What is Russell Simmons suing over?
The lawsuit challenges On the Record, a 2020 documentary about sexual misconduct allegations against Simmons. In his verified amended complaint, Simmons characterizes the film as “a defamatory film that was mislabeled as a factual documentary.” That is his description, not a judicial conclusion.
TheWrap reported in 2025 that Simmons sought $20 million in damages and alleged that the film disregarded evidence he and his legal team had presented. Reporting in March 2026 on the amended complaint says Simmons also accused the defendants of proceeding despite warnings and presenting a one-sided account. These are claims by Simmons; the sources do not independently establish them as facts.
The complaint also states, “This lawsuit is not an attempt by the Plaintiff to stifle any free speech.” That sentence is part of Simmons’s pleading, not a court’s assessment of the suit’s purpose.

Who is named in the amended complaint?
A copy of the verified amended complaint identifies the plaintiff as Russell W. Simmons and the case as New York County Supreme Court, Index No. 157136/2025. It names Warner Bros. Discovery, Inc., doing business under the HBO, HBO Max, and Max brands; Jane Doe Films; director Kirby Dick; and director Amy Ziering, as well as placeholder defendants. A complaint records a party’s allegations; it does not establish that they are true.
What does On the Record cover?
The film centers on music executive Drew Dixon’s account and her decision to speak publicly. It also covers Sil Lai Abrams and Sheri Sher. Warner Bros. Discovery’s pressroom says HBO Max acquired U.S. rights after the film’s 2020 Sundance Film Festival premiere; Jane Doe Films describes it as a 2020 HBO Max Original.

HBO’s synopsis likewise presents the story through Dixon’s decision to speak publicly and her experience in the music industry. PBS’s May 26, 2020 program framed the documentary around allegations against Simmons and discussed Dixon and Joan Morgan. The women’s accounts are allegations, and Simmons denies sexual assault allegations.
What do the filmmakers say about the film?
In an International Documentary Association interview, directors Dick and Ziering discussed the documentary, Oprah Winfrey’s withdrawal before the Sundance premiere, and their account of the film’s fact-checking. Those remarks describe the filmmakers’ account of their process; they are not independent proof of every disputed assertion in the film or lawsuit.

Has a court ruled on the lawsuit?
The available sources identify the lawsuit and amended complaint but do not establish a later motion, ruling, settlement, dismissal, or other final outcome as of October 8, 2026. It would therefore be inaccurate to say, on this evidence, either that a court found the documentary defamatory or that it rejected Simmons’s claims. The complaint’s status and the latest docket event are separate questions from what the parties allege.
