How to Report Suspected Healthcare Fraud to the FDA, SEC, or HHS-OIG

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Choose the agency by the conduct involved: report FDA-regulated product problems or deceptive health claims to the FDA; Medicare, Medicaid, kickback, federal grant, contractor, beneficiary-identity, or listed quality-of-care misconduct to HHS-OIG; and possible securities-law violations by a healthcare company or issuer to the SEC. Preserve original records, build a dated factual timeline, submit through the agency’s official channel, and do not assume that anonymity, confidentiality, retaliation protection, whistleblower awards, or personal reimbursement work the same way at each agency.

Start with the conduct, not the company name

A single healthcare business can fall under more than one regulator. The deciding question is what allegedly happened and which legal or public program was affected.

Agency Primary jurisdiction Official submission channels Useful supporting material Confidentiality or anonymity rules established by the agency What the process is designed to do
FDA FDA-regulated products, deceptive disease-treatment claims, adverse events, quality defects, therapeutic failure and use errors FDA’s Report a Problem hub; MedWatch online reporting; Form FDA 3500 for health professionals; Form FDA 3500B for consumers and patients Product labels, advertisements, photographs, purchase records, medical records you may lawfully share, and a clear description of the event or defect The supplied FDA material does not establish a general anonymity promise. Use the reporting instructions for the specific form and avoid sending unnecessary personal information. Product-safety and compliance review, investigation and appropriate regulatory action
HHS-OIG False claims to Medicare or Medicaid, kickbacks or referral inducements, medical identity theft involving Medicare or Medicaid beneficiaries, HHS grant or contract fraud, HHS personnel, grantee or contractor misconduct, emergency-stabilization failures, and abuse or neglect in nursing homes and other long-term-care facilities HHS-OIG online complaint portal, including the healthcare-fraud and whistleblower-retaliation categories A narrative covering nature, scope, time frame and how you learned of the conduct; names and contact details; witnesses; emails, documents, billing records and photographs Complaints are Privacy Act records. Referrals to other offices are made on an official-need-to-know basis. Investigation and referral of suspected HHS program or administrative misconduct; it rarely provides individual refunds or other personal relief
SEC Possible federal securities-law violations involving a healthcare issuer, investment or securities transaction, including materially false disclosures, insider trading, market manipulation, fraudulent offerings and theft or misappropriation of investor funds SEC Tips, Complaints & Referrals online TCR portal; Form TCR by mail or fax Full names and contact details, a detailed account of what happened, who was involved, how, why and when, plus relevant documents Tips are confidential. Whistleblower submissions receive enhanced confidentiality protections. Anonymous submissions are allowed; an anonymous person seeking a whistleblower award must be represented by an attorney. Securities-law enforcement and, when the statutory requirements are met, consideration of a whistleblower award

These jurisdictions can overlap. For example, a false statement about a drug’s effectiveness may be a product issue for the FDA, while a company’s knowingly false statement about that same product in an investor filing may be a securities matter for the SEC. Describe each distinct theory rather than forcing every allegation into one report.

When the FDA is the right destination

Product safety, quality and deceptive health claims

Use the FDA’s Report a Problem hub for concerns involving FDA-regulated products. The scope includes foods, drugs, biologics, medical devices, blood products, vaccines, cosmetics, animal products, tobacco and radiation-emitting electronic products.

For human medical-product reactions, quality problems, therapeutic failure or use errors, MedWatch provides online reporting and two paper forms. Health professionals use Form FDA 3500; consumers and patients use Form FDA 3500B. Give the product’s exact name, lot or serial information when available, the date and setting of use, what went wrong, the outcome and any treatment received. Keep the original label, packaging, instructions and photographs.

The FDA describes a fraudulent product as one claiming to prevent, treat or cure disease without proof of safety and effectiveness. A social-media advertisement, website, sales call or package that makes such a claim belongs in the FDA product-reporting pathway when the underlying product is FDA-regulated. State the exact claim and preserve a screenshot or downloaded copy showing the date and seller.

FDA reports are not a general billing-fraud channel

A provider’s false Medicare claim, a kickback for patient referrals or misuse of a federal healthcare grant ordinarily belongs with HHS-OIG, not the FDA product form. Explain the product connection only when the allegation actually concerns the product, its labeling, its safety, its quality or its marketing claims.

Separate FDA grant allegations by intent and type

For suspected criminal fraud involving FDA grants, FDA directs reporters to the HHS-OIG Hotline. Noncriminal grant misuse and conflicts of interest should go to the FDA grants office. Include the grant number, recipient, spending records and the conduct that makes you believe the issue is criminal, administrative or a conflict, but do not label conduct “criminal” merely because it appears improper.

What a strong FDA submission explains

  • Which regulated product is involved and how you obtained or encountered it.
  • The exact claim, defect, reaction, failure or use error.
  • Dates, locations, lot, serial or package information and the people or businesses involved.
  • Whether anyone was injured, became ill or required treatment.
  • Original advertisements, labels, receipts, photographs, correspondence and other records.

FDA says, “Your report can save lives.” — FDA, Report a Problem to the FDA, page updated 2026. That statement reflects the public-health value of early product information; it is not a promise that every report will produce a public enforcement action or an individual remedy.

When HHS-OIG is the right destination

Medicare and Medicaid false claims

Use HHS-OIG for suspected false or fraudulent claims submitted to Medicare or Medicaid. Examples include billing for services never provided, materially misrepresenting the service delivered, or using a beneficiary’s information to obtain payment. Tie each suspected false claim to the program, patient or provider involved and explain how you know the claim was inaccurate.

Kickbacks, inducements and medical identity theft

HHS-OIG accepts allegations that someone offered or received a kickback or other inducement for referrals. It also covers medical identity theft involving Medicare or Medicaid beneficiaries. Identify the referral arrangement, payment or benefit, the people involved, the affected beneficiary and the claims or enrollment activity connected to it.

Grants, contracts and HHS personnel

The OIG complaint scope includes HHS grant or contract fraud and misconduct by HHS employees, grantees or contractors. Include the award or contract number, recipient, approving officials, invoices, deliverables, payment trail and the specific obligation you believe was violated.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Quality-of-care and facility allegations

The listed HHS-OIG matters include failure to evaluate and stabilize an emergency patient and abuse or neglect in nursing homes and other long-term-care facilities. Describe the patient’s condition, dates, facility, staff members, actions or omissions, witnesses and any resulting harm. For an immediate medical emergency, seek emergency care first; the complaint process is not a substitute for treatment.

What to prepare before submitting

HHS-OIG asks for a narrative explaining the nature, scope, time frame and how you learned of the conduct. Add addresses, telephone numbers, email addresses, corroborating witnesses and electronic evidence such as emails, documents, billing records or photographs. Organize the material so an investigator can understand the allegation without guessing which document supports which sentence.

HHS-OIG states, “HHS-OIG’s Hotline reviews and investigates thousands of complaints each year.” — U.S. Department of Health and Human Services Office of Inspector General, Before You Submit a Complaint, page reviewed 2026. “Thousands” is a qualitative description, not a precise annual count.

Understand the limits of an OIG complaint

HHS-OIG says it rarely intervenes in personal or civil grievances. A complaint can alert the government to suspected misconduct, but it is not a guaranteed route to a refund, benefit correction, private damages or another personal remedy. If you need those outcomes, pursue the separate administrative or judicial process that applies to your claim while preserving the OIG submission and its confirmation information.

When the SEC is the right destination

Healthcare fraud that affects investors or securities markets

Send a healthcare-company allegation to the SEC when the core misconduct may violate federal securities law. Relevant examples include materially false company or financial disclosures, insider trading, market manipulation, fraudulent securities offerings, and theft or misappropriation of investor funds.

A product complaint by itself is not a securities tip. It becomes potentially relevant to the SEC when, for example, executives allegedly concealed a material product problem from investors, misrepresented revenue or clinical results in a filing, traded while possessing material nonpublic information, or used investor money for an undisclosed purpose.

Submit through the TCR system

Use the SEC’s Tips, Complaints & Referrals online TCR portal. The SEC also accepts Form TCR by mail or fax. A useful submission gives the full names and contact details of the people and entities involved and answers five basic questions: what happened, who was involved, how it happened, why it violated securities law and when it occurred. Attach relevant documents and explain what each attachment shows.

The SEC says, “All tippers can use this webform to submit information, whether they elect whistleblower status or not.” — U.S. Securities and Exchange Commission, Welcome to Tips, Complaints, and Referrals, 2024. Sending information does not automatically make you a whistleblower or establish award eligibility.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Anonymity and possible awards

You may submit anonymously. If you want to remain anonymous while seeking a whistleblower award, you must be represented by an attorney. To preserve potential award eligibility, submit directly to the SEC through its portal or Form TCR even if you previously gave the information to another agency or to the media. Keep the SEC confirmation number and a complete copy of what you sent.

SEC tips are confidential, and whistleblower submissions receive enhanced confidentiality protections. Those protections do not authorize you to disclose another person’s private information unnecessarily, and they do not guarantee that the SEC will open an investigation, bring an action or pay an award.

Build a report investigators can use

  1. Classify the conduct. Decide whether the central issue is a regulated product, an HHS program or provider, or securities-market conduct. If separate conduct fits separate agencies, prepare separate, cross-referenced submissions.
  2. Preserve original records. Save invoices, claims, product labels, advertisements, emails, contracts, screenshots, photographs and financial records in their original form. Keep the original file and make a working copy for annotation. Record when and how you obtained each item.
  3. Create a dated chronology. List the first relevant event, each later transaction or communication, the people present, the location and the outcome. Use exact dates when known and identify estimates as estimates.
  4. Identify the actors and money flow. Give legal names, trading names, addresses, telephone numbers, email addresses, provider or facility identifiers, grant or contract numbers, claim numbers and payment destinations when lawfully available.
  5. Explain your knowledge. Distinguish what you personally observed, what a document shows and what someone else told you. Name witnesses and provide contact information where lawful and safe.
  6. Map each fact to jurisdiction. State why the allegation belongs with the selected agency: the product is FDA-regulated, the claim involved Medicare or Medicaid, the payment was a referral inducement, the grant or contract was an HHS award, or the conduct affected investors or a securities transaction.
  7. Submit through the official channel. Use the FDA reporting hub or MedWatch form, the HHS-OIG complaint portal, or the SEC TCR portal/Form TCR. Do not send sensitive material to an unverified intermediary.
  8. Keep a complete record. Save the submitted narrative, attachments, date, receipt or confirmation number and any follow-up correspondence. Do not alter the only copy of an original record after submission.

Confidentiality, anonymity and retaliation are different concepts

Confidentiality concerns how an agency handles information after receiving it. The SEC describes tips as confidential and gives whistleblower submissions enhanced confidentiality protections. HHS-OIG treats complaints as Privacy Act records and limits referrals to other offices to official need-to-know. Those statements do not create a universal rule for every FDA report.

Anonymity means the agency is not told your identity. The SEC permits anonymous submissions, but an anonymous person seeking a whistleblower award must use an attorney. An anonymous report may also limit an investigator’s ability to clarify facts. Do not assume that selecting an anonymous option at one agency carries over to another.

Retaliation is a separate issue from confidentiality. HHS-OIG’s portal includes a whistleblower-retaliation category. Describe the protected reporting activity, who took the retaliatory action, dates, witnesses and resulting harm. Keep employment, medical and financial records that document the change. The presence of a retaliation category is not a promise of a particular remedy.

Before naming a witness or attaching a patient record, consider whether disclosure is lawful and necessary. Redact unrelated personal information when the form permits it, but preserve an unredacted original securely in case an authorized investigator needs to verify it.

Common reporting scenarios

“Can I report a drug scam to the FDA?”

Yes, when the allegation concerns an FDA-regulated product marketed with unproven claims to prevent, treat or cure disease, or involves a reaction, quality defect, therapeutic failure or use error. Use Report a Problem or MedWatch and preserve the package, label, advertisement and purchase information. If the same company also misled investors in a filing, that separate securities allegation may warrant an SEC submission.

“Where do I report Medicare fraud?”

Use HHS-OIG for suspected false Medicare or Medicaid claims, beneficiary identity theft or referral kickbacks. Include the beneficiary or provider identifiers you may lawfully provide, claim dates, services billed, amounts, payment records and witnesses. An FDA report is appropriate only if a distinct product-safety or product-marketing issue is involved.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

“Should I report Medicare fraud to HHS-OIG or the FBI?”

For the Medicare or Medicaid allegations covered here, HHS-OIG is the identified federal complaint channel. Describe the facts fully and let the appropriate authorities determine referrals. Do not delay a report while trying to predict which investigative office may ultimately handle it.

“Can I report a healthcare company to the SEC?”

Yes, when the conduct may violate securities law—for example, materially false disclosures, insider trading, market manipulation, a fraudulent offering or misappropriation of investor funds. Use the TCR system or Form TCR and explain the connection between the healthcare conduct and an investment, issuer or securities transaction.

“What if I want a refund or correction?”

Regulatory complaints and personal remedies are different tracks. HHS-OIG specifically says it rarely intervenes in personal or civil grievances. Preserve the agency report, but separately pursue the administrative appeal, payer dispute, civil action or other remedy that governs your individual loss.

Errors that weaken otherwise credible complaints

  • Choosing the agency by brand or reputation. Route by product, federal program or securities conduct.
  • Sending a conclusion without a timeline. Replace “they committed fraud” with dated events, documents, amounts and people.
  • Editing originals. Keep untouched files and label any working copy.
  • Bundling unrelated allegations. Separate product safety, billing, grant and investor theories so each agency can assess its own jurisdiction.
  • Overstating certainty. Identify direct observations, documentary evidence and second-hand information separately.
  • Assuming a report guarantees action. Submission starts an agency process; it does not promise an investigation, enforcement case, award, confidentiality beyond stated rules or personal compensation.
  • Using an unofficial intermediary. Submit through the named government portal or form and retain the confirmation.
  • Ignoring retaliation or safety concerns. Document retaliation through the HHS-OIG category when applicable, and obtain urgent medical help before filing a complaint if someone is in immediate danger.

A final routing checklist

  • Is the central problem an FDA-regulated product, its safety, quality or disease-treatment claim? Start with the FDA.
  • Does it involve Medicare or Medicaid claims, kickbacks, beneficiary identity theft, HHS grants or contracts, HHS personnel or contractor misconduct, emergency stabilization, or long-term-care abuse or neglect? Start with HHS-OIG.
  • Does it involve an issuer, investment or securities transaction, such as false disclosures, insider trading, market manipulation, a fraudulent offering or investor-fund theft? Start with the SEC.
  • Have you preserved originals, built a dated chronology, identified witnesses and documented the money or claim trail?
  • Have you chosen the correct confidentiality or anonymity option without assuming another agency uses the same rule?
  • Have you saved the submission, receipt, confirmation number and follow-up record?

The most useful report is specific, chronological and tied to the agency’s jurisdiction. A product allegation goes to the FDA, federal healthcare-program and HHS administrative misconduct to HHS-OIG, and securities-law conduct to the SEC; overlapping facts can be reported separately with the distinctions made explicit.
