The union argued that qualified professionals—including the armorer and employer—are responsible for firearm operation and safety, while performers must receive safe-handling instruction. It was the union’s position on workplace responsibilities, not a court ruling about the fatal shooting or Alec Baldwin’s criminal case.
Why SAG-AFTRA issued the statement
On January 19, 2024, Baldwin was charged again with involuntary manslaughter in connection with the fatal October 2021 shooting during a rehearsal for Rust, as reported by the Los Angeles Times. SAG-AFTRA responded with a statement dated January 25, titled “Statement Regarding New Charges in the ‘Rust’ Tragedy.” The union described itself in the release as representing approximately 160,000 members. SAG-AFTRA’s statement addressed what it viewed as an actor’s duties when handling a firearm at work.
What the union argued about an actor’s role
SAG-AFTRA’s central point was that using a prop firearm does not make an actor responsible for inspecting it as a firearms specialist. The statement put it plainly: “An actor’s job is not to be a firearms or weapons expert.” It also said, “The guidelines do not make it the performer’s responsibility to check any firearm.”
To support that position, the union cited Safety Bulletin 1 from the Joint Industry-Wide Labor Management Safety Commission. SAG-AFTRA said qualified professionals are responsible for firearm operation, including inspection and safekeeping. It characterized the armorer and employer as having responsibility for firearm activity on set, rather than transferring that responsibility to a performer simply because the performer is handed a weapon.

Training and supervision still matter
The union did not argue that performers need no safety preparation. Its statement said anyone issued a firearm on set must receive training and guidance in its safe handling and use. It added that “all activity with firearms on a set must be under the careful supervision and control of the professional armorer and the employer.” In other words, the statement paired an expectation of instruction for performers with its assertion that operational oversight belongs to qualified professionals and the employer.
What the statement does—and does not—establish
The release is SAG-AFTRA’s account of industry standards and performer responsibilities. It is not a judicial finding, a factual determination about what happened on the Rust set, or proof that a particular person complied with safety requirements. The union’s argument about an actor’s job is distinct from the criminal case’s questions about evidence, conduct, and legal responsibility.

How Baldwin’s case later ended procedurally
The union issued its statement months before Baldwin’s 2024 trial. During the trial, Judge Mary Marlowe Sommer dismissed the case over allegations that police and prosecutors withheld evidence from the defense. The Associated Press later reported that prosecutors withdrew their appeal in December 2024. The AP’s account of the dismissal and appeal describes a procedural outcome in the criminal case; it does not report that the court adopted SAG-AFTRA’s interpretation of actor and armorer responsibilities.
