What did Haliey Welch say about the lawsuit?
In December 2024, Welch said she was cooperating with the legal team representing people affected by HAWK. The Atlantic reproduced her statement: “I am fully cooperating with and am committed to assisting the legal team representing the individuals impacted, as well as to help uncover the truth, hold the responsible parties accountable, and resolve this matter.” The Atlantic
That was a public statement of cooperation, not an admission of liability or a court document. Investors had filed the initial complaint the day before the statement was reported.

Why was Welch later named in the case?
The initial complaint named four parties and did not include Welch. In November 2025, plaintiffs asked the court for permission to amend it to add Welch, Forster and 16 Minutes LLC. Decrypt reported that the proposed claims included allegations about promotional compensation and advertised token features. The request to amend and the claims described in it do not establish that the court granted the request or that any allegation is true.

Welch’s earlier pledge to cooperate and the later effort to name her are distinct events. The statement did not itself resolve the claims or prevent plaintiffs from seeking to add parties as the litigation developed.
What is alleged, and what has a court established?
The original complaint alleged that HAWK was offered and sold without required securities registration and that its promotion gave buyers an expectation of profit. Later plaintiffs’ allegations, as described by Decrypt, concerned Welch’s company and promotional compensation as well as token features. These are claims made by plaintiffs, not established facts.

- The appointment of lead plaintiff and co-lead counsel was a procedural step, not a ruling on the merits.
What is the latest established case status?
Burwick Law’s March 30, 2026 case page described the consolidated class action as pending. That is the latest substantiated status in the cited materials, and it is a description by plaintiffs’ counsel. Those materials do not establish whether a later court order or docket update has changed the status since then.
