Suno says training on copyrighted music is “fair use”—what the claim means in 2026

Suno acknowledged that copyrighted music appeared in its training data, but says using it to teach a generative model is fair use. The labels disagree, and the U.S. litigation remains unresolved.

Short answer: Suno acknowledged in an August 1, 2024 filing and public statement that it trained models on music found on the open internet and that much of that material was copyrighted, including music owned by major labels. It did not concede that the copying was unlawful. Suno argues that using recordings to teach a system to generate new music is protected by fair use. The labels argue that Suno copied and commercially exploited their catalogs at massive scale. No U.S. court ruling identified through August 18, 2026, has finally resolved that question.

What Suno actually admitted

Suno’s statement was narrower than the headline “Suno stole music” sometimes used by critics. The company said its models were trained on medium- and high-quality music available on the open internet and acknowledged that much of it was copyrighted, including recordings owned by major labels. That is a factual admission about the material in its training corpus, not a judicial finding of infringement.

“Open internet” describes access, not ownership or permission. A recording can be publicly reachable while remaining protected by copyright, subject to platform terms, or unavailable for commercial copying. Suno’s statement did not establish that it had a license for every recording, that it knew the owner of each work, or that its corpus contained only sound recordings. A legal analysis may also involve musical compositions, lyrics, metadata and other separately protected elements.

The company’s user terms are a different issue: they require users to have the necessary rights for material they upload and authorize specified processing and model-improvement uses. Those terms do not answer whether Suno had permission to assemble and copy its historical training corpus.

Why the lawsuits matter

On June 24, 2024, the Recording Industry Association of America announced lawsuits against Suno and Udio on behalf of major record companies. The complaints allege unauthorized copying of decades of sound recordings to build commercial generative-music services. The labels say an AI company should not be able to copy their catalogs, sell access to a competing music product and then invoke fair use without a license.

The cases are not limited to whether an output sounds like a particular hit. They target the underlying acquisition and processing of recordings, the commercial service built on that copying, and alleged harm to existing or foreseeable markets for licensed music used in AI development.

The RIAA announcement and the filed complaint contain the labels’ allegations; they are not proof that every allegation has been established.

Suno’s fair-use theory in plain English

Suno’s position is that a model does not function as a music-streaming service. During training, the system extracts statistical relationships—such as patterns in melody, rhythm, instrumentation and production—and then generates audio in response to a prompt. It does not ordinarily hand the user the original recording as the requested file.

Suno’s chief executive compared that process to a child listening to many rock songs and learning how to write a rock song. The analogy explains the company’s “transformative” argument, but it does not decide the legal issue. A court still must examine the digital copying required to acquire and process the works, the scale of that copying, and its economic consequences.

The governing statute, 17 U.S.C. § 107, directs courts to weigh four non-exclusive factors. None is an automatic rule, and the factors are considered together.

How the four factors frame the dispute

1. Purpose and character

Suno’s argument: Training is technologically transformative. The system uses recordings as inputs to create a new tool and new audio rather than redistribute the originals unchanged.

The labels’ response: Suno is a commercial company whose paid service depends on the trained model. The alleged copying directly supports a competing product. Commercial purpose does not automatically defeat fair use, but it can weigh against it, especially if the use substitutes for licensed material.

2. Nature of the works

Music is highly creative, which generally gives this factor more weight against fair use than use of factual or functional material. The rights are not interchangeable:

  • A sound-recording copyright covers a particular recorded performance (the master).
  • A musical-composition copyright covers the underlying music and lyrics.
  • Master owners, songwriters and publishers may be different parties.
  • Lyrics, performances and some metadata can raise additional claims.

The 2024 RIAA case principally emphasizes sound recordings, while other claims or licensing arrangements could involve compositions and lyrics as well.

3. Amount and substantiality

Training may require acquiring and processing complete recordings. Suno can argue that the model does not retain or distribute those recordings as songs. The labels can respond that complete copying is still copying and that the quality, scale and possible retention of expressive material matter.

The question is not simply whether a model used “small snippets.” Relevant evidence could include how much of each recording entered the pipeline, whether protected expressive elements were retained, and whether the system can reproduce recognizable material.

4. Effect on existing and potential markets

This may be the most economically consequential factor. Suno can characterize its service as a new creative tool that does not replace the original catalog. The labels can argue that generated tracks compete with licensed recordings and commissioned music, reduce demand in commercial uses, and undermine a foreseeable market in which catalog owners license music for AI training.

Docket materials show discovery disputes about licensing agreements, AI-licensing strategy, alleged market harm and the labels’ efforts to obtain “no AI” provisions. Those disputes do not establish the final answer, but they show why market evidence is central.

Training, outputs and user uploads are separate questions

The dispute contains at least four legally distinct issues:

  1. Was it lawful to acquire or copy the recordings for the training corpus?
  2. Was it lawful to store and process those copies during training?
  3. Does a particular generated track reproduce protected expression from an existing song or recording?
  4. Did a user supply infringing lyrics, audio, samples or other material?

A company could prevail on one issue and lose on another. Original output would not automatically legalize unlicensed training, while a finding that some training was fair would not immunize an output that reproduces protected lyrics, a melody or a recording.

Memorization and regurgitation

Evidence could become especially important if a model produces material unusually close to a training example. Investigators and courts might examine near-identical melodies, lyrics, arrangements or recordings; reproduction after unusually specific prompts; audio fingerprints; internal memorization evaluations; and safeguards that detect or block recognizable material. No supported finding here establishes that Suno’s models do or do not memorize particular songs.

Access method and provenance

Source provenance can matter independently of fair use. Questions include whether files were downloaded under a platform’s terms, whether technical restrictions or anti-scraping measures were bypassed, whether Suno had a license for masters or compositions, and whether a purchase by an individual authorized mass commercial copying. Accessibility alone answers none of those questions.

What has happened since 2024?

U.S. litigation remains unresolved

As of August 18, 2026, the located U.S. docket materials show continuing discovery over training data, licensing, market harm and Suno’s defenses. Suno has also raised theories involving alleged copyright misuse and anticompetitive conduct, arguing that major rights holders may be using market power to restrict AI competition. Those are litigation positions, not findings that the labels coordinated unlawfully. No final U.S. fair-use judgment was verified in the cited materials.

A reported German ruling

MusicRadar reported that the Munich Regional Court ruled against Suno on July 31, 2026, in a case brought by GEMA concerning works represented by the German collecting society. Coverage describes licensing-related remedies and a finding that Suno’s conduct was unlawful under German law.

That development may increase commercial and litigation pressure on AI-music companies, but it is not binding precedent in the Massachusetts federal case. The jurisdictions may apply different statutes, evidence and remedies. The final German text, any appeal and the precise scope of an injunction or disclosure order should be checked before relying on them.

Prices, credits and model features can change; the pricing page identified an advanced model as v5.5 when checked. Suno says paid-plan rights may permit distribution and monetization, but copyright eligibility varies by region and fully AI-generated music may not qualify for copyright protection in the United States. Human-authored lyrics, substantial edits, arrangement or other creative contributions can change the analysis without making every element protected.

Users remain responsible for uploads, lyrics, samples, voices and other third-party material. A user who uploads a copyrighted backing track, supplies lyrics they did not write, imitates a living artist’s voice, or distributes a recognizable melody may face separate claims. Suno’s relevant materials are its pricing page, paid-rights guidance, distribution guidance, retroactivity guidance, copyright explanation and Terms of Service (listed as revised March 26, 2026 on the terms page).

What the case could decide—and what it will not

A decision could address Suno’s particular corpus, copying methods, evidence of output behavior and commercial markets. It would not automatically settle every AI-training dispute, every model architecture or every jurisdiction. Remedies could range from damages and disclosure to licensing, an injunction or a negotiated settlement.

Nor would a ruling on training answer whether a particular user’s song is copyrightable, whether a distributor will accept it, or whether lyrics and samples were lawfully supplied. Those questions require separate analysis of authorship, contracts and third-party rights.

Frequently Asked Questions

Did Suno admit that its training data contained copyrighted music?

The U.S. courts had not finally answered the question in the cited materials as of August 18, 2026.
