The public court record says she had gone on a date with a person using the name “Audrey” on November 14 and expected another date on November 15. Investigators identified “Audrey” as Bailey Boswell.
Aubrey Trail and Boswell were later convicted in separate proceedings. Trail received a death sentence after a jury found him guilty of first-degree murder and conspiracy to commit first-degree murder; he had pleaded no contest to improper disposal of human skeletal remains. Boswell was convicted of first-degree murder, conspiracy and improper disposal and received life imprisonment for murder plus consecutive terms on the other convictions. The Nebraska Supreme Court affirmed both defendants’ convictions and sentences. On April 20, 2026, the U.S. Supreme Court denied Trail’s petition for review of a state postconviction ruling.
What is established about Sydney Loofe’s disappearance?
Loofe was 24 when she died. According to the Nebraska Supreme Court’s account in State v. Boswell, she was working at a hardware store in Lincoln and did not report for her shift on November 16, 2017. A friend checked a dating profile connected with the person Loofe had met and supplied it to police. Family and friends knew that Loofe had gone on a first date on November 14 with someone using the name “Audrey,” and that a second date had been planned for November 15.
Investigators determined that “Audrey” was Boswell. The court opinions describe the subsequent investigation and evidence admitted at trial, but they are not a complete investigative file or a word-for-word trial transcript. They establish the procedural record and the evidence the appellate courts considered, not every detail that may have been collected by investigators.

What happened between the dates and the missing-person report?
November 14, 2017: the first date
The appellate record says Loofe met a person using the name “Audrey” on November 14. Investigators later connected that dating identity to Bailey Boswell. The record also says Loofe and “Audrey” planned to meet again the following day.
November 15, 2017: the planned second date
A second date was expected on November 15. The opinions do not present the planned meeting as proof, by itself, of what happened to Loofe. It is part of the chronology that led investigators to examine the dating profile, communications and movements associated with Boswell and Aubrey Trail.
November 16, 2017: reported missing
Loofe was reported missing after she failed to appear at her Lincoln hardware-store job. A friend’s discovery of the dating profile gave police an early investigative lead. The case then developed through records, physical evidence and forensic testing described in later court decisions.
How did investigators connect Boswell and Trail to the case?
The Nebraska Supreme Court’s opinions describe several categories of evidence rather than a single decisive clue. Investigators examined phone activity and location information associated with Boswell and Trail, recovered evidence from disposal sites and an apartment, and used DNA analysis. The appellate record presents these items as parts of the prosecution evidence considered at trial.

Phone records and location information
Phone records and location data were used to trace activity associated with the defendants and to place devices or people in locations relevant to the investigation. Location data can show where a device was recorded by a network or other system; it does not automatically prove who was holding the device at every moment. The court opinions recount how this information fit into the larger evidentiary presentation rather than treating it as an isolated identification method.
Physical evidence and disposal sites
Investigators examined physical evidence recovered from disposal sites and from an apartment. The opinions discuss those recoveries in the context of the charges, including improper disposal of human skeletal remains. Because the appellate decisions summarize evidence admitted at trial, they should not be read as a complete catalog of every item collected or tested.
DNA analysis
The appellate record uses qualified language about the DNA evidence. It says Loofe was included as a contributor, or could not be excluded, from DNA found on certain recovered items. That wording matters: it does not mean that every tested item produced a categorical match to Loofe, nor does it establish that all physical evidence had the same result. The opinions describe how the DNA evidence was presented and challenged in the trials.
When were charges filed?
In 2018, the Nebraska Attorney General announced that both defendants had been charged with first-degree murder and improper disposal of human skeletal remains. The later prosecutions added or resolved conspiracy allegations through the trial proceedings. Charging documents are allegations; the findings that legally determined the case were the jury verdicts and the sentences imposed by the courts.

Who was convicted in the Sydney Loofe case?
| Defendant | Convictions recorded in the public record | Sentence | Appellate status |
|---|---|---|---|
| Aubrey Trail | Jury conviction for first-degree murder and conspiracy to commit first-degree murder; no-contest plea to improper disposal of human skeletal remains | Death sentence imposed by a three-judge panel | Nebraska Supreme Court affirmed convictions and sentence in 2022; U.S. Supreme Court denied certiorari on April 20, 2026 in postconviction litigation |
| Bailey Boswell | First-degree murder, conspiracy to commit first-degree murder and improper disposal of human skeletal remains | Life imprisonment for murder, with consecutive terms for the other convictions | Nebraska Supreme Court affirmed convictions and sentences on May 10, 2024 |
The cited public sources do not state the lengths of Boswell’s consecutive terms for the non-murder convictions in the material summarized here. They should therefore be described as consecutive terms rather than assigned an unsupported number of years.
What happened at Aubrey Trail’s trial?
Verdicts and plea
Trail’s 2019 trial ended with jury convictions for first-degree murder and conspiracy to commit first-degree murder. Separately, he had pleaded no contest to improper disposal of human skeletal remains. A no-contest plea resolves that charge without a trial verdict on the factual allegations in the same way as a guilty plea, although it results in a conviction and may be sentenced by the court.
Death sentence
A three-judge panel imposed the death sentence. The Nebraska Supreme Court’s decision in State v. Trail, 312 Neb. 843 (2022), addressed challenges involving jury selection, trial rulings, a courtroom incident and sentencing. The court affirmed the convictions and sentence on direct appeal.
What happened at Bailey Boswell’s trial?
Boswell was convicted of first-degree murder, conspiracy to commit first-degree murder and improper disposal of human skeletal remains. The sentencing announcement issued by the Nebraska Attorney General in 2021 states that she received life imprisonment for the murder conviction and consecutive terms for the remaining convictions.

The Boswell appeal included objections to evidence such as photographs and testimony. The Nebraska Supreme Court’s opinion, State v. Boswell, 316 Neb. 542 (2024), considered those appellate arguments and affirmed the convictions and sentences. An affirmance means the judgment remains in force; it does not mean that an appellate court independently re-tried every factual dispute presented to the jury.

Trail’s direct appeal
In 2022, the Nebraska Supreme Court affirmed Trail’s convictions and death sentence. Its opinion reviewed the legal issues raised on direct appeal, including jury selection, trial rulings, the courtroom incident and sentencing. The decision’s description of trial evidence is a summary of the record relevant to those issues, not a substitute for the complete trial transcript.
Boswell’s appeal
On May 10, 2024, the Nebraska Supreme Court affirmed Boswell’s convictions and sentences. The opinion addressed her evidentiary challenges, including arguments concerning photographs and testimony. The result left the trial judgment intact.
Trail’s later U.S. Supreme Court petition
Trail later sought U.S. Supreme Court review of a state postconviction ruling. The official docket in Aubrey C. Trail v. Nebraska, No. 25-6512, records that the petition for a writ of certiorari was denied on April 20, 2026.

A denial of certiorari means the U.S. Supreme Court declined to hear the case. It is not a new trial, a factual ruling on every issue raised below, or an endorsement of every rationale used by the lower courts. The Nebraska judgments therefore remain the operative convictions and sentences described above.
What were the defense positions, and what did the courts actually find?
Arguments made by a defense are not automatically findings of fact. The Associated Press’s account of the Nebraska Supreme Court’s 2024 decision reported that Boswell’s defense argued she had been forced by Trail to participate. That was a defense position. The public record establishes that a jury convicted her and that the Nebraska Supreme Court affirmed those convictions; it does not turn the defense theory into a judicial finding that she was coerced.
Similarly, appellate opinions may recount prosecution evidence and competing interpretations without resolving every factual assertion independently. The safest description is to distinguish among allegations in charging papers, arguments by lawyers, evidence admitted at trial, jury findings and appellate rulings.
How should the investigation and trial record be read?
- Separate chronology from proof. The dates of the dates, the missing-person report and the arrests or charges explain how the case developed, but a date alone is not proof of a specific act.
- Use the court’s qualifiers. Phrases such as “included as a contributor” or “could not be excluded” accurately describe the DNA language reported in the appellate opinion.
- Do not reduce the case to one clue. The opinions discuss phone and location records, physical recoveries and DNA together.
- Distinguish trial evidence from appellate review. The Nebraska Supreme Court reviewed legal challenges to the proceedings; it did not conduct a second jury trial.
- Identify the decision-maker. The jury returned Trail’s and Boswell’s murder and conspiracy verdicts, while a three-judge panel imposed Trail’s death sentence and the sentencing court imposed Boswell’s terms.
What is the case’s current legal status?
Based on the cited public record, Trail’s direct-appeal convictions and death sentence were affirmed by the Nebraska Supreme Court in 2022. His later petition asking the U.S. Supreme Court to review a state postconviction ruling was denied on April 20, 2026. Boswell’s convictions and sentences were affirmed by the Nebraska Supreme Court on May 10, 2024. Those appellate outcomes leave both defendants’ convictions in place.
