The allegation was Madsen’s account, not a finding established by the filing or by the reporting. The Associated Press later reported that he asked for the divorce filing to be dismissed.
What Michael Madsen alleged in the divorce filing
The Los Angeles Times reported that Madsen filed for divorce in Los Angeles County Superior Court in September 2024, citing irreconcilable differences. In a signed statement attached to the petition, he wrote: “I have been separated from Respondent since my son’s death by suicide on 1/25/22. I believe Respondent drove him to this by her neglect, drinking and alcoholism.”
The wording matters: the petition’s stated ground was irreconcilable differences, while the attached statement set out Madsen’s personal allegation about the marriage and his son’s death. It does not establish that allegation as fact. The Los Angeles Times reported that Hudson Madsen died by suicide on January 25, 2022, and that Madsen said he had been separated from DeAnna since then. Los Angeles Times
What DeAnna Madsen said
The Los Angeles Times reported that DeAnna Madsen disputed a separate allegation that she broke into the family home. It quoted her as saying that she and the children “have been supporting him to the best of our ability.” That response concerned the separate home-related allegation; it does not resolve the accusation in Michael Madsen’s divorce statement.

Madsen’s attorney, Perry C. Wander, told the Los Angeles Times: “Michael is looking forward to spending quality time with his children and pursuing acting and writing poetry … now that he is free from a toxic, abusive marriage.” That was Wander’s characterization, not a court finding. The Los Angeles Times also reported that prosecutors declined to file charges against Madsen after his August 2024 arrest, citing insufficient evidence. The decision on that separate matter did not adjudicate the divorce petition’s allegations. Los Angeles Times

The initial petition should not be described as still pending. Weeks after filing it, Madsen asked for the divorce filing to be dismissed, according to the Associated Press. That later procedural step changed the status of the filing; it did not turn the accusations in the attached statement into established facts. Associated Press
