal agency, a sector-specific framework, or qualified local legal assistance may be the correct route. Do not assume that an exclusion means you have no rights; it may mean a different law applies.

What exactly happened?
Write down the conduct, not just the conclusion that it was “union-busting.” Record who spoke or acted, the date and location, the exact words you remember, who was present, what you were asked to do, and what changed afterward. A threat, a discipline decision, or a sudden transfer can matter differently depending on timing and context.
Is there a deadline?
The NLRB says unfair-labor-practice charges generally must be filed within six months of the alleged violation. Contact a regional office early even if you are still gathering information; agency staff can explain how to start a charge and whether the facts appear to fit the NLRA.
Know what the NLRA protects
Section 7 protects the right to self-organization, to form, join, or assist a labor organization, to bargain collectively through representatives of your choice, and to engage in concerted activity for mutual aid or protection. It also protects the right to refrain from those activities. You are not required to support a union, and an employer may not punish you for choosing not to participate when the law protects that choice. The NLRB summarizes these rights in its employee guidance: Employee Rights and What’s the Law?
Concerted activity is broader than a union card
Protected concerted activity is action connected to group concerns, taken with or on the authority of coworkers, or intended to initiate, induce, or prepare for group action. Examples include coworkers discussing pay or schedules, signing a petition, or presenting a group complaint, even when no union is yet involved. The NLRB explains the concept and its limits at Concerted Activity.

Work rules still matter
An employer may enforce nondiscriminatory limits on solicitation during working time. Under NLRB guidance, it generally may not ban union solicitation during nonwork time or prohibit distribution of literature during nonwork time in nonwork areas, subject to exceptions and special rules, including rules that can apply in construction. Follow neutral safety, access, confidentiality, and conduct policies; do not use protected rights as a reason to ignore otherwise lawful rules.
Conduct that may be unlawful employer interference
The NLRB identifies recurring warning signs. Each example is an indicator for seeking advice, not an automatic legal ruling. The words used, the setting, the employer’s policy, your coverage, and what happened next all matter.
Threats
- Threatening job loss, reduced benefits, worse treatment, or closure of a facility if employees support a union.
- Threatening discipline, discharge, or other reprisals for discussing organizing or acting with coworkers.
Coercive questioning and surveillance
- Demanding to know how you or a coworker will vote or whether you support the union in a way that pressures employees.
- Spying on pro-union workers, creating the impression that they are being watched, or asking coworkers to report on organizing activity.
Promises and inducements
- Offering raises, promotions, schedule changes, benefits, or other advantages in exchange for rejecting a union or abandoning protected activity.
Retaliatory treatment
- Transfers, layoffs, termination, harder assignments, discipline, reduced hours, or other adverse treatment because of union or protected concerted activity.
The NLRB’s employer guidance describes these categories and the legal limits on employer conduct: Employer/Union Rights and Obligations and What’s the Law? — Employers. An employer may express opinions about unionization within legal limits; an opinion becomes a potential violation when the surrounding conduct interferes with employees’ protected choice.
What to do when pushback starts
1. Make a factual chronology
- Open a contemporaneous log. For each incident, note the date, time, location, participants, exact words as best you can recall, and whether attendance or an action was required.
- Record the practical result: a schedule change, transfer, discipline, lost hours, new assignment, benefit offer, or changed treatment.
- Identify witnesses and preserve messages, notices, schedules, policies, and disciplinary documents that you can lawfully retain.
Keep the record factual. Distinguish what you personally observed from what someone else told you, and keep original files rather than editing screenshots. Do not secretly access restricted systems, copy confidential customer data, or violate a lawful retention or security rule to gather evidence.

2. Preserve the context
Save the policy that the employer says it is enforcing and note whether the same rule is applied to non-union subjects. A neutral solicitation rule enforced consistently can be lawful; a rule created or enforced selectively against union activity may raise a different question. Record whether managers were present, whether a meeting was mandatory, and whether anyone mentioned discipline or benefits.
3. Stay within lawful workplace boundaries
Use nonwork time and permitted nonwork areas for organizing where applicable. Follow safety, access, anti-harassment, and confidentiality requirements. Do not retaliate against coworkers who oppose organizing; their right to refrain is also protected.
4. Contact the NLRB promptly
You can ask an NLRB Regional Office about possible interference and the charge process. A charge is what initiates the agency’s investigation; an informal conversation alone does not substitute for filing. The agency’s assistance route is explained at Interference with Employee Rights.
Can your employer require an anti-union meeting?
This issue is date-sensitive. In an announcement dated November 13, 2024, the NLRB said that in Amazon.com Services LLC it ruled that requiring employees, under threat of discipline or discharge, to attend meetings where the employer expresses views on unionization violates Section 8(a)(1). The announcement said employers could express their views if they gave reasonable advance notice of the meeting’s subject, stated that attendance was voluntary with no adverse consequences, and kept no attendance records. It also said the standard would apply prospectively: Board Rules Captive-Audience Meetings Unlawful.

Do not treat every employer meeting about a union as automatically prohibited. The 2024 announcement is a Board decision and the governing rule can be affected by later Board or court action. Before relying on it, check the NLRB’s current materials and obtain advice about the meeting’s date, notice, attendance language, threats, and recordkeeping.
If you are called to a meeting
- Keep the notice, invitation, text message, or email.
- Note whether attendance is described as mandatory and whether discipline is threatened.
- Write down the stated topic, who attended, what was said, and whether attendance was recorded.
- Do not make a false statement about your views. If questioned, you can ask what policy or legal basis the employer is relying on and document the response.
How an NLRB charge works
Filing
A charge filed with an NLRB Regional Office starts the investigation. Provide the employer’s identity, your contact information, the dates and locations involved, the people responsible, the protected activity, and the documents or witnesses that support your account. The agency’s process page is Investigate Charges.
Investigation
Board agents gather evidence from the charging party, the employer, and witnesses. The Regional Director evaluates the findings under the NLRA and applicable Board law. The agency may request interviews, documents, or sworn statements. Be accurate and disclose unfavorable facts rather than guessing.
Possible outcomes
The NLRB may seek an order stopping unlawful conduct and restoring the prior situation. Potential remedies can include reinstatement, monetary relief, and removal or voiding of an unlawful rule or policy. A remedy is not automatic; it depends on the investigation, proof, legal standards, and the specific harm.

The NLRB says it typically decides the merits of a charge within 7 to 14 weeks, although some matters take longer. That is an agency estimate, not a deadline or guarantee, and the agency says many charges are settled, withdrawn, or dismissed during that period. Its FAQ is at Frequently Asked Questions — NLRB.
Choose the right route when the NLRA does not fit
| Situation | First contact | What to clarify | Potential result |
|---|---|---|---|
| Private-sector employee whose facts suggest threats, coercive questioning, retaliation, surveillance, or unlawful promises | NLRB Regional Office | Whether the conduct is protected by the NLRA and whether a charge is timely | Investigation and possible reinstatement, monetary relief, or removal of an unlawful rule |
| Government employee, independent contractor, supervisor, agricultural or domestic worker, or rail/air-carrier employee | Agency or framework governing that employment category, plus qualified local legal assistance | Which statute, collective-bargaining system, or public-sector process applies | Varies by jurisdiction and law; the NLRA process may not be available |
| Worker uncertain about status or facts | NLRB office for coverage questions and a qualified labor lawyer or worker-rights clinic | Worker classification, employer type, protected activity, and available deadlines | A tailored filing or referral after coverage is established |
The NLRB’s coverage page is the best starting point for the federal exclusions: Are You Covered?. The agency cannot decide every workplace dispute, and a state or sector-specific process may offer a different remedy or deadline.
Common mistakes that weaken a case
- Waiting for a termination. A threat, coercive interrogation, surveillance, promise, or lesser adverse action can be significant before anyone is fired.
- Calling every disagreement illegal. Employers may communicate views within legal limits, and lawful policies can apply during organizing. Focus on the conduct and context.
- Relying on memory alone. Dates, exact words, witnesses, policies, and before-and-after schedules are easier to evaluate when preserved promptly.
- Breaking a neutral work rule to collect evidence. Do not trespass into restricted systems, take confidential data, or disrupt operations; those actions can create separate problems.
- Assuming a union is required for protection. Group discussion and complaints about workplace conditions can be protected concerted activity even without a union.
- Assuming the NLRA covers everyone. Check worker status and industry before relying on the federal charge process.
A practical checklist
- Confirm whether you are likely a covered private-sector employee.
- Write a dated, factual chronology and identify witnesses.
- Preserve notices, messages, schedules, policies, and discipline records lawfully.
- Separate protected activity from unrelated performance or conduct issues in your notes.
- Follow neutral work, safety, access, and confidentiality rules.
- Record whether an anti-union meeting was mandatory, whether consequences were threatened, and whether attendance was tracked.
- Contact the NLRB Regional Office promptly about possible interference and filing.
- If an NLRA exclusion may apply, identify the correct agency or obtain qualified local advice rather than abandoning the issue.
What the NLRB can—and cannot—tell you
NLRB guidance explains employee rights, employer limits, coverage, filing, investigation, and possible remedies. It does not predetermine how a particular incident will be decided. The agency will evaluate the evidence under the law in effect for the relevant conduct. A careful record and prompt contact improve the chance that the right facts reach the right forum, but neither guarantees a finding or remedy.
