Yes, you can use AI-generated background music in a documentary or creator video, but “royalty-free” describes a licence, not automatic copyright ownership. Choose a product whose stated terms cover your release, keep the download or licence record, and check whether the free tier is personal-use only, watermarked, public, or excluded from commercial rights. For documentary work, also avoid prompts that imitate a living artist or a recognisable singer without consent.
What “Royalty-Free” Means For Background Music
A royalty-free track normally means you do not owe a separate royalty for each use covered by the licence. It does not necessarily mean you own the composition, can register it exclusively, or can use it in every medium. The vendor’s plan and licence control those details.
In the United States, the Copyright Office says material generated entirely by AI is not copyrightable, prompts alone do not make you the author, and only human-authored parts of a mixed work can be protected. Background-Music Needs In A Documentary Edit
- Ask for an instrumental bed when narration must remain intelligible: for example, “restrained documentary underscore, sparse piano and soft strings, low dynamics, no lead melody.”
- Describe the edit’s emotional job rather than a famous artist: “observational countryside sequence, patient pulse, organic texture, gradual lift for the final reveal.”
- Generate alternate energy levels and endings so the editor can leave space for interview answers, archive audio and credits.
- Keep stems or editable files when the service provides them, so dialogue ducking and scene changes can be handled in the edit.

How To Use A Track Ethically And Safely
- Write a rights brief. State the film type, release platforms, territory, duration, mood, instrumentation and whether a client needs an onward licence.
- Use a neutral musical reference. Describe tempo, texture, density and emotional arc. Do not request a living artist’s voice, a named performer’s identity or a near-copy of a copyrighted track.
- Check the exact plan. Save the plan name, date, receipt, download page and licence text. Free access may mean personal use, attribution, public release or no commercial rights.
- Keep human creative work. Your arrangement, editing, orchestration, recording, mix and original lyrics can be the human contribution; retain project files that show that work.
- Credit and disclose where required. Tunee’s free plan requires attribution, while Spotify supports DDEX AI disclosures and labels some potentially AI-generated artist identities with an AI Persona badge. - Review the final mix. Remove musical moments that mask speech, check loudness transitions against archive audio, and confirm that any voice, sample or reference upload was supplied with the necessary consent.
Consent, Voices And Samples
A background track can still create rights and ethical problems when it contains an identifiable voice, imitates a performer, or is built from material you do not control. Musicful advises creators to avoid directly copying copyrighted works or protected content from specific artists. Spotify says vocal impersonation is allowed only when the impersonated artist has authorised it. Obtain consent for any person’s voice and follow the platform’s terms before publication. Where The Evidence Stops
Vendor phrases such as “royalty-free” or “commercial use” do not establish every detail a production may need. The supplied information does not establish universal clearance for collecting-society registration, Content ID, sublicensing, theatrical distribution, broadcast, worldwide territories, or perpetual client ownership. Ask the vendor for those points before delivery when they matter to the commission.
