A defensible production separates four jobs: establish the film’s editorial purpose, clear each asset under the law that governs its use, obtain informed interview consent, and verify every consequential claim. U.S. fair use is a context-specific analysis under four statutory factors, not a documentary exemption; archive custody does not prove that footage is public domain; and a public profile does not eliminate privacy or personality-rights concerns.
Define the film before you chase footage
Write a one-sentence proposition describing what the documentary will test, explain or reveal. “A biography of X” is too broad to guide evidence. A proposition such as “How did the mayor’s housing policy change after the 2010 flood, and who benefited?” tells you which records, witnesses and counterarguments matter.
Set the jurisdiction and release plan
List every territory in which you expect to show the film, sell it, stream it or license clips. Copyright exceptions, privacy rules, publicity or personality rights and consent standards differ by country. The World Intellectual Property Organization (WIPO) warns that limitations and exceptions vary internationally and that their interpretation can be disputed. A use that appears defensible in the United States may require a licence or a different edit elsewhere.
Decide whether the first release is a U.S.-only festival run, a worldwide platform delivery or a staged rollout. Tell your clearance lawyer and insurer the real plan; a release limited to one territory, medium or term can have different risk and cost from an all-media, worldwide, perpetual grant.

Build a dated chronology
Create a timeline of events, decisions, public statements and source publications. For every entry, record the date, place, original document or recording, and what remains uncertain. Use contemporaneous primary records for pivotal events where possible, then use interviews to explain, contest or contextualize the record rather than replacing it.
Build a rights-and-evidence map
Make one row for every clip, still photograph, song, document, interview recording, graphic, screen capture and quotation. A spreadsheet or rights-management database should contain:
- an internal asset ID and precise description, including timecodes or page numbers;
- source, creator, commissioning party, current owner and chain of title when known;
- where and when you obtained it, and whether the source is an original, licensed copy or repost;
- intended use, duration, territory, media, language versions and promotional uses;
- licence terms, fee, expiration, credit, edit, music-replacement or approval requirements;
- the exception analysis if no licence is obtained;
- interview consent and release status, privacy or publicity concerns, and unresolved factual issues; and
- the person who approved the decision and the date of the last review.
This map is a practical production control, not a universal statutory form. Review it before picture lock, delivery, marketing and any change in territory or platform. Preserve permission emails, invoices, deeds, correspondence and the exact files you reviewed.
Can you make a documentary about a public figure without permission?
Often, yes, when the film uses lawfully obtained information and material under a valid licence or applicable exception. A subject’s permission is not a prerequisite to discussing public conduct, attending open proceedings or quoting facts that are not protected expression. That does not grant permission to copy creative works, reveal private facts, imply endorsement or make unsupported accusations.

Consider four separate questions for the person and for each asset:
- Copyright: Who owns the recording, photograph, article, music or document, and what right permits your reproduction?
- Privacy: Does the material disclose intimate or non-public information, and is publication justified by public interest under the governing law?
- Publicity or personality rights: Could the person’s name, image, voice or likeness be treated as an endorsement or commercial exploitation in a relevant jurisdiction?
- Defamation and editorial accuracy: Is a statement presented as fact, allegation, opinion or unresolved claim, and can you prove the context and truth or privilege that applies?
WIPO emphasizes that privacy is balanced against public interest and that recognizable people can retain privacy interests. A public figure may have less protection for genuinely public conduct, but status is never a complete defence. Obtain jurisdiction-specific advice for private facts, reconstructed scenes, advertising and international distribution.
How U.S. fair use works for documentary material
Section 107 of the U.S. Copyright Act identifies criticism, comment, news reporting, teaching, scholarship and research as examples of purposes that may qualify, then requires a case-by-case assessment. The statute says: “In determining whether the use made of a work in any particular case is a fair use the factors to be considered shall include—”. There is no safe number of seconds, no automatic rule for news footage and no blanket documentary exemption. Nonprofit status alone does not decide the result.
| Factor | Questions for your cut | Document in the file |
|---|---|---|
| Purpose and character | Does the film comment on, analyze, criticize or otherwise add meaning to the source, or merely substitute for it? Is the use commercial, educational, journalistic or mixed? | Explain the editorial point made by the exact excerpt, not just the film’s general topic. |
| Nature of the copyrighted work | Is the source factual and already published, or highly creative, unpublished and commercially valuable? | Identify the work’s genre, publication status and expressive choices. |
| Amount and substantiality | How much is used quantitatively, and did you take the “heart” of the work? Is every second, frame or line needed to make the point? | Record timecodes, alternate shorter edits and why the qualitative portion is necessary. |
| Effect on the potential market | Could your use replace a licence, viewing or sale of the original, or interfere with a likely licensing market? | Consider available licences, clip-market practice, your audience and the effect of the final context. |
These factors interact; a strong point on one does not cancel a serious problem on another. The Documentary Filmmakers’ Coalition’s 2005 statement describes fair use, where it applies, as “a right, not a mere privilege,” but that principle still requires a reasoned application to the particular excerpt. Have counsel review close calls and retain the written analysis for insurers, distributors and future editors.

A practical order for every unlicensed asset
- Identify the exact work, creator and likely rights holders; do not rely on a social-media upload or archive catalogue title alone.
- Ask whether a licence is available and commercially reasonable for the intended territory, term, media and marketing.
- If licensing is unavailable or disproportionate, analyze fair use or another exception under each governing jurisdiction.
- Try a narrower excerpt, a still instead of motion, a replacement recording, a commissioned graphic or an original narration that makes the point without copying the source.
- Assess remaining copyright, insurance, delivery and takedown risk; have counsel document the decision before lock.
Can I use news footage in my documentary?
Newsworthiness does not place a broadcast, wire-service video, reporter’s narration, still image or soundtrack in the public domain. The station, network, photographer, agency, production company or another party may own separate rights in the images, audio, script and music. Ask the rights holder for a licence that states the exact clip, territory, term, media, language, edits, captions, promotional use and required credit.
If you seek fair use in the United States, connect the excerpt to a specific act of criticism, comment or reporting. Showing a long, uninterrupted report merely to convey an event is harder to defend than showing a short portion while analyzing the report’s framing, omission or historical significance. Do not assume that a clip is safe because it is old, widely reposted, visible on a public website or supplied by a source who does not own it. Clear embedded music and graphics separately, or replace them when the licence does not cover them.
Is footage in the National Archives public domain?
Not automatically. The National Archives and Records Administration (NARA) states that works created by U.S. federal officers or employees as part of their official duties are not eligible for U.S. copyright protection. Its holdings, however, can also contain third-party works, donated collections, contractor material, contractual limits, donor restrictions, publicity rights and other conditions. NARA says, “NARA does not confirm copyright status for any items in its holdings.” It does not indemnify a user or grant a general licence.
Clear an archive item at the record level
- Save the catalogue identifier, title, creator, date, series and the exact file or reel you examined.
- Read the record description, accession or deed information and any rights, restrictions or reproduction notes.
- Determine whether the relevant images and sounds were made by federal employees in official duties or by an outside photographer, broadcaster, contractor or donor.
- Contact the appropriate permissions office or rights holder when ownership, privacy, publicity or contractual limits are unclear.
- Record the conclusion for the specific item and intended use; never convert a clearance for one reel, photograph or territory into a blanket archive clearance.
The same discipline applies to presidential libraries, local government repositories, museums and university collections. “Held by” describes custody, not necessarily copyright or release status.

Do documentary interviewees need to sign a release?
A release is prudent production evidence and is recommended whenever possible, but its legal effect depends on the country, wording, consideration, capacity and actual use. WIPO advises producers to obtain prior written consent whenever possible. A release does not transfer copyright in third-party footage, make an inaccurate edit true, or give you rights the signer does not own.
What an interview release should cover
- the project title or a clearly defined description of the film and related versions;
- recording of voice, image, name, biography and quotations, plus the media, territories, term and promotional uses;
- permission to edit, translate, subtitle, synchronize and combine the interview with other material;
- payment or other consideration, if any, and required credit;
- whether the interviewee has any review, approval, withdrawal or confidentiality right; and
- signatures, date, contact details, authority to sign and a process for minors or representatives.
Stanford’s sample release illustrates how scope, media, name and likeness use, and waiver terms can be spelled out. Adapt a form with counsel; do not copy a template without checking local law or promising approval rights you do not intend to grant.
Conduct a reliable interview
- Explain who is producing the film, the subject, expected distribution and whether the interview may be edited, translated or promoted.
- Ask about the person’s direct knowledge. Mark what they saw or did themselves versus what they later heard.
- Obtain written consent before recording when practicable, and note any accessibility, language, guardian or interpreter needs.
- Preserve the original recording, release, notes and follow-up correspondence together.
- Do not imply that signing guarantees a favorable portrayal or editorial control unless the written agreement expressly provides it.
Research allegations and give the subject a fair chance to respond
Maintain a claim log for conduct, motive, private life and alleged wrongdoing. For each claim, state whether it is a verified fact, a sourced allegation, an opinion or unresolved; list the supporting records; check names, dates, quotations and context; and preserve contrary evidence. Corroborate high-impact allegations independently rather than repeating a single source’s account.
Before locking a substantial adverse assertion, contact the subject or representative with enough detail to understand the allegation and a reasonable deadline. Keep an accurate record of the questions sent, delivery, response, follow-ups and any non-response. Include a material reply or characterize it fairly. Do not call silence an admission. PBS FRONTLINE’s public guidelines treat defamation and invasion-of-privacy review as part of responsible documentary practice alongside releases and rights clearance.

Choose between licensing, exception, replacement and omission
Use this comparison for each disputed asset, then apply local advice where the film will be distributed.
| Route | Best fit | Costs and constraints | Residual questions |
|---|---|---|---|
| Licence | The owner is identifiable and the excerpt is central, creative or commercially sensitive. | Fee, negotiation time, credit, term, territory, edit limits, insurance and platform delivery rules. | Does the grant cover trailers, translations, clips, renewals and every underlying element? |
| U.S. fair use or another local exception | The material is needed to comment on or analyze the source and licensing is unavailable or not proportionate. | Legal review, insurer and distributor scrutiny; no guaranteed outcome and possible territory limits. | Purpose, source nature, amount, market effect, privacy and publicity issues. |
| Replace or limit | The point can be made with a shorter excerpt, original narration, a commissioned image or a cleared recording. | Editorial compromise and possible reshoot or redesign. | Does the substitute still prove the proposition without misleading viewers? |
| Omit | Risk or uncertainty outweighs the scene’s editorial value. | Loss of color, chronology or a contested perspective. | Can the gap be disclosed or filled with independently sourced evidence? |
Compare not only legal theory but also licence price, deliverable specifications, insurance, takedown exposure and whether a platform will demand documentation.
Final clearance and delivery checklist
- Every asset has an owner, source record and licence or exception analysis.
- Archive items have been checked individually; custody has not been treated as public-domain proof.
- Interview releases match actual territories, media, term, edits and promotional plans.
- Music, photographs, graphics, quotations and embedded third-party works are cleared separately where necessary.
- Claims are labelled as fact, allegation, opinion or unresolved, with contrary evidence retained.
- The subject received a fair opportunity to respond to substantial adverse claims.
- Privacy, publicity or personality rights were assessed for recognizable people, including people not named on screen.
- An entertainment lawyer or qualified documentary-clearance professional reviewed unresolved fair-use choices, sensitive allegations, private facts, disputed releases and international versions.
- Insurance and distributor requirements were checked against the final cut, trailer, posters, subtitles and clips.
- The rights map, releases, permissions, source files and legal memoranda are stored with version dates and access controls.

Frequently Asked Questions
Does a public figure have to approve my documentary before release?
No general approval right follows from public-figure status. You may still need permission for particular copyrighted assets, and privacy, publicity, defamation and contractual issues can require changes or legal review.
Is a short clip automatically fair use?
No. U.S. fair use considers purpose and character, the nature of the source, the amount and qualitative importance used, and market effect. Courts assess the complete context; no fixed seconds rule exists.
Can an interviewee withdraw after signing?
That depends on the release and governing law. A clear written agreement may limit withdrawal, but capacity, coercion, promised approvals, privacy law and specific contractual terms can change the analysis.
Who is responsible when an archive cannot confirm copyright status?
The producer must assess the specific item and intended use, seek permissions or a licence where needed, and manage the remaining legal and insurance risk. Archive custody or a catalogue listing is not a blanket clearance.
