You can start a production company without owning a camera package or renting an office. Begin by deciding what the company will make and who will pay for it, then test demand and map the costs before taking on fixed expenses. From there, choose a location and legal structure, register and set up the business, and build the rights, staffing, and project systems needed to deliver work. The details vary by state and locality, production type, and whether a project uses union performers.
1. Choose what the company will do—and who will pay
“Production company” can describe several different businesses. Decide whether you will produce documentaries or narrative films, make commercials or branded videos, provide production services to outside clients, or combine these activities. Identify the likely customer or funding source for each kind of work.
Possible revenue models include commissioned work, service production, and projects the company develops and owns. Compare them by who pays, when cash arrives, who controls the finished work, how repeatable the work may be, how much capital is needed before revenue, and who bears the risk of an overrun. These are choices to validate, not a ranking with one best answer.
Write a short description of the offer and test it with prospective clients, collaborators, and local industry contacts. The SBA’s business-planning guidance treats planning as a way to assess an opportunity and explain a company’s strategy; the plan should fit the business rather than follow a one-size-fits-all template.

2. Research demand and estimate startup costs
Before committing to rent, payroll, or equipment, make a practical estimate of what it will take to find and deliver the first jobs or projects. List likely customers, competing providers, expected project cadence, and the revenue sources you can realistically pursue. Separate costs of winning work from costs of producing and delivering it.
- Operating costs: wages, rent, utilities, insurance, and government fees, among other expenses.
- Project costs: costs tied to a particular production, such as crew, locations, and other delivery needs.
- Timing: when deposits, client payments, financing, and production expenses are expected to occur.
The SBA notes that startup costs vary with business type and location. There is no reliable universal price for starting a production company: a lean service business and a company financing its own films have different needs, and expenses also vary by jurisdiction. Build a budget around your model, local costs, and first-project assumptions rather than relying on a generic figure.
3. Choose a location based on work and operating realities
Compare places where you might base the company by access to customers and collaborators, labor availability, rent and wages, taxes and fees, zoning, and the local permitting process. A location that is convenient for a shoot is not automatically the best place to register or run the business.
Location can affect taxes, regulations, and the government offices responsible for the business. It can also affect access to production support. For example, the California Film Commission’s production resources point producers to regional film offices for location searches and permit support. Check the relevant state, county, and city resources for the place you are considering, and verify any incentive program directly before counting on it.

4. Select a legal and tax structure with qualified advice
Consider sole proprietorship, partnership, limited liability company (LLC), and corporate options in light of who owns the company, how it may raise money, the tax treatment, personal-liability exposure, filing costs, and governance workload. There is no universally best entity for every production company.
The SBA explains that structure affects taxes, fundraising, paperwork, and personal liability. The IRS explains how entity form affects federal tax return treatment. State law and the company’s circumstances also matter, so discuss the choice with an attorney or tax professional familiar with the intended jurisdiction before filing.
5. Check the company name before using it
Check whether the name is available under the applicable state entity rules, whether a local assumed-name or “doing business as” (DBA) filing is needed, whether it conflicts with a trademark, and whether a suitable domain is available. These checks address different issues; availability as a business name does not by itself establish the right to use a name as a brand.
The SBA notes that DBA requirements vary by structure and jurisdiction and that a DBA does not override trademark law. Confirm requirements with the agencies that apply where the company will operate.

6. Register the business and organize its governance records
File formation or registration documents with the relevant jurisdiction when required, and retain copies with the company’s ownership and governance records. Depending on the entity, those records may include an operating agreement, bylaws, or other documents setting out authority and ownership arrangements.
Keep these records accessible and consistent with how the business actually operates. SAG-AFTRA’s theatrical signatory guidance asks for company formation documents and distinguishes documentation for corporations and LLCs. That requirement applies to its signatory process, not to every production company.
7. Set up tax IDs, bookkeeping, and business banking
Determine whether the company needs a federal employer identification number (EIN) and state tax IDs based on its structure, hiring, and tax obligations. The IRS startup checklist says an EIN is free when obtained directly from the IRS. Do not pay a third party simply to obtain one from the IRS.
Choose a bookkeeping process that records income, expenses, payroll obligations, and the company’s tax year. Keep company money separate from personal money: the SBA recommends opening a separate business bank account when you begin accepting or spending money as a business. Ask a tax professional which federal, state, and local filings apply.

8. Check permits, insurance, and workplace obligations for each operation
There is no single permit or insurance checklist that applies to every company or shoot. Ask the appropriate federal, state, county, and city agencies, the property owner, and the local film office about the company’s ordinary operations and the specifics of each production. Requirements and fees can depend on the activity, location, and type of property.
Insurance documentation is likewise jurisdiction- and activity-specific. For example, New York City’s Mayor’s Office of Media and Entertainment lists insurance requirements for many film-permit applications, including specific certificate details. Treat that as a New York City example, not a nationwide rule. Also identify the workplace and payroll obligations that apply to the people and locations involved in a particular job.

For every project, establish who owns or controls the script and underlying material, and document the permissions needed to produce and exploit the work. Depending on the project, the file may need rights assignments, work-for-hire agreements, releases, music and other third-party permissions, and distribution or licensing agreements. Get entertainment counsel for project-specific rights and contract questions; the documents required depend on the material and intended use.
Rights records are often described as “chain of title.” SAG-AFTRA’s theatrical signatory guidance identifies screenplay registration, assignments, and distribution or license agreements among the materials it reviews. That is a useful illustration of why rights documentation matters, although signatory review does not define every production’s legal needs.

10. Plan crew, budgets, and union compliance project by project
Prepare a realistic budget, schedule, cast and crew plan, and hiring process for each production. If you plan to hire SAG-AFTRA performers, identify the applicable agreement and contact the union early. Agreement eligibility and terms depend on the project; union paperwork is not a prerequisite for every production company or every production.
As described on SAG-AFTRA’s official pages accessed in 2026, its Theatrical Agreement applies to films shooting entirely in the United States with a total budget greater than $2,000,000 and films shooting outside the United States. Its Low Budget Agreement applies to films shooting entirely within the United States with a total budget less than $2,000,000. These are descriptions of those specific agreements, not universal definitions of union or non-union production. Confirm the current agreement and eligibility with SAG-AFTRA before hiring covered performers.
SAG-AFTRA’s signatory guidance requests advance applications and project materials that can include a line-item budget, cast list, script, and day-out-of-days schedule. Check the materials and timing for the specific agreement rather than assuming one process covers all projects.
11. Make a first-project plan and create a repeatable system
For the first project, connect the creative plan to the business and production decisions that make delivery possible. Before committing to production, account for secured rights, a finance plan, budget and schedule, locations, insurance, hiring, and the terms for delivery and distribution—or client delivery, for commissioned work.

This turns an initial project into useful operating experience without assuming that every production will follow the same model.
