On January 1, 2024, the 1928 Steamboat Willie work entered the public domain in the United States. That change made its early Mickey Mouse depiction available to use under U.S. copyright law—not every later Mickey design, Disney work, or use of Disney branding. In the days that followed, reports described two horror-film projects drawing on the character.
What entered the public domain—and where?
The change applies to the 1928 work and its early depiction of Mickey, not to Mickey Mouse in every form. Later designs and other separately protected expression do not become free to copy just because the original work’s copyright term ended. Duke University’s Center for the Study of the Public Domain explains that its analysis concerns U.S. law; copyright status can differ in other countries. Duke’s 2024 Public Domain Day analysis and an NYU Journal of Intellectual Property & Entertainment Law article discuss the territorial nature of copyright.
In the United States, material that has entered the public domain cannot be reclaimed as private copyright property. But copyright is only one part of the picture: later expressive additions and trademarks can still matter, particularly if a new work could suggest Disney sponsorship or approval. The American Bar Association’s discussion of Steamboat Willie and Mickey Mouse explains why later designs and trademark concerns remain relevant.
Which Mickey Mouse horror films were announced?
Early-January 2024 coverage described two separate projects. Those reports establish announcements, including a trailer for one project and a proposed premise for the other; they do not establish either film’s current release or distribution status.

The Associated Press also reported the two projects and stressed that the copyright change made only the initial versions of Mickey and Minnie available. Associated Press coverage provides that announcement-era context.
Can anyone make a Steamboat Willie movie?
In the United States, creators can use the 1928 work and its early depiction as public-domain material. That is not a blanket license to reproduce later Mickey designs, use unrelated Disney material, or market a film in a way that falsely suggests Disney made or endorsed it. A project should be evaluated based on the specific material it uses and how it is presented to audiences.

The Washington Post reported Disney’s statement that consumer associations with its stories and products would remain important: “That will not change when the copyright in the ‘Steamboat Willie’ film expires.” That statement does not undo the work’s U.S. public-domain status; it underscores why copyright and branding are distinct considerations.

The January 2024 stories are evidence of the projects being announced at that time, including a trailer for Mickey’s Mouse Trap and a proposed concept for LaMorte’s project. They do not establish that either film was completed, released, available to stream, or issued on physical media. Nor does the U.S. copyright date determine the status of the work in every country.
