On December 27, 2024, President-elect Donald Trump asked the Supreme Court to pause the January 19 deadline in the federal law targeting TikTok. He wanted his incoming administration to have time to pursue a political solution—not a ruling that the law was unconstitutional. The justices did not grant that pause: on January 17, 2025, they upheld the law. After taking office, Trump separately directed the attorney general to delay enforcement.
What Trump asked the justices to do
Trump filed an amicus brief—a submission by someone who is not a party to the case—while he was president-elect. He asked the Court to stay, or temporarily pause, the law’s January 19, 2025 deadline so his incoming administration could try to negotiate a political resolution involving TikTok.
That was a request for time, not a request to strike down the statute. Trump’s filing did not adopt TikTok’s First Amendment challenge or take a definitive position on whether the law was constitutional. He argued that the Court should allow the new administration an opportunity to address the dispute before the deadline took effect. The deadline fell one day before his inauguration, leaving little room for him to act as president first.
What the law required—and what “ban” meant
The Protecting Americans from Foreign Adversary Controlled Applications Act, enacted in 2024, required TikTok’s parent company, ByteDance, to complete a qualified divestiture that ended the app’s foreign-adversary control. Without one, covered companies could not distribute or maintain TikTok in the United States, and internet-hosting providers could not support it. The law also created exposure for services that continued to support the app after the deadline.

So “ban” was a useful shorthand, but not a description of a switch Congress would flip on every user’s phone. The restrictions targeted the infrastructure needed to distribute and operate the app. Existing users’ access could depend on what app stores, hosting providers and TikTok itself did; the law did not guarantee that every installed copy would stop working at the same moment. The statute also allowed a possible one-time extension of up to 90 days if its conditions were met.
Why the case reached the Supreme Court
A three-judge panel of the U.S. Court of Appeals for the D.C. Circuit upheld the law in December 2024. TikTok, ByteDance and related challengers then asked the Supreme Court to block the law, arguing that it burdened protected speech by the company, creators and users. They also disputed the government’s evidentiary basis for concerns about Chinese control and access to data.

The Biden administration defended the law as a national-security measure. It said the government had an important interest in preventing China from obtaining Americans’ personal data or using control of TikTok’s recommendation system to influence content. Those were the government’s stated risks and rationale; the case did not establish that China had accessed every user’s data or manipulated particular videos.
Trump’s intervention was distinct from both sides’ merits arguments. TikTok sought to defeat the law on constitutional grounds; the government sought to preserve it; Trump asked the Court to delay the deadline to leave room for a negotiated outcome.

The fast timeline—and the outcome
- December 27, 2024: Trump filed his brief as president-elect, asking for a pause.
- January 10, 2025: The Supreme Court heard oral arguments on an unusually compressed schedule.
- January 17, 2025: The Court issued its decision, rejecting the challengers’ First Amendment claims and upholding the law as applied to them.
- January 19, 2025: The statutory deadline arrived.
- January 20, 2025: Trump took office and directed the attorney general not to enforce the law for 75 days while his administration considered next steps.
The Court’s decision recognized that the law affected speech-related interests, but treated it as directed at foreign control and ownership rather than at particular viewpoints. It concluded that the burden on speech was not substantially broader than necessary to advance the government’s important national-security interest in preventing access to Americans’ data. The ruling concerned this statute and these challengers; it was not a blanket approval of any government restriction on TikTok or a finding that officials may censor content at will.
The justices did not grant Trump the pre-inauguration pause he had requested. TikTok briefly went dark in the United States around January 19, and service was restored after Trump indicated he would direct a delay once in office. His January 20 order was a separate executive action: it instructed the attorney general not to enforce the statute for 75 days. It was not a Supreme Court stay, did not repeal the law and did not erase Congress’s requirements. A president cannot repeal an act of Congress by executive order.

What the episode meant for users and businesses
For users and creators, the immediate uncertainty was about whether TikTok would remain available, not whether the Supreme Court had permanently guaranteed its future. For app stores and hosting providers, the law placed the practical pressure on continued distribution and infrastructure support. For advertisers and businesses that relied on TikTok, a possible interruption threatened audience reach and campaign continuity, even as the precise service impact depended on how the deadline was enforced.

Later enforcement delays and policy actions during 2025 did not change what Trump had asked the Court to do in December 2024. His request was to buy time; it did not itself save TikTok or invalidate the law.
