DNA recovered from beneath Mindy Morgenstern’s fingernails matched Moe Gibbs. According to Oxygen’s 2026 account of Dateline’s reporting, that profile also matched evidence from an unsolved Fargo-area rape investigation, helping investigators focus on Gibbs. The North Dakota Supreme Court’s 2009 opinion confirms the fingernail DNA evidence and the later conviction, while the specific account of the database match comes from Oxygen’s report.
What happened to Mindy Morgenstern?
Morgenstern was a Valley City State University student. On September 13, 2006, she was found dead inside the front door of her off-campus apartment. The North Dakota Supreme Court opinion says there were no signs of forced entry and no known witnesses.
She was last seen on campus, logging off a school computer at 12:23 p.m. A friend called her at 12:47 p.m. and got no answer. Investigators believed the killing occurred between about 12:45 and 1:30 p.m.; that was an estimated window, not an established exact time. The court records that she had been strangled and suffered a slit throat, but those details are not necessary to understand how the investigation developed.
What evidence linked Moe Gibbs to the killing?
DNA beneath Morgenstern’s fingernails
The most significant forensic link described in the court opinion came from scrapings and clippings of Morgenstern’s left-hand fingernails. Testing of the clippings found 41.2 nanograms of DNA: 30.8 nanograms matched Gibbs’s profile, and the remainder matched Morgenstern’s. The scrapings showed a two-to-one ratio of Gibbs DNA to Morgenstern DNA.

At trial, state evidence characterized the quantity of Gibbs’s DNA beneath her nails as consistent with fairly vigorous physical contact, such as a struggle or an athletic event, rather than secondary transfer. The opinion also describes an injury on each of Gibbs’s hands that was considered consistent with fingernail scratches. Those were interpretations presented in the trial evidence, not a claim that DNA alone established what happened.
Other samples did not all point to Gibbs
The test results were not uniformly incriminating. DNA on the knives excluded Gibbs, as did DNA from rubber gloves found in the apartment and mitochondrial DNA from a hair in Morgenstern’s hand. A spot on her shirt did not exclude him as a contributor, which is different from a finding that it definitively came from him.

The defense argued that the small amount of DNA could have reached Morgenstern through secondary transfer. The state’s interpretation of the fingernail evidence and the defense’s alternative explanation were matters for the jury to weigh alongside the other circumstantial evidence.
How did the Fargo-area case help investigators identify Gibbs?
Oxygen’s January 28, 2026 Dateline report says investigators entered the fingernail DNA profile into a federal criminal database, where it matched evidence from a separate, unsolved Fargo-area rape. According to that account, the survivor’s description of her attacker and the fact that Gibbs lived in the same apartment complex as Morgenstern helped direct investigators’ attention toward him.

Oxygen also reports that Gibbs had provided a statement and DNA early in the murder investigation, and that his DNA matched evidence from the scene. The court opinion independently records that Gibbs lived in the complex and that an interview on September 20, 2006, ended with his arrest. It does not narrate the database match and Fargo case in the same detail, so that connection should be understood as Oxygen’s reporting rather than as a finding stated in the court’s opinion.

The conviction rested on circumstantial evidence described in the court opinion, including the fingernail DNA, the injuries to Gibbs’s hands, a shirt stain that did not exclude him, his residence in the same complex, and phone and computer activity that stopped during the state’s estimated time of the killing. No single item should be mistaken for the entire case.
The North Dakota Supreme Court affirmed the judgment
Gibbs appealed, raising issues that included defense expert funding, prosecutorial remarks, the handling of a videotaped interview, and whether the evidence was sufficient to support the verdict. In its April 2, 2009 opinion, the North Dakota Supreme Court affirmed the judgment. On the sufficiency question, the court considered the evidence and reasonable inferences in the light most favorable to the verdict—a deferential standard that asks whether the jury’s finding had adequate support, not whether the appellate court would decide the facts anew.

Justice Crothers wrote for the court: “Under our deferential standard of review of claims about sufficiency of the evidence, we conclude sufficient circumstantial evidence existed for the jury to find Gibbs guilty of murder.”
