What happened on the Rust set
In October 2021, a firearm discharged during a rehearsal for the film Rust near Santa Fe, New Mexico. Cinematographer Halyna Hutchins was killed, and director Joel Souza was wounded. Actor and producer Alec Baldwin was holding the firearm, according to Associated Press reporting.
What the jury decided
The jury convicted Gutierrez-Reed of involuntary manslaughter and found her not guilty of a separate charge of evidence tampering. The verdicts were distinct: her acquittal on the tampering charge did not change or cancel the manslaughter conviction. The jury announced its decision on March 6, 2024, as the Associated Press reported.
What prosecutors and the defense argued
The prosecution’s account
Prosecutors argued that live ammunition had been brought onto the set and that Gutierrez-Reed failed to detect it during firearm-safety checks. In closing, special prosecutor Kari Morrissey told jurors: “Hannah Gutierrez failed to maintain firearms safety, making a fatal accident willful and foreseeable.” That was the prosecution’s argument, not a separate finding beyond the jury’s verdict. Associated Press coverage reported the argument and verdict.

The defense’s position
The defense disputed the prosecution’s account and argued that failures extended beyond Gutierrez-Reed, including in weapon handling and production safety. Those were defense arguments; they should not be confused with the jury’s recorded findings. CBS News coverage describes the competing positions.
Post-verdict motion and sentence
On March 29, 2024, the trial judge denied Gutierrez-Reed’s motion for a new trial and release pending sentencing. The defense had relied on a New Mexico Supreme Court decision about jury instructions; the judge found the cases distinguishable, according to the Santa Fe Reporter.

On April 15, 2024, Judge Mary Marlowe Sommer sentenced Gutierrez-Reed to 18 months in prison. Contemporary local reporting described the term as the maximum sentence. At sentencing, Souza spoke about the loss caused by Hutchins’s death. CBS News quoted him saying: “What I want is simply not possible. What I want is, everyone is OK and lives aren’t destroyed.” CBS News reported on the hearing and sentence.

Gutierrez-Reed’s attorneys filed an appeal with the New Mexico Court of Appeals in May 2024, according to the Albuquerque Journal. That filing establishes that an appeal was initiated; it does not establish how the court ruled. The cited reporting does not establish the appeal’s disposition as of October 7, 2026, so no later outcome or current custody status can be stated here.
