TikTok attributed the technical failures to a power outage at a U.S. data center. The available evidence does not establish that the outage was an intentional censorship operation or that the moderation reports were directed by the new owners.
What happened after the deal closed?
The U.S. transaction closed on January 22, 2026, creating TikTok USDS Joint Venture LLC. Between January 24 and 26, users reported a collection of service problems rather than a complete nationwide shutdown. MacRumors published its incident report on January 26 at 4:59 p.m. Pacific Time.
- Videos failed to upload or remained stuck in processing.
- Requests loaded slowly or timed out.
- Videos displayed zero views, while likes or other engagement data appeared to be missing.
- Some posts remained in review.
- Creators reported temporary suspensions and “Ineligible for Recommendation” labels.
A platform can remain accessible while individual systems—uploads, moderation queues, analytics, recommendations, or account enforcement—are degraded. The reported symptoms therefore describe a partial service incident, not proof that every TikTok function went offline.
MacRumors’ incident report said TikTok blamed a power outage affecting a U.S. data center and described the resulting problems as a cascading systems failure. TikTok said it was restoring service. No public postmortem in the available coverage identifies the data center, outage duration, affected cloud region, failed redundancy, or the precise systems involved, so the explanation remains TikTok’s account rather than independently verified technical findings.

Why did users raise censorship concerns?
The suspicion arose from the combination of timing and content. Users said posts concerning Immigration and Customs Enforcement and a Minneapolis shooting were placed into review, marked “Ineligible for Recommendation,” or associated with temporary account suspensions. The complaints appeared just after the ownership and governance change, when the new venture had been assigned responsibility for U.S. content moderation and algorithm security.
These reports describe different types of enforcement that should not be treated as interchangeable:
- Removal: the post is deleted.
- Recommendation restriction: the post remains available but is excluded from recommendation feeds.
- Review delay: automated or human systems temporarily hold the post.
- Distribution decline: a post receives fewer impressions, which can result from ranking changes, delayed analytics, or an outage.
- Account enforcement: the creator is temporarily or permanently suspended.
An “Ineligible for Recommendation” label can reduce reach without deleting a video. Likewise, a zero-view display during a systems incident may reflect delayed or missing analytics rather than deliberate suppression.

Was political censorship proven?
No. The available reporting supports the narrower conclusion that users reported politically sensitive moderation and recommendation problems during a broader technical disruption. It does not prove that officials ordered the actions, that the new investors directed them, that political keywords were systematically targeted, or that the outage concealed a censorship program.

The timing reasonably fueled questions, but timing alone cannot establish causation. A technical failure could produce review backlogs, incorrect labels, delayed counters, and distribution errors without any intentional policy change. Conversely, ordinary moderation decisions can appear unusually selective when they occur during a major news event and a service outage.
Individual screenshots can show that a user saw a particular label; they cannot show why it was applied or how widespread the treatment was. Establishing intentional suppression would require broader evidence such as controlled posting tests, large samples of enforcement outcomes, before-and-after reach comparisons, independent auditing, or platform transparency data. The available material contains none of those datasets.

What the U.S. ownership deal changed
The transaction was a structured joint venture, not a simple sale of TikTok to Oracle or the U.S. government. The official announcement from TikTok says TikTok USDS Joint Venture LLC operates the protected U.S. functions under a majority-American ownership structure.

The venture’s announced responsibilities include U.S. user-data protection, algorithm security, content moderation, software assurance, and the retraining, testing, and updating of the recommendation algorithm with U.S. user data. The arrangement also places the U.S. data and algorithm-security infrastructure in Oracle’s U.S. cloud environment, according to the company’s announcement and related reporting from Data Center Dynamics and ABC News.
Those are governance and operational assignments, not evidence that the algorithm had already been replaced or that investors personally controlled individual moderation decisions on January 24–26. ByteDance’s 19.9% stake also means the entity was not wholly divested from ByteDance ownership, even though the protected U.S. functions moved into the new venture.

What later government language adds
A July 16, 2026 Office of Legal Counsel opinion described TikTok USDS Joint Venture as functioning independently of ByteDance, majority-owned by American investors, and operating with a revised recommendation algorithm and cybersecurity program. That later description helps explain the intended structure, but it does not retroactively verify TikTok’s January outage explanation or resolve whether any January moderation decisions were politically motivated.

During the incident, users also noticed wording concerning citizenship or immigration status and precise location information. MacRumors reported that the same wording appeared in the prior privacy policy. That makes it unsafe to claim that the ownership deal newly introduced those data practices without a direct before-and-after policy comparison.
Privacy-policy language can describe data TikTok may collect, infer, or receive from third parties; it does not prove that every listed category is collected from every user. A change in the contracting entity likewise does not automatically establish a change in the app’s technical data collection. Privacy questions and censorship questions are related in the political debate but require separate evidence.

Did users move to alternatives?
App Store rankings recorded a short-lived attention spike for UpScrolled. A January 26 snapshot reported the app as high as number two among free U.S. apps and later at number eight, as reflected in Techmeme’s coverage snapshot. Rankings are a momentary measure, not proof of sustained downloads, active users, creator migration, or market share.
The spike could reflect curiosity, protest migration, users seeking a platform that presents itself as politically impartial, or dissatisfaction while TikTok was malfunctioning. Nothing in the available evidence shows that UpScrolled permanently replaced TikTok.
What remains unanswered
- Which U.S. data center or cloud region lost power?
- How long did each affected service remain degraded?
- Did TikTok publish a technical incident report or postmortem?
- Were moderation labels and suspensions later reversed?
- Did nonpolitical posts experience the same review and recommendation failures?
- Did the venture change moderation rules or algorithm behavior after January 22?
- Will TikTok USDS publish enforcement, audit, or transparency data?
- Did the UpScrolled ranking surge translate into sustained usage?
Until those questions are answered with technical records, systematic moderation data, or independent audits, the most defensible account remains limited: a newly restructured U.S. TikTok experienced a significant infrastructure-related disruption while users reported politically sensitive moderation problems. The reports explain why censorship concerns spread, but they do not prove intentional political suppression.
