Short answer: TikTok’s U.S. operation is now run by TikTok USDS Joint Venture LLC, a majority-American-owned company established on January 23, 2026. ByteDance still owns 19.9% of the venture, so “U.S.-owned” does not mean wholly American-owned. The new structure gives the U.S. venture authority over American user-data protection, software security, content moderation, and the U.S. recommendation system, while keeping the app connected to global TikTok.
What happened to TikTok in the United States?
After years of legal and political dispute, TikTok’s U.S. operation was restructured as TikTok USDS Joint Venture LLC. The White House approved the proposed structure in September 2025, and the venture announced its establishment on January 23, 2026. Its stated purpose is to put key U.S. security and platform decisions under a majority-American-owned entity while allowing American users and creators to remain connected to TikTok’s global ecosystem.
The dispute began with a 2020 executive order targeting TikTok and ByteDance. Congress passed the Protecting Americans from Foreign Adversary Controlled Applications Act in April 2024, creating a divestiture requirement. TikTok briefly went offline in the United States in January 2025 as the statutory deadline approached. Enforcement delays issued in 2025 kept the service operating during negotiations; the resulting joint venture is the current U.S. structure.

Who owns and governs the U.S. operation?
The venture is majority American-owned, but the ownership is not exclusively American. Oracle, Silver Lake, and MGX each hold 15%; ByteDance holds 19.9%. The remaining interests are held by other consortium participants, including the Dell Family Office, Vastmere Strategic Investments, Alpha Wave Partners, Revolution, Merritt Way, Via Nova, Virgo LI, and NJJ Capital. Oracle is an investor and security partner; it does not own TikTok outright.
The seven-member board includes Shou Chew, Timothy Dattels, Mark Dooley, Egon Durban, Raul Fernandez, Kenneth Glueck, and David Scott. The White House said ByteDance could select one director and would be excluded from the security committee. The venture identifies Raul Fernandez as independent director and chair of that committee. Adam Presser is CEO, and Will Farrell is chief security officer.
These arrangements establish formal majority-American ownership and governance. They do not, by themselves, answer every technical or contractual question about the licensed recommendation technology, shared code, or the division of work with TikTok’s global entities.
What changes for users?
Data protection and access
The venture says U.S. user data will be protected in Oracle’s U.S. cloud under a dedicated privacy and cybersecurity program, with outside audits and alignment with standards including NIST CSF, NIST 800-53, ISO 27001, and CISA requirements. Oracle-hosted U.S. data controls and code-review arrangements existed before the ownership restructuring, so the new venture builds on an earlier security program rather than introducing domestic hosting for the first time. Data being stored in the United States is not the same as proof that no foreign person or organization can ever influence the service. Storage location, access permissions, software control, model governance, audit scope, and user remedies are distinct questions. The venture’s public materials describe its security program but do not establish that every cross-border data flow is impossible or disclose every access-control detail.
Recommendation system
The venture says it will retrain, test, update, and secure the U.S. recommendation algorithm using U.S. user data in Oracle’s U.S. cloud. The White House describes the U.S. venture as responsible for operating the algorithm and making content-moderation decisions. That is a significant governance change, but it is not proof that the technology was rebuilt from scratch or is wholly independent of ByteDance’s underlying work.
Public announcements do not provide the full technical architecture, model weights, training-data description, evaluation methodology, or a complete account of continuing ByteDance involvement. The claim that the algorithm is now “American” should therefore be understood as a claim about the U.S. venture’s stated authority and security responsibilities, not a publicly demonstrated technical break with all prior technology.
Moderation and software security
The venture says it has decision-making authority over U.S. trust-and-safety policies and content moderation, as well as software assurance. Oracle is described as a trusted security partner, and the stated program includes source-code review and monitoring of software updates, data flows, and recommendation models. Those controls could affect enforcement, appeals, and how U.S.-specific policies are applied. The public announcements do not provide a complete before-and-after comparison of moderation rules, nor do they establish that moderation will become less controversial or more permissive.

The venture announced ISO 27001 certification in April 2026. Certification is a formal security milestone, not proof that every national-security concern has been resolved. The practical value of review also depends on its scope, how quickly issues are fixed, whether reviewers can require changes, and what results are made public.
Will the app look different?
Not necessarily. The arrangement is designed to preserve interoperability: U.S. users can continue to encounter international creators, and U.S. creators can remain discoverable abroad. TikTok’s global entities retain roles in certain commercial activities, including e-commerce, advertising, and marketing. Users should not assume that they must move to a newly named app or that the U.S. catalog will become an isolated copy.
Many of the consequential changes—corporate authority, cloud controls, access permissions, code review, algorithm governance, and moderation responsibility—are largely behind the scenes. A familiar interface does not show whether those controls work; equally, a visible product change does not by itself prove that the ownership transaction caused it.
Which new features have appeared?
Local Feed
The venture announced a Local Feed on February 12, 2026. The newsroom announcement establishes that the feature was introduced, but does not establish uniform availability or identical behavior for every U.S. account and device. It also does not provide enough detail to promise exactly how location is determined, whether a location permission is required, how creators can opt out, or how local recommendations interact with the main For You feed. Check the feature and your device’s location permissions in your own app before relying on it.

TikTok GO
Announced on May 13, 2026, TikTok GO is a discovery and booking product for experiences. It signals expansion into transactions and commerce, but it is a product development rather than direct evidence of a change in ownership or data-security practice. Using booking or commerce services can involve transaction-related information in addition to ordinary viewing and engagement data.

It addresses a particular concern: whether a foreign-adversary-owned parent controls the U.S. operation and its sensitive systems. It does not establish that TikTok collects less information, eliminate advertising profiling, prevent every breach, or resolve broader concerns about ranking and social-media use. A U.S.-owned company can still collect extensive data and make opaque recommendation decisions.
- Foreign-control risk: The formal ownership and governance structure is designed to reduce ByteDance’s control over the U.S. operation.
- Data-security risk: U.S. cloud hosting and security controls are part of the stated program, but users should not treat location of storage alone as a complete privacy guarantee.
- Commercial tracking: The restructuring does not amount to a general limit on advertising, personalization, or data collection.
- Algorithmic influence: The venture says it controls and retrains the U.S. recommendation system, but public technical evidence is not detailed enough to independently establish the extent of its practical independence.
- General platform risks: Content moderation disputes, misinformation, addictive design, and ordinary account-security risks are not automatically solved by a change in ownership.
Privacy-conscious users can review their app permissions, especially location, contacts, microphone, and camera access, and use available data access, download, and deletion controls. The venture published a U.S. privacy-policy explanation in February 2026; consult the current policy and settings for the terms that apply to your account rather than assuming the ownership change means less collection.

What does this mean for creators and businesses?
The venture says U.S. creators remain discoverable internationally, so the restructuring is not presented as a break in global reach. Still, creators and businesses should watch for changes in recommendation distribution, local discovery, advertising measurement, commerce eligibility, and the experience of reaching audiences outside the United States. The public announcements do not establish that these outcomes have changed uniformly.
For a business, the decision is whether TikTok produces measurable discovery or sales for its particular audience—not whether the new ownership guarantees long-term regulatory stability. Keep customer relationships on channels you control, such as a website or email list, and maintain another route to reach customers. TikTok’s official starting points are TikTok for Business and the U.S. TikTok Shop seller portal; verify current advertising, seller, fulfillment, and promotional terms before committing budget.
What do government-device rules say now?
In July 2026, the Justice Department’s Office of Legal Counsel concluded that TikTok USDS Joint Venture is outside the federal No TikTok on Government Devices Act because ByteDance does not control it and the venture operates independently. The opinion also points to revisions to the recommendation algorithm and cybersecurity program intended to insulate federal information. This does not mean TikTok is allowed on every government phone or system. Federal acquisition rules still contain restrictions concerning ByteDance covered applications on executive-agency technology and certain federal-contractor systems. State-government bans, agency policies, military and intelligence rules, and employer or school device policies can also differ. The relevant federal materials are FAR Subpart 4.22 and contract clause 52.204-27; users should check the rule that applies to their agency, contract, and device.
What should users watch next?
The most useful evidence will be information that lets outsiders assess whether the announced separation works in practice, rather than another broad assurance. Look for public audit summaries and their scope, technical documentation of the recommendation system, independent evaluations of data access and foreign-influence safeguards, moderation transparency, and clear explanations of how U.S. and global teams divide authority. Privacy-policy revisions and changes to app permissions also matter, particularly as location-based discovery and booking features expand.
For creators and businesses, track audience reach, local discovery, ad measurement, and commerce performance over time rather than attributing every feed change to the new ownership. For users, the key question is whether transparent controls and independent evidence accompany the company’s security claims.
