That is narrower than a promise to avoid all AI processing: SoundCloud still describes AI-assisted tools for functions such as discovery, content identification, and fraud prevention. The controversy began in 2025, when artists objected to broad terms language that appeared to permit content to be used in AI development. SoundCloud’s live terms are the controlling version as of August 18, 2026.
Why did SoundCloud’s AI clause cause a backlash?
In May 2025, reporting drew attention to language in SoundCloud’s terms that reportedly had been added in a February 2024 update. It said that, unless a separate agreement said otherwise, users agreed their content could be used to “inform, train, develop or serve as input” to AI or machine-intelligence technologies or services as part of providing SoundCloud’s services. TechCrunch reported the clause and SoundCloud’s response on May 9, 2025; The FADER followed up on May 14.
Artists objected because the wording was broad and did not clearly separate ordinary platform uses of machine learning from training generative systems on recordings to produce or imitate music. “Train” and “serve as input” can describe dataset use as well as other technical processes, and the terms did not make the boundary clear to users. Contemporary reporting also said users could not find an obvious web-setting opt-out when the issue surfaced. The clause appeared to grant broad permission; it is not, by itself, evidence that SoundCloud actually trained a generative model on uploaded music.
Did SoundCloud train AI on artists’ uploads?
SoundCloud said it had never used artist content to train AI models, had not developed generative-AI tools using artists’ uploads, and did not permit third parties to scrape its content for AI training. It said the disputed language was intended to describe internal AI-assisted functions, including recommendations, search, playlisting, tagging and organization, fraud detection, and content identification. Those are SoundCloud’s public statements, reported by TechCrunch and The FADER; the available sources do not establish an independent technical audit of every use of content.

What changed in the current terms?
Following the backlash, SoundCloud said it would clarify that it would not use user content to train generative-AI models designed to replicate or synthesize a user’s voice, music, or likeness without explicit affirmative opt-in consent. The live Terms of Use contain that commitment and state they were last amended January 19, 2026. SoundCloud’s May 2025 explanation also said future generative-AI opportunities for artists would require explicit consent and artist control.
The commitment is specific: it concerns training generative models intended to reproduce or synthesize creative identity. It is not phrased as a ban on every machine-learning use, nor does it resolve every copyright, privacy, publicity, performer-rights, or licensing issue that may arise from a recording. The current terms also place responsibility on users to have the rights, licenses, consents, and permissions required for uploaded content, and allow SoundCloud to remove content or take other action when terms or another person’s rights are violated. For content delivered under separate agreements and controlled by third-party rights holders, the terms say AI use requires authorization from the applicable rights holders.

“AI use” covers different activities
SoundCloud’s public materials describe a range of AI-related activity. Treating all of it as “training on artists’ music” obscures important differences:
- Platform operations: discovery and recommendations, search, tagging and organization, content identification, and fraud detection. SoundCloud has described these as operational or artist-supporting functions.
- Generative-model training: using content to develop a model that generates or imitates music, a voice, or a likeness. The current terms require affirmative opt-in consent for the specified identity-replicating use.
- AI-assisted creation: a creator uses a tool for a remix, vocal transformation, or other music-making task. The rights and permissions for the inputs and output still matter.
- Distribution and monetization: whether a release is eligible through SoundCloud for Artists. This is a separate product-policy question, not the same as whether a user may upload a track directly to SoundCloud.
SoundCloud’s AI Partnerships & Integrations page describes partner tools and AI-related work. Its existence does not mean every partner workflow is automatically cleared for commercial release or distribution.

What do the API rules say about third parties?
SoundCloud’s API Terms of Use address developers using content accessed through the API. They prohibit copying or reproducing user content to inform, train, develop, or provide input to AI technologies unless explicitly licensed, and restrict using API-accessed content to train or develop AI, create fingerprints, or serve as AI input. The terms also require relevant licenses, rights, permissions, and rightsholder authorization for AI services built using SoundCloud user content.
These API restrictions concern developers and API-accessed material; the general Terms of Use govern SoundCloud users and the platform relationship. The documents therefore address different actors and situations. The API language is not a substitute for the separate commitment in the general terms governing SoundCloud’s own use of content.

Can artists upload or distribute AI-generated music?
SoundCloud’s guidance distinguishes a track being present on the listening platform from a release being eligible for distribution or monetization through SoundCloud for Artists. Its distribution rejection guidance says AI tracks require rights verification. It states that content made with services such as Suno was not eligible for SoundCloud for Artists distribution or monetization at the time of that guidance, while content made through SoundCloud’s AI integration partners could be eligible. That is a product-specific rule, not proof that every AI-assisted upload is banned across SoundCloud.
Eligibility can turn on the creation method, tool terms, rights, and route used. Before submitting a release, check the current help-center guidance rather than assuming that an AI tool’s presence in a partner ecosystem guarantees distribution approval.

What creators should check before uploading or distributing
- Use the current terms, not old screenshots. Read the live Terms of Use and check its amendment date; the version current as of August 18, 2026 is marked January 19, 2026.
- Identify the route. A direct SoundCloud upload, SoundCloud for Artists distribution, an API integration, and a third-party partner workflow can be governed by different rules.
- Verify every right in the track. Confirm permissions for the master recording, composition, samples, vocals, and any identifiable voice or likeness. Owning a finished master does not necessarily clear the other elements in it.
- Read the AI tool’s license. Check commercial-use permissions, ownership terms, attribution duties, restrictions on distribution, and any rules about training data or output.
- Keep records. Retain project files, collaborator permissions, sample and beat licenses, AI-tool terms, and voice or likeness releases so you can document how the track was made and what you are authorized to use.
- Look for an affirmative opt-in. If SoundCloud offers a generative-AI program involving your content, distinguish a clear opt-in from a general platform setting or ordinary upload permission.
A public upload should not be treated as a license for third parties to train models. SoundCloud’s stated “no AI” signaling mechanism may communicate restrictions, but it is not a universal technical guarantee against scraping. Likewise, contractual language cannot by itself settle every rights dispute involving a sample, cloned voice, or third-party likeness.
What the controversy means now
The 2025 dispute was about both the breadth of the old wording and the trust artists place in platforms with their recordings. SoundCloud narrowed the relevant promise: under the current terms, generative training aimed at replicating or synthesizing a user’s voice, music, or likeness requires that user’s affirmative opt-in consent. That change should not be confused with a claim that SoundCloud performs no AI-assisted processing, or that every AI-created track is eligible for every SoundCloud product.
