Kerala High Court Denied Actor Siddique Anticipatory Bail in 2016 Case; Supreme Court Later Granted Conditional Bail

The Kerala High Court refused Siddique anticipatory bail in September 2024 in a case over an alleged 2016 incident. The Supreme Court later directed conditional bail, without deciding guilt.

The Kerala High Court denied actor Siddique anticipatory bail on 24 September 2024 in a case concerning an allegation of rape in 2016. The Supreme Court later allowed his appeal and directed conditional anticipatory bail on 19 November 2024. Neither bail order determined whether the allegation was true or whether Siddique was guilty.

What is the case about?

The Supreme Court’s judgment identifies the case as Crime No. 1192 of 2024, registered at Museum Police Station in Thiruvananthapuram on 27 August 2024 under Sections 376 and 506 of the Indian Penal Code. The alleged incident was said to have taken place in 2016. The allegation is disputed; the bail proceedings were not a trial on the merits.

The complainant’s identity is not needed to explain the court rulings and is not included here.

Why did the Kerala High Court deny anticipatory bail?

In its 24 September 2024 order, the Kerala High Court dismissed Siddique’s Bail Application No. 7331 of 2024. It cited the seriousness of the accusations, material it considered relevant at the preliminary stage, and the investigation’s early stage and needs. The prosecution argued that custodial interrogation was necessary; the court also referred to concerns about possible witness intimidation or evidence tampering.

The High Court did not treat the time between the alleged incident and the complaint as a reason to dispose of the matter at the bail stage. It said the explanation for the delay should be evaluated after trial. Its observations addressed the request for pre-arrest protection, not a final determination of guilt.

In addressing arguments about the complainant’s character, the High Court wrote: “The attempt to blame a woman for speaking out may be a strategy to silence her, which is hostile to the supremacy of the law.” That was the High Court’s statement in the context of those arguments, not a finding by the Supreme Court.

Did the Supreme Court later grant Siddique bail?

Yes. On 19 November 2024, the Supreme Court allowed Siddique’s appeal and directed that if he was arrested in this FIR, he be released on bail subject to conditions imposed by the trial court. The stated conditions included depositing his passport and cooperating with the investigating officer. The Court said breach of bail conditions could lead to cancellation.

The Supreme Court noted the nearly eight-year interval between the alleged incident and the complaint. It also referred to a Facebook post around 2018 that, according to the judgment, made allegations concerning about 14 people including Siddique, and to the complainant not having approached the Justice Hema Committee. The Court said it would not give elaborate reasons, “particularly considering the sensitivity of the case.” Those limited observations should not be read as a finding that the allegation was false.

What is known about the case’s later status?

The Supreme Court’s 19 November 2024 direction establishes the bail outcome described here. It does not establish what happened later in the investigation or whether a charge-sheet, trial, or subsequent bail variation followed. A current official court docket or police or court record is needed to confirm developments after the orders.
