Pornhub and XVideos Face the EU’s Strictest Platform Rules—but They Aren’t Social Networks

Pornhub and XVideos have not been reclassified as social networks. But because each exceeded 45 million EU users, both face the Digital Services Act’s strictest VLOP obligations—including systemic-risk reviews, transparency, researcher access and enhanced child-protection scrutiny.

Yes—but with an important qualification: the European Union has not legally reclassified Pornhub or XVideos as social-media sites. Instead, the European Commission designated both adult-content video platforms as Very Large Online Platforms (VLOPs), placing them in the Digital Services Act’s highest regulatory tier alongside the largest social and online-platform services.

Each platform was found to have at least 45 million average monthly users in the EU, the statutory threshold for VLOP designation. That status brings enhanced duties covering systemic-risk assessments, risk mitigation, transparency, advertising, researcher access, compliance governance and protection of minors.

The short answer: same top regulatory tier, not the same type of service

The headline is broadly right about the seriousness of the rules, but “the same rules as social media sites” can be misleading if it suggests that Pornhub and XVideos have become social networks.

Under the EU’s Digital Services Act, services are regulated according to factors including their reach, function and potential systemic risks. A platform that hosts or distributes user content can fall within the DSA without being a conventional social network. Once an online platform reaches at least 45 million average monthly active recipients in the European Union and is formally designated, it enters the VLOP category.

Pornhub and XVideos crossed that threshold. Their designation means they face many of the same enhanced obligations imposed on the largest social-media and online-platform services. It does not mean that their business models, content rules or every individual legal obligation are identical to those of Facebook, Instagram, TikTok or X.

What happened, and when?

The European Commission designated Pornhub and XVideos as VLOPs on December 20, 2023. The Commission said that each service had at least 45 million average monthly users in the EU.

The general DSA framework began applying broadly to covered intermediary services on February 17, 2024. The additional obligations specific to the VLOP tier took effect four months after notification:

  • Pornhub: VLOP obligations began on April 21, 2024.
  • XVideos: VLOP obligations began on April 23, 2024.

The distinction matters. The DSA is not a single set of rules that suddenly applied to only these two websites. It is a graduated framework: general obligations apply across the covered digital-services sector, while the strictest requirements apply to services designated as VLOPs or Very Large Online Search Engines.

The Commission’s official designation list, as updated in 2026, continues to identify Pornhub and XVideos as VLOPs and records their designation date as December 20, 2023. VLOP status is therefore an ongoing regulatory classification, not a one-time announcement.

What the strictest DSA tier requires

The enhanced duties are designed around the idea that very large services can create or amplify risks affecting many people. The obligations reach beyond the question of whether an individual piece of content is legal. They also examine how a platform is designed, how it recommends material, how it sells advertising, how it enforces its terms and how it manages risks to users and society.

1. Annual systemic-risk assessments

VLOPs must identify, analyse and assess systemic risks connected with the design or operation of their services at least annually and whenever necessary. The assessment must consider more than ordinary content moderation.

Relevant risk categories include:

  • the dissemination of illegal content;
  • risks to fundamental rights, including freedom of expression and privacy;
  • effects on civic discourse and electoral processes;
  • gender-based violence;
  • public-health risks; and
  • risks to the protection of minors.

For an adult-content platform, the minor-protection issue is particularly significant. The Commission is examining not only whether illegal material is removed, but also whether the service’s systems adequately prevent children from encountering pornography and whether the platform’s age-assurance controls are effective in practice.

2. Measures to reduce identified risks

After identifying systemic risks, a VLOP must adopt reasonable, proportionate and effective mitigation measures. The DSA does not prescribe one universal technical solution for every platform. Instead, the measures are expected to respond to the platform’s particular design and risks.

Possible areas for mitigation include:

  • content-moderation systems and enforcement procedures;
  • recommendation and ranking systems;
  • terms and conditions;
  • advertising systems;
  • data practices;
  • user-reporting and complaint mechanisms; and
  • design choices affecting children and other vulnerable users.

This is one reason the comparison with social-media platforms is useful. The EU is regulating the potential impact of the service as a large information-distribution system, rather than applying a special rule simply because a website belongs to the adult-entertainment industry.

3. More detailed transparency reporting

VLOPs must publish more extensive information about their moderation systems than smaller covered services. Reporting can include details about moderation resources, the qualifications of moderators, language expertise and indicators relating to moderation accuracy.

The Commission’s transparency portal lists reports for both services. The portal shows Pornhub reports for February 2026, August 2025, February 2025 and August 2024. It shows XVideos reports for February 2026, August 2025, February 2025 and June 2024.

The existence of a report does not mean that the Commission has accepted the platform’s compliance, data, methodology or conclusions. It does show that VLOP transparency is a continuing obligation rather than a label applied once at the time of designation.

4. Advertising transparency

The Commission has identified additional advertising-transparency obligations for Pornhub, XVideos and Stripchat. These obligations are part of the broader DSA effort to make large platforms more transparent about advertising systems and the relationship between ads, users and targeting.

Advertising transparency should not be confused with a requirement that all advertising on every platform be identical. The relevant question is whether a VLOP provides the information and safeguards required by the DSA for its advertising arrangements.

5. Access for vetted researchers

VLOPs must provide relevant data access to vetted researchers under the DSA framework. The purpose is to allow independent scrutiny of issues such as systemic risks, platform design, content distribution and the effects of moderation or recommendation systems.

Research access is important because regulators and the public cannot evaluate a large platform solely from the outside. At the same time, access is structured: it is not a general right for anyone to obtain confidential commercial or personal data without safeguards.

6. An independent, properly resourced compliance function

VLOPs must maintain a compliance function with sufficient resources and direct access to the company’s management body. Its responsibilities include monitoring DSA compliance, overseeing systemic-risk reporting, supporting audits and following up on mitigation measures.

This requirement is intended to make DSA compliance an internal governance responsibility rather than an informal task handled only by a communications or moderation team. The platform must have an organisational structure capable of identifying risks, documenting decisions and reporting problems to senior management.

7. User reporting, reasons for restrictions and complaints

The broader DSA framework includes mechanisms for users to report potentially illegal content and requires platforms to provide explanations when they remove or otherwise restrict content. These procedures are separate from the VLOP threshold, but VLOPs must operate within the wider framework as well as meet the additional top-tier obligations.

In practical terms, a user should not be left without an explanation when a platform takes an enforcement action affecting their content or account. The DSA also establishes avenues for challenging certain moderation decisions, although those mechanisms do not guarantee that disputed content will be restored.

Why adult-content platforms receive particular scrutiny

Adult-content services present a distinctive version of the risks that the DSA asks very large platforms to assess. The central concern is not only the legality of pornography involving adults. It is also whether minors can access or be exposed to pornographic material, whether illegal content is uploaded or circulated, and whether the platform’s systems adequately detect and respond to abuse.

On June 13, 2024, the Commission requested information from Pornhub, XVideos and Stripchat. The request covered measures related to:

  • the assessment and mitigation of risks involving minors;
  • illegal content;
  • gender-based violence;
  • age-assurance mechanisms; and
  • the organisation of internal DSA compliance.

The request for information was an investigative step, not a final finding that the companies had breached the law.

The Commission opened formal proceedings in 2025

On May 27, 2025, the Commission opened formal DSA proceedings against Pornhub, Stripchat, XNXX and XVideos. The proceedings focused on protection of minors, including suspected shortcomings in effective age-verification measures.

Formal proceedings mean that the Commission is investigating possible non-compliance. They do not, by themselves, prove an infringement or determine the eventual penalty. The companies have procedural rights during the investigation, and the Commission must assess the evidence before reaching a final decision.

What the March 2026 preliminary findings mean

On March 26, 2026, the Commission announced preliminary findings that Pornhub, Stripchat, XNXX and XVideos had breached the DSA by failing to protect minors from exposure to pornographic content.

This is a significant escalation, but the word “preliminary” is essential. According to the Commission’s announcement, the companies may inspect the investigation files and respond in writing. The March announcement is therefore not:

  • a final infringement decision;
  • a final court judgment;
  • a final remedial order; or
  • a final determination of the amount of any fine.

The appropriate description as of the dossier’s research cutoff, August 11, 2026, is that the Commission has announced preliminary breach findings and that the companies’ rights of defence remain in progress.

It would be inaccurate to say that the EU has already fined Pornhub and XVideos under the DSA unless and until a final decision establishing such a penalty is issued. It would also be inaccurate to treat the preliminary findings as though they had already been confirmed by a court.

Age verification does not automatically mean a government-ID requirement

The enforcement dispute has brought age assurance to the centre of the debate, but the DSA does not establish a blanket rule saying that every user must submit a government identity document to access online services.

On April 29, 2026, the Commission adopted a recommendation describing a common EU-wide approach to age-verification technologies. The approach is based on privacy-preserving concepts such as anonymous proof of age and includes data-protection safeguards. The Commission encouraged Member States to make robust, privacy-preserving age verification available by December 31, 2026.

This recommendation is relevant to the policy direction of travel, but it does not automatically resolve the proceedings against Pornhub or XVideos. The enforcement question is whether the platforms had effective measures under their existing DSA obligations. The recommendation sets out a developing common technical and policy approach; it is not itself a final ruling on the companies’ past compliance.

The distinction matters for users. An age-assurance system might establish that someone is over a particular age without disclosing their full identity or browsing history to an adult-content platform. Whether a particular system is sufficiently effective, private and legally compliant will depend on its design and implementation.

What “the same rules as social media” gets right—and wrong

For Pornhub and XVideos, the adult-content context makes several questions especially important:

  1. Can minors reliably be kept away from pornography? The answer depends on the effectiveness—not merely the existence—of age-assurance controls.
  2. How quickly and accurately is illegal material identified and removed? Large services need processes capable of handling substantial volumes of uploads, reports and appeals.
  3. How do recommendation systems affect exposure? A platform’s risk profile can be influenced by how it ranks, suggests or promotes material, not only by what users upload.
  4. Are moderation systems equipped for the EU’s languages and legal context? Transparency reporting includes information about moderation resources and language expertise for a reason.
  5. Can outside researchers meaningfully examine the risks? Data access is intended to improve independent scrutiny while preserving necessary privacy and security protections.

These questions illustrate why the EU’s approach is broader than a conventional content takedown law. It examines the platform’s systems and governance as well as individual items of content.

What happens next?

The next stage is procedural. Pornhub, XVideos and the other companies named in the March 2026 announcement may review the Commission’s evidence and submit written responses. The Commission will then consider those responses before deciding whether to adopt a final infringement decision or take another course.

Possible outcomes cannot be stated as settled facts at this stage. They could include additional findings, required changes to platform systems, commitments, or financial penalties if the legal and factual conditions for them are met. The March preliminary announcement alone does not establish which outcome will occur.

Meanwhile, the platforms remain subject to their continuing VLOP obligations. Their transparency reports, risk assessments, mitigation measures, advertising disclosures, researcher-access arrangements and internal compliance systems are part of an ongoing regulatory relationship with the EU—not merely responses to one investigation.

Does the EU require every user to submit a government ID to view adult content?
