Quebec has enacted a law that could require qualifying digital platforms to offer and make French-language cultural content easier to find. But it does not set a fixed quota: the percentages, covered services and practical rules depend on future regulations. The Act’s coming-into-force date must also be set by government decree.
From bill to law
Bill 109, An Act to affirm the cultural sovereignty of Québec and to enact the Act respecting the discoverability of French-language cultural content in the digital environment, was introduced on May 21, 2025, by Mathieu Lacombe, Quebec’s Minister of Culture and Communications. It passed on December 11 and received assent on December 12, 2025, becoming 2025, chapter 38. The National Assembly’s bill record says the Act comes into force on a date or dates determined by decree. Accordingly, enactment should not be confused with the start of operational obligations.
The Act also amends Quebec’s Charter of Human Rights and Freedoms to recognize, subject to standards established by law, a right to the discoverability of and access to original French-language cultural content. The details of what platforms must do are chiefly left to regulations.
What “discoverability” means
The Act treats discoverability as more than having a title somewhere in a catalogue: content must be available online and easy to find among other content, including for someone who was not specifically looking for it. A French-language film buried in a vast catalogue may be available, but its placement, metadata, searchability and recommendations affect whether users can discover it.

The statute authorizes rules about recommendations, promotion and display, as well as metadata standards. Depending on the eventual regulations, those rules could affect home screens, search results, category pages, curated collections or recommendation systems. The law does not itself prescribe a particular ranking formula or require users to watch or listen to any particular work.
No percentage is written into the Act
The Act does not say, for example, that a platform must devote 30% of its catalogue to French-language content. Instead, it empowers the government to make regulations setting criteria for original French-language cultural content and the quantity or proportion that covered platforms must offer. Regulations may also address the share of content available in a French version, accessible French-language content for people with disabilities, discoverability, metadata, exceptions and different requirements for different kinds of services, content or manufacturers. The enacted text is the controlling source for that framework.
That leaves three distinct steps: the Act has created the authority; regulations must supply many of the concrete standards; and individual platforms may in some cases follow an approved alternative agreement rather than default regulatory measures. Until the regulations and commencement decree are in place, claims about a specific service’s quota or deadline are premature.

French-language does not automatically mean Quebec-made
The Act refers to original French-language cultural content from Quebec or elsewhere in the world. French-language work from France, Belgium, Africa or another francophone region could therefore be relevant under the future rules. That is not the same as a Quebec-production quota.

The regulations will determine how such categories count. A French version may be addressed separately from original French-language content, so a dubbed title should not automatically be assumed to satisfy any future original-content requirement.
What services and devices could be covered?
The framework is broader than conventional video streaming. It can reach services offering audiovisual content, music and other audio, as well as other online cultural-content services identified by regulation. It also covers platforms that provide access to third-party services, and may impose duties on television manufacturers and connected-device manufacturers whose interfaces provide access to online cultural content.

Netflix, Spotify, an audiobook service, a podcast platform or a connected-TV interface may illustrate the kinds of services or products the law could reach; naming an example does not establish that it will be covered or what obligation it will have. Coverage and requirements depend on the Act’s definitions and future regulatory criteria. The framework includes services provided with or without payment, so free access alone does not necessarily put a service outside it.
The enacted law excludes a digital platform whose main purpose is to offer Indigenous content. It is important to rely on the final Act rather than assume every exclusion discussed when the bill was introduced carried through unchanged.
Possible changes users might notice
The Act provides for interfaces to be easily configurable in French, subject to regulatory conditions. That does not by itself establish a universal rule that French must be the default language. Regulations could also require more visible French-language collections or recommendations, better French metadata, or other ways to make content easier to find.

Some television and connected-device interfaces may also be required to provide access to government-designated viewing platforms that meet specified conditions, including majority original French-language cultural content and operation by a public-interest or nonprofit legal person. The practical result could be a clearer French-language option or more direct access to qualifying services, but the precise design and scope remain to be settled.

The Minister may enter into an agreement with a qualifying platform allowing substitute measures, if they achieve the Act’s objectives at least equivalently. Government approval is required, and an agreement may last up to four years. The statute does not prescribe a standard package for such agreements; a tailored approach could matter where a single catalogue percentage would not fit a service’s business model.
The Act establishes the Bureau de la découvrabilité des contenus culturels within the Ministry of Culture and Communications to help ensure compliance with the Act, regulations and approved agreements. The framework provides for registration of platforms that meet regulatory criteria, information requests, inspections and investigations. The Minister can require non-personal information about content presence, discoverability and consumption, and can order platforms or manufacturers to take corrective measures. The Act also provides for injunctions, administrative penalties where authorized and penal provisions.

For failure to comply with a ministerial order, the statute sets a maximum administrative penalty of $2,500 for a natural person and $15,000 for any other person. Regulations may establish penalties for regulatory breaches up to those amounts, and continuing non-compliance can count as a new breach for each day it continues. These figures are not a blanket statement of likely liability for every platform or every breach: the applicable provision and regulations matter.
What remains unsettled
The Act establishes a framework, not a complete operating manual. Important details await the commencement decree and regulations, including which platforms meet coverage or registration thresholds, the actual percentages, how original French-language content and French versions are counted, applicable accessibility standards, exceptions, discoverability measures, reporting duties and enforcement procedures. The Act calls for the Minister to report to government at least once every three years, but that does not substitute for the rules platforms need to implement.
Quebec’s framework also sits alongside federal broadcasting and online-streaming regulation. Federal policy addresses broadcasting and online undertakings, Canadian content, contributions and the CRTC’s jurisdiction; Quebec’s law focuses on French-language cultural content, discoverability and interfaces. They are distinct regimes, and the Quebec Act does not by itself settle how any particular federal requirement applies or resolve jurisdictional questions.
For creators and cultural organizations, the framework could create new ways for French-language works to be carried and surfaced. For platforms and device makers, potential obligations may involve catalogues, French versions, interfaces, metadata, recommendations, data and reporting. For viewers, the intended outcome is easier access and discovery—not a rule requiring them to consume particular content. Exactly how those interests will be balanced depends on the regulations and implementation.
