The Menendez brothers’ resentencing is over. In May 2025, Los Angeles County Superior Court Judge Michael Jesic resentenced Erik and Lyle Menendez to 50 years to life, making them eligible for parole consideration. The next expected step is a parole suitability hearing—not another resentencing—and a hearing or parole grant would not, by itself, guarantee release.
Why the December hearing date is no longer current
The December date in the earlier headline referred to a resentencing hearing originally scheduled for December 11, 2024. That date was superseded by later proceedings: Judge Michael Jesic resentenced the brothers in May 2025. The Los Angeles County District Attorney’s Office announced the new 50-years-to-life sentences.
That sentence change opened the way for parole consideration, but it did not order the brothers’ immediate release. The California Department of Corrections and Rehabilitation (CDCR) must process the amended judgment and determine the applicable parole eligibility.
What happens at a parole suitability hearing
A suitability hearing is a decision about whether a person can safely be released under the applicable risk assessment. It is not a new trial, and it does not reopen the question of guilt. The California Board of Parole Hearings (BPH) describes the central question as whether an incarcerated person currently poses an unreasonable risk of danger to society if released.

What the panel considers
CDCR’s Board of Parole Hearings media FAQ says panels may consider criminal history; self-control at the time of the offense; programming and institutional conduct; evidence of personal change; release plans; and relevant youth- or elderly-offender factors. The panel evaluates the individual case rather than deciding release solely from the sentence or the fact that parole eligibility has been reached.
What a decision means
If a panel denies parole, the person remains incarcerated; the hearing does not itself change the underlying conviction or sentence. If a panel grants parole, the grant is not automatically final: BPH says it is subject to review by the Board’s Legal Division and the Governor’s Office. A grant therefore should not be treated as a confirmed release date.

When are the next parole hearings?
Associated Press reported in 2026 that the brothers’ next parole hearings had been tentatively moved to March 2027 from August 2028 after the parole board granted requests to advance them. March 2027 is a reported timeframe, not a confirmed date for both individual hearings. The individual entries were not independently established in the available official-calendar information.
BPH says its hearing schedules are updated weekly. Check the live California Board of Parole Hearings calendar for Erik and Lyle separately: dates can change, and their proceedings need not have identical dates or outcomes. BPH also describes an administrative process for advancing a future suitability hearing in specified circumstances.

What to watch for next
- Eligibility processing: CDCR’s processing of the amended judgment determines the applicable parole eligibility.
- Separate hearing notices: Look for each brother’s individual date on the BPH calendar rather than assuming a shared appointment.
- Panel decisions and review: A denial or grant, any stated denial period, and any subsequent review are separate developments. A hearing date alone does not establish the result.
