Netflix’s Menendez Doc Director Says Erik Avoided Discussing a Retrial to Avoid False Hope

Netflix documentary director Alejandro Hartmann said Erik Menendez avoided discussing a retrial in 2024 to avoid false expectations. The brothers’ parole status later changed, with a March 2027 hearing tentatively reported.

In a 2024 interview about Netflix’s The Menendez Brothers, director Alejandro Hartmann said Erik Menendez did not want to discuss the possibility of a retrial because he did not want to create “false expectations.” That comment reflected the brothers’ situation at the time—not their current parole status: both were denied parole in 2025, and the Associated Press reported in September 2026 that their next hearing was tentatively moved to March 2027.

What the director said about a possible retrial

Hartmann’s explanation was specific: “Erik didn’t want to talk about that because he doesn’t want to have false expectations,” the director told People in an exclusive interview published October 4, 2024. The subject was the possibility of a retrial. The headline’s broader phrase “possibility of freedom” should not be read as a statement that Erik was discussing every possible route to release.

Hartmann was describing his own conversations with the brothers, not making an independent finding about their legal prospects or their private motives. The remark belongs to the period when he was making the documentary and should be understood in that interview-era context.

How Hartmann spoke with Lyle and Erik for the film

People reported that Hartmann’s conversations with Lyle and Erik began in 2022 and continued over five months. The article said the director recorded more than 20 hours of phone conversations with them from prison. These are figures reported by People, not independently audited production statistics.

According to Hartmann’s account in the interview, Erik initially did not want to participate, while Lyle agreed to speak with the director. Lyle later encouraged Erik to talk. Hartmann said the early exchanges began informally and developed into interviews. The director also described differences in how the brothers spoke and discussed difficult subjects; those descriptions are his impressions rather than independently established assessments of their personalities.

What the documentary covers

The Menendez Brothers is a documentary directed by Hartmann that premiered on Netflix on October 7, 2024. Netflix says it draws on extensive audio interviews with Lyle and Erik, trial lawyers, journalists, jurors, family members and other observers. The brothers speak about the crime and the trials that followed.

The film includes the brothers’ accounts of their family history and their descriptions of the crime. Those are accounts presented in the documentary, not a basis for treating disputed allegations as independently established fact.

What changed after the 2024 interview

The parole picture changed after Hartmann’s interview. The Associated Press reported that a Los Angeles judge resentenced the brothers in May 2025 to 50 years to life, making them eligible for parole. Both were denied parole at hearings in August 2025, as reported by Netflix Tudum.

In a September 8, 2026 report, the Associated Press said the brothers were eligible for another parole hearing in March 2027, about 17 months earlier than expected, after petitions for earlier hearings were granted. AP described the revised timing as tentative. A hearing date is not a release date, and the cited reports do not guarantee that a future hearing will result in release.
