SoundCloud Backtracks on AI After Artist Outrage—and What Its New Policy Actually Means

SoundCloud’s broad AI language triggered artist outrage in 2025. The company later promised opt-in consent for generative models that replicate a user’s voice, music, or likeness—but the policy is not a blanket ban on all AI processing.

SoundCloud did not establish that it had trained a generative-AI model on artists’ music. The 2025 controversy began when users discovered unusually broad Terms of Use language allowing uploaded content to “inform, train, develop or serve as input to” AI technologies. After artists objected, SoundCloud said the wording was too broad, promised clearer protections, and added an explicit opt-in requirement for generative models designed to replicate or synthesize a user’s voice, music, or likeness.

That is a meaningful change, but it is not a blanket ban on every AI-related use of uploads. SoundCloud still distinguishes generative systems that imitate creative identity from operational tools used for recommendations, organization, personalization, fraud prevention, and content identification.

The short version

  • What triggered the backlash: SoundCloud’s terms appeared to grant broad permission for uploaded content to be used in connection with AI and machine-intelligence technologies.
  • What SoundCloud said it had done: The company denied using artist content to train generative-AI models and said it did not permit third-party scraping for that purpose. That is a company statement, not an independently published audit.
  • What changed: SoundCloud said it would require explicit opt-in consent before using content to train generative models intended to replicate or synthesize a user’s voice, music, or likeness.
  • What remains unclear: The current language does not answer every question about recommendation models, embeddings, metadata, consent withdrawal, deletion of training data, audits, compensation, or earlier processing.
  • What artists should do: Separate SoundCloud’s upload rules from its distribution rules, verify rights in every part of an AI-assisted track, and retain licenses and permission records.

Why SoundCloud’s terms caused alarm

As reported by TechCrunch, SoundCloud added broad AI-related language in a February 2024 Terms of Use update. In practical terms, the clause appeared to let the company use uploaded content as material for informing, training, developing, or supplying AI and machine-intelligence technologies.

That wording raised a straightforward concern: could music uploaded by an artist become training data for a system capable of generating music, copying a vocal identity, or imitating an artist’s style? The language alone did not prove that such training had occurred. It did, however, appear broad enough to create uncertainty about what the platform had permission to do.

For musicians, the distinction matters. Completed use, contractual permission, and perceived future risk are three different things. An artist may object to a platform claiming a right even if the platform says it has not exercised that right.

SoundCloud’s explanation

SoundCloud said it had never used artist content to train generative-AI models, had not developed AI tools using that content, and did not allow third parties to scrape SoundCloud for AI training. The company also pointed to a “no AI” tag intended to prohibit unauthorized use.

SoundCloud said the broad wording was intended to cover platform functions such as personalized recommendations, content organization, discovery, fraud detection, and content identification. Those functions can involve machine-learning systems without being generative tools that produce new music or imitate a performer.

That explanation addressed what the company said it intended. It did not remove the underlying problem: the wording users saw was broader than the examples SoundCloud gave publicly.

The backlash and the reversal

Artists and AI-policy advocates objected to the apparent absence of a clear, visible opt-in. Their concerns included possible use of music, voices, compositions, metadata, lyrics, and artist identity to build competing generative systems. They also questioned whether creators would receive attribution, compensation, meaningful control, or a practical way to refuse.

The controversy was intensified by the contrast between SoundCloud’s artist-focused identity and terms that appeared to give the platform extensive discretion over uploaded material.

On May 14, 2025, CEO Eliah Seton acknowledged that the language was “too broad” and unclear. SoundCloud said it would revise the Terms of Use and would not use content to train generative-AI models designed to replicate or synthesize a user’s voice, music, or likeness without explicit opt-in consent. The company also described future AI use as being based on consent, transparency, and artist control. The commitment was reported by TechCrunch and stated in a public SoundCloud CEO clarification.

What the current terms say

The current SoundCloud Terms of Use reviewed for this article list January 19, 2026 as the amendment date. They include language stating that SoundCloud will not use content to train generative-AI models aimed at replicating or synthesizing a user’s voice, music, or likeness without explicit consent through an opt-in mechanism. See the current Terms of Use for the operative language.

The terms also state that SoundCloud and third parties may not use covered content controlled by third-party rights holders for AI training or development without authorization from the applicable rights holders.

This is narrower than saying “SoundCloud banned AI training.” The policy specifically addresses generative models intended to reproduce or synthesize creative identity. It does not necessarily prohibit every machine-learning process used to operate the service.

What “opt-in” does—and does not—answer

The important question is not only whether SoundCloud uses the word “opt-in,” but what the opt-in covers and how it works in practice.

The current language and public explanations do not fully resolve whether consent is required for every AI system or only for generative models that replicate or synthesize voice, music, or likeness. They also leave practical questions for creators:

  • Does “training” include embeddings, classifiers, tagging systems, recommendation models, moderation tools, or analytics?
  • Are metadata, artwork, lyrics, track descriptions, comments, and listening behavior covered separately from audio?
  • Can consent be withdrawn, and what happens to a model or dataset created before withdrawal?
  • Does a later policy revision apply to material processed under an earlier version of the terms?
  • Are label, publisher, enterprise, or other separately negotiated agreements controlling?
  • What exactly counts as explicit consent in the user interface?

These are implementation and contract questions, not evidence that SoundCloud has used music improperly. They are also the questions artists should ask before treating the revised policy as a complete solution.

Third-party rights make the issue more complicated

An uploader cannot necessarily authorize uses of material they do not control. A track may contain a beat or sample licensed from someone else, a co-written composition, a featured performer’s vocal, a label-controlled master, third-party artwork, or lyrics owned by another rights holder.

SoundCloud’s current terms address content controlled by third-party rights holders and require authorization for AI training or development. That means an artist’s upload is not automatically a complete grant of rights merely because the artist pressed the upload button.

For collaborations, each contributor’s rights may matter. A permission from one vocalist may not cover the composition, master recording, or another performer’s identity. Similarly, an AI music subscription may grant commercial rights to certain outputs while leaving samples, voices, lyrics, or underlying compositions subject to separate restrictions.

SoundCloud’s own AI tools and partnerships

SoundCloud has said it works with AI vendors on tools involving remixing, vocal generation, and custom samples. It has also described partner tools such as Musiio as supporting artist discovery and content organization rather than generative-model training.

That distinction is important: SoundCloud’s willingness to support some AI-assisted creation or platform automation does not mean every AI-generated track is automatically eligible for upload, distribution, or monetization.

Uploading is not the same as distributing or monetizing

SoundCloud’s rules for putting a track on the platform are separate from its rules for distributing or monetizing that track through SoundCloud for Artists. The company’s Help Center guidance on AI-assisted content says creators must own the relevant rights or hold appropriate licenses.

At the time covered by the cited Help Center material, SoundCloud identified certain AI integration partners whose content could be considered for distribution or monetization, subject to rights verification and documentation. The same guidance identified Suno-created content as not valid for SoundCloud for Artists distribution or monetization at that time. Because eligibility pages can change, artists should check the live policy before submitting a release.

In other words:

  • Platform AI policy: how SoundCloud may process content uploaded to its service.
  • Distribution policy: whether an AI-assisted recording can be sent to other services or monetized through SoundCloud.
  • Copyright and licensing: whether the uploader owns or has cleared the recording, composition, voices, samples, artwork, and other elements.

A track may be uploadable but rejected for distribution. That is a policy distinction, not necessarily a contradiction.

A practical checklist for artists

  1. Read the current Terms of Use. Record the amendment date and the date you reviewed it. Do not rely on an old screenshot or a social-media summary.
  2. Identify the exact AI use. Ask whether the issue involves generative replication, recommendation, tagging, moderation, fraud detection, personalization, or another operational function.
  3. Confirm what you own. List the master, composition, lyrics, samples, loops, artwork, featured performances, and voices in the track.
  4. Save documentation. Keep AI-service terms, subscription receipts, licenses, stems, contributor permissions, and collaboration agreements.
  5. Check distribution eligibility separately. Review SoundCloud’s current distribution-rejection guidance before submitting an AI-assisted release.
  6. Be especially careful with voice cloning. Your own voice, another person’s voice, and an imitation of a recognizable performer raise different permission questions.
  7. Ask for written clarification when necessary. If the track involves a label, publisher, co-writer, sample, or AI provider with unusual terms, obtain a clear answer before monetizing.

What the episode means for creator platforms

The SoundCloud dispute illustrates why broad AI language can trigger a major backlash even when a company says no controversial training has occurred. Creators increasingly expect affirmative consent rather than a general permission buried in platform terms.

Platforms, meanwhile, want to use machine learning for discovery, personalization, content organization, moderation, and fraud prevention. They must explain those uses without creating the impression that creator uploads can quietly become the raw material for generative competitors.

SoundCloud’s revised language is therefore best understood as a clarification and contractual restriction, not proof that every AI-related use of uploaded material is prohibited. It narrows the most alarming scenario—generative replication of a user’s voice, music, or likeness without explicit opt-in consent—while leaving other operational and implementation questions open.

What remains unresolved

The available policy language does not establish whether consent can be revoked, whether already-created training data would be deleted, whether models would be retrained, whether creators receive compensation, or whether independent audits are available. It also does not make every AI-assisted output automatically copyrightable, licensable, or eligible for distribution.

Artists should treat the January 19, 2026 terms as the current reference point identified here, while recognizing that Terms of Use and Help Center rules can change. The safest approach is to match each upload and release to the rights actually controlled, the AI provider’s license, and the distribution route’s current eligibility rules.
