Start with the actor, not the label. The First Amendment ordinarily restricts government—federal, state, and local—not private people or companies acting on their own. The threshold question is whether the specific decision that restricted speech is fairly attributable to government. A public-facing service, government funding, regulation, contract, or an official’s job title does not by itself answer that question.
If government itself made the decision, the state-action threshold is usually satisfied and the analysis moves to the applicable First Amendment rule. If a private entity acted, state action exists only through limited, fact-specific routes such as a traditionally exclusive public function, government compulsion, or joint action. A separate rule applies to a public official’s social-media account: under Lindke v. Freed, the official must have had actual authority to speak for the State on the relevant matter and must have purported to use that authority in the challenged activity.
What the state-action question asks
“State action” is the constitutional-law term for conduct treated as governmental for First Amendment purposes. It is a threshold inquiry. It does not decide whether the restriction is constitutional, what forum rules apply, or what remedy a claimant can obtain.
Describe the challenged conduct precisely before applying any test. “They censored me” is too general. The relevant act might be a city employee deleting one comment, a public office blocking an account, a private platform removing a post, a venue refusing to host a speaker, or a government agency directing a contractor to exclude someone. The same person or organization may perform several acts in different capacities, and each act may require a separate analysis.

The Supreme Court stated the baseline in Manhattan Community Access Corp. v. Halleck (June 17, 2019): “The Free Speech Clause of the First Amendment prohibits only governmental, not private, abridgment of speech.” That principle makes private conduct the default, while recognizing narrow exceptions.
When government itself acts
If a federal, state, county, municipal, or other governmental body made the challenged decision, the state-action threshold is generally met. The difficult question then changes: which substantive First Amendment doctrine governs the restriction?
For example, a government office deleting comments from an account it operates may raise forum-classification and viewpoint-discrimination issues. A public school disciplining a student may involve school-speech doctrine. A licensing agency denying a permit may involve prior-restraint or content-neutrality rules. Government may also be speaking for itself rather than regulating private speech, which can change the analysis. Those are merits questions after the government-actor threshold, not substitutes for identifying who acted.
Government employment alone is not a complete shortcut. An employee may post or act personally, outside delegated authority. Conversely, a person without a prominent title may exercise official authority in a particular decision. The conduct and source of authority matter more than the label attached to the person.

When a private actor can be treated as a state actor
Private conduct does not become governmental merely because the entity serves the public, receives public money, operates under a license, performs a useful service, or has a government contract. Halleck identifies limited routes for attributing private conduct to government. Each asks about the specific function and decision challenged.
Traditional, exclusive public function
The function must be one that government has traditionally and exclusively performed. “Public” in the everyday sense is not enough. Nor is it enough that government sometimes performs the activity, that the activity is heavily regulated, or that the service affects the public.
The Supreme Court has treated running elections and operating a company town as examples of functions that can satisfy this demanding test. By contrast, supplying electricity, operating nursing homes, and providing special education have not qualified simply because government also performs or regulates those activities. The definition of the function must be precise: operating a particular public-access channel, for example, is not the same as exercising a general governmental power.
In Halleck, a private nonprofit operated public-access television channels under a municipal arrangement. The Court rejected the argument that hosting public speech alone made the nonprofit a state actor. Operating the channels was not a function traditionally and exclusively reserved to government.

Government compulsion
Compulsion asks whether government required the private entity to take the particular action being challenged. A general regulatory scheme, inspection program, tax benefit, or funding condition is not automatically proof that government compelled the specific speech restriction.
Identify the actual command: a statute, regulation, order, contract term, official instruction, or other directive. Then connect it to the decision at issue. If a regulator required a private operator to remove a particular category of speech, the directive may be relevant. If the operator independently chose the policy while government merely supervised the industry, the compulsion route is much weaker.
Courts examine the wording, legal force, and practical operation of the alleged directive. “Government knew about it” and “government could have regulated it” are different from “government required it.”
Joint action or concerted participation
Joint action asks whether government participated with the private entity in the challenged conduct. The question is not whether the entities had a relationship in the background, but whether they acted together in making or carrying out the particular decision.

A private company’s ordinary performance of a contract, without joint participation in the disputed act, does not automatically establish state action.
A private party carrying out a governmental constitutional obligation
The Court also discusses situations in which a private party performs an obligation that the Constitution places on government, citing West v. Atkins. This is a case-specific application of state-action principles, not a rule that every government contractor is a state actor.
Ask what constitutional duty government owed, what function the private party actually performed, and whether the challenged conduct was part of carrying out that duty. A contractor’s status, standing alone, does not answer those questions.
Why a public-facing forum is not automatically governmental
A venue can invite the public to speak without becoming a government actor. The public-forum doctrine governs restrictions imposed by government in forums subject to First Amendment rules; it does not convert every private forum into a constitutional forum.

A private theater, website, broadcaster, or meeting hall may choose speakers under its own editorial, contractual, or property interests unless a separate legal rule supplies state action. In Halleck, the Supreme Court specifically held that “merely hosting speech by others is not a traditional, exclusive public function and does not alone transform private entities into state actors subject to First Amendment constraints.”
Accordingly, “everyone can post here,” “the service is open to the public,” and “the venue discusses public issues” describe access, not governmental status. The analysis still returns to the actor, the function, the source of authority, and the government’s role in the challenged decision.
Public officials and social media: the Lindke two-part test
Lindke v. Freed, decided March 15, 2024, supplies the current Supreme Court test for a public official’s social-media activity under 42 U.S.C. § 1983. State action exists only if both conditions are met:
- Actual authority: the official possessed actual authority to speak on the State’s behalf on the particular matter.
- Purported exercise: the official purported to exercise that authority in the relevant social-media activity.
Authority must come from written law or longstanding custom. A government job title, government-related subject, or apparent usefulness of an account is not enough by itself. The second condition asks how the official presented and used the account in the challenged activity.
Do these 3 things before closing this tab:
1Clear out junk files and repair common Windows errors2Fix the driver behind crashes, sound loss and screen glitches3Repair Windows errors before they cause bigger problemsFinding actual authority
Look for statutes, ordinances, regulations, formal delegation, agency rules, job duties, or an established governmental practice assigning the official power to speak for the State on that subject. Authority must match the matter at issue. An official authorized to announce emergency information may not automatically have authority to speak for the government about a separate policy dispute.
Finding a purported exercise of authority
Examine the account’s presentation and operation. Relevant facts can include how the page identifies the office, whether it uses government contact information or insignia, whether posts issue directives or official announcements, how the account is used in practice, and whether the challenged moderation occurred as part of that official activity.
These appearance factors are evidence of purported exercise; they do not replace the requirement of actual authority. A personal account may discuss public business without becoming official, while an account with mixed personal and official content may require post-by-post analysis.
Applying Lindke to a mixed-use page
Analyze the challenged post, reply, block, or deletion rather than classifying the entire account in one word. Ask:

- What subject was involved?
- What written law or longstanding custom gave the official authority, if any, to speak for the State on that subject?
- How did the official identify and operate the account?
- Was the moderation tied to an official announcement or governmental interaction, or was it part of personal communication?
An employee’s government status alone does not make a personal post governmental. Conversely, calling a page “personal” does not settle the issue if the official actually possessed and purported to use governmental speaking authority.
A practical decision procedure
Use this sequence before arguing about viewpoint discrimination, public forums, or remedies.
- State the act in one sentence. For example: “A county employee blocked an account from replying to a post on the county’s information page.”
- Name the decision-maker. Identify the person, agency, nonprofit, platform, employer, or contractor that chose the restriction.
- Separate acts by the same actor. A public employee’s official announcement, personal comment, and employment decision may have different constitutional character.
- If government acted directly, move to the merits. Determine the governing First Amendment rule for the forum, speech, and restriction.
- If a private entity acted, test public function. Define the exact function and ask whether government traditionally and exclusively performed it.
- Test compulsion. Find the specific legal requirement or directive and connect it to the challenged action.
- Test joint action. Identify concrete government participation in making or carrying out the decision.
- Check for a governmental constitutional obligation. If a private party performed a duty owed by government, analyze that relationship under the facts rather than assuming contractor status is enough.
- For an official’s social-media activity, apply both Lindke elements. Establish actual authority and purported exercise of that authority.
- Only then analyze the substantive claim and remedy. State action, a First Amendment violation, and an available cause of action are separate questions.
Comparison table for mixed government-private disputes
| Challenged action | Decision-maker | State-action inquiry | What must be shown next |
|---|---|---|---|
| Agency deletes speech from an account it operates | Government office or official acting for it | Threshold generally satisfied | Apply the relevant forum, speech, and restriction rules |
| Private platform removes a user post under its own policy | Private company | Public function, compulsion, joint action, or a comparable specific basis must be established | Identify the precise governmental connection to that removal |
| Private venue refuses a speaker | Private owner or operator | Public access alone is insufficient | Look for a traditionally exclusive governmental function or concrete government participation |
| Government tells a contractor to exclude a speaker | Contractor, with an alleged government directive | Analyze whether the government compelled the particular exclusion | Read the statute, contract, order, or instruction and connect it to the act |
| Private entity and agency jointly design and enforce a restriction | Both private and governmental participants | Potential joint action | Prove coordinated participation in the challenged decision |
| Official blocks a user from a mixed-use social-media page | Public official | Apply Lindke: actual authority plus purported exercise | Identify the legal or customary authority and the account’s official presentation and use |
Common analytical mistakes
“It serves the public, so it is government”
Public benefit, popularity, or open access does not satisfy the exclusive-public-function test. Define the function and its historical allocation first.
“Government money makes the conduct state action”
Funding may matter to the factual relationship, but it does not by itself prove that government made, compelled, or jointly carried out the restriction.
“A government contract makes the contractor a state actor”
Contracts can contain relevant directives, but contractor status alone is not dispositive. Examine the specific duty and decision.
“Regulation equals compulsion”
Oversight and regulation leave many private choices intact. The compulsion inquiry requires evidence that government required the particular action.
“A page title settles an official’s social-media status”
Under Lindke, a title, seal, or government-related content cannot substitute for actual authority to speak for the State on the matter at issue.
“State action proves a First Amendment violation”
It does not. After state action is established, the claimant still must identify the applicable doctrine and show why the restriction fails it. Forum classification, viewpoint, content neutrality, government speech, and other rules can change the result.

Facts and documents that usually matter
A careful record is more useful than a general description of the relationship. Preserve:
- The exact post, comment, account, policy, notice, or decision that restricted speech.
- Dates, screenshots, URLs or account identifiers, and the sequence of events.
- The decision-maker’s role and the capacity in which the person acted.
- Statutes, ordinances, regulations, job descriptions, delegations, and longstanding practices bearing on authority.
- Contracts, grant terms, directives, emails, meeting records, or instructions allegedly requiring the restriction.
- Evidence of coordinated planning or participation by government and a private entity.
- How an account identifies itself, what official functions it performs, and whether it mixes personal and governmental activity.
For a social-media dispute, preserve the page’s presentation at the time of the challenged action. Accounts change, posts are edited, and moderation tools may erase evidence of who acted and why.
State action is separate from remedy and cause of action
Even when conduct is fairly attributable to government, a claimant must identify the legal vehicle for relief. Section 1983, for example, has its own requirements, including conduct under color of state law and a deprivation of a federal right. Immunity, standing, jurisdiction, exhaustion, and available remedies may affect a case without changing the state-action analysis.
Likewise, finding no state action does not necessarily mean every claim disappears. Contract, employment, anti-discrimination, property, consumer-protection, or other statutes may apply to private conduct, depending on the jurisdiction and facts. The First Amendment threshold answers only whether constitutional restrictions on government conduct attach to the challenged act.

Manhattan Community Access Corp. v. Halleck (2019)
Halleck states the government-only baseline, explains the limited private-actor routes, and rejects the claim that operating a public-access speech forum is itself a traditionally exclusive governmental function. Its reasoning is especially important when a private organization hosts public discussion under a public-facing arrangement.
Lindke v. Freed (2024)
Lindke supplies the two-part rule for a public official’s social-media activity under §1983: actual authority to speak on the State’s behalf on the particular matter, plus a purported exercise of that authority in the relevant activity. The opinion directs attention to written law or longstanding custom and treats the page’s appearance and use as relevant evidence, not conclusive labels.
Constitution Annotated context
The Congressional Research Service’s State Action Doctrine and Free Speech discussion places Halleck and related precedents, including Lebron, in doctrinal context. Specific outcomes can still depend on the jurisdiction, procedural posture, governing law, and the complete factual record.
A concise checklist before asserting a First Amendment claim
- Who made the decision?
- What precise act restricted speech?
- Was the actor government, private, or mixed?
- If private, what exact function was performed, and was it traditionally and exclusively governmental?
- Did government compel the particular action?
- Did government participate jointly in the decision?
- Is public access or public funding being mistaken for state action?
- If an official used social media, was there actual authority to speak for the State on that matter?
- Did the official purport to exercise that authority in the challenged activity?
- If state action exists, which separate First Amendment rule governs the restriction, and what remedy or cause of action is available?
The reliable way to tell whether a First Amendment right applies is therefore factual and sequential: identify the actor and act, trace any governmental authority or participation, apply the narrow private-actor tests or the Lindke framework where appropriate, and only then analyze the substantive constitutional rule.
