Charro does not kill Emiliano in Netflix’s The Accident. Season 1 leaves Emiliano alive in prison while Charro threatens revenge; the complete two-season story shows Charro attacking Emiliano but failing. Emiliano survives and ultimately shoots Charro, who dies in the final confrontation.
Spoilers for both seasons follow. The answer depends on whether “the ending” means the Season 1 cliffhanger or the complete series now listed on Netflix.
Key takeaways
- Charro does not kill Emiliano in The Accident; Emiliano is alive at the end of both seasons.

- Emiliano receives a two-year prison sentence without bail for involuntary manslaughter after his negligence causes the children’s bouncy house to break loose.
- Netflix’s official title page lists two seasons, so the Season 1 cliffhanger is not the complete series ending.

| What is the ending’s scope? | A deliberate cliffhanger. | The revenge storyline reaches its violent resolution. |
What happens at the end of Season 1?
Season 1 ends before Charro can carry out the threatened killing. After Lupita frames Charro for Moncho’s murder, Charro is arrested. Charro then uses bribery to arrange a transfer to the same prison where Emiliano is being held. The setup makes an attack appear imminent, but the season closes with Emiliano still alive.
Emiliano’s prison sentence follows the original birthday-party tragedy in Santa Cruz, Mexico. A bouncy house carrying children is lifted by high winds because Emiliano, distracted by a business call, failed to secure it properly. Netflix’s account treats that negligence as the decisive cause while distinguishing the accident from an intentional killing in its official explanation of The Accident.
Rather than admit his responsibility, Emiliano pays Moncho, the family’s housekeeper, to accept the blame. Moncho is wrongly imprisoned, and Emiliano’s attempt to conceal a negligent act becomes the source of further injustice. Emiliano is eventually convicted of involuntary manslaughter and sentenced to two years in prison without bail.
Daniela eventually visits Emiliano, recognizes how grief and blame shaped her own actions, and reconciles with him. That emotional reconciliation does not remove the legal or moral consequences: Emiliano remains imprisoned, and Charro’s arrival creates the season’s final unresolved danger.

What changes in Season 2?
Season 2 premiered on December 10, 2025, one year after the tragedy. Netflix’s official announcement presents the continuation as a conflict between redemption and revenge and introduces Tamara “La Pantera,” a figure from Charro’s past. Netflix’s announcement says the story requires characters to choose “between redemption or revenge in order to move forward.”
Season 2 turns the Season 1 threat into direct violence. Charro attacks Emiliano during the prison storyline, but Emiliano survives. The final conflict later moves beyond the prison and brings Emiliano, Charro, Lupita, and other characters seeking revenge into the same confrontation.
According to secondary finale recaps from The Review Geek and Tonboriday, Emiliano shoots Charro during the final confrontation. Charro dies from the wound, while Emiliano remains alive. The scene therefore reverses the expectation established by Season 1: Charro is the aggressor for much of the revenge plot, but Emiliano is the person who delivers the fatal shot.
| Character | Action | Outcome |
|---|---|---|
| Emiliano | Negligently leaves the inflatable unsecured, hides his role, and later shoots Charro. | Convicted of involuntary manslaughter, imprisoned, and alive after killing Charro. |
| Charro | Seeks revenge for the loss surrounding Moncho, threatens Emiliano, and attacks him. | Survives Season 1 but dies after Emiliano shoots him in Season 2. |
| Lupita | Arranges Moncho’s killing through Barroso, kills Barroso with a poisoned apple, and frames Charro. | Becomes a central participant in the cycle of revenge. |
| Moncho | Accepts blame for Emiliano’s accident and is later targeted by Charro and Lupita’s plot. | Is fatally poisoned by Barroso on Lupita’s instructions. |
Who killed Moncho?
Lupita is responsible for Moncho’s final murder, not Charro. Lupita hires Eulogio “Barroso” to poison Moncho. Charro is guilty of brutal attempts to punish Moncho, including an earlier attack and an attempt to harm Moncho’s family, but Charro is not the person who administers the final poison.

Lupita later poisons Barroso with an apple and plants evidence that helps frame Charro for Moncho’s death. The plot deliberately separates the person seeking revenge from the person who commissions the killing. Charro’s arrest is consequently part of Lupita’s plan, not proof that Charro killed Moncho.
Why is Emiliano responsible for the original tragedy?
Emiliano is responsible because his inattention leaves the children’s bouncy house improperly secured, allowing high winds to lift it during the birthday party. The series does not present Emiliano as someone who deliberately set out to kill the children, but it does show that his negligence caused the accident and that his cover-up multiplied the damage.
The show’s central distinction is between an accident and responsibility for its consequences. Emiliano’s original act is negligent rather than an intentional murder. His decision to pay Moncho to accept blame, however, transforms a tragic mistake into a continuing chain of imprisonment, betrayal, murder, and revenge.
What happens to the amusement-park business deal?
The amusement-park project collapses. The accident and the public revelations damage the partnership, while archaeological artifacts discovered at the construction site halt development because construction cannot proceed there.

What does the ending mean?
The ending argues that revenge cannot restore what the characters have lost. Emiliano’s negligence begins the tragedy, but his concealment allows the consequences to spread. Charro’s grief becomes intimidation and attempted violence, while Lupita’s pursuit of control leads to murder and framing.
Season 1 asks whether Charro will become the final agent of violence by killing Emiliano. Season 2 answers with a reciprocal threat: Charro attacks Emiliano, but Emiliano ultimately kills Charro. Neither man receives a clean moral victory. Emiliano survives, but he remains responsible for the original tragedy and for the cover-up; Charro dies after allowing grief and revenge to define his actions.
This interpretation follows the documented outcomes rather than a quoted creator explanation. No on-record creator statement in the available research identifies Emiliano or Charro as the more morally culpable man. Netflix’s official framing of the second season instead emphasizes the opposing choices of redemption and revenge.

Is there a third-season ending to consider?
No third-season conclusion is supported by the supplied research. Netflix’s current title page lists two seasons, and the Season 2 finale is the latest documented resolution: Charro dies after Emiliano shoots him, while Emiliano survives.
Bottom line
Charro never kills Emiliano. In Season 1, Charro only threatens Emiliano after arranging to enter the same prison. In Season 2, Charro attacks Emiliano but fails, and Emiliano ultimately shoots Charro. Lupita is the person who arranges Moncho’s murder, while Emiliano is punished for the negligent bouncy-house accident and its concealment.
